BE IT ORDAINED by the Common Council of the City of South Bend, Indiana.
SECTION 1. - That the Department of Public Parrs be and the same
is hereby authorized and permitted to grant an ease-
ment to the Indiana and Michigan Electric Company,
permitting it to overflow with water, in the event
the same becomes necessary for its purpose, the fol-
lowing described real estate, situate in Section 26,
Township 38 North, Range 2 East, St. Joseph County,
Indiana, described as follows, to -wit:
Beginning at a point on the left bank of
the St. Joseph River, which point is Eleven Hund-
red sixty -two and ninety -two hundredths (1162.921)
East and Eleven Hundred Two and Ninety -four Hun-
dredths (1102.941) feet North of the Southwest
corner of said Section Twenty -six (26), Township
and Range aforesaid, running thence North Twenty -
seven (27) degrees and thirty -seven (37) minutes
West Three Hundred sixty -eight and seven tenths
(368.7) feet; thence by a six (6) degree curve to
the right having a central angle of Fifty -four (54)
degrees and a radius of Nine Hundred fifty -five
(955) feet, Nine hundred (900) feet; thence North
Twenty -six (26) degrees and twenty -three (23)
minutes East Six Hundred Seven (607) feet to the top
of the North (left) bank of the St. Joseph River;
thence North Eighty -seven (87) degrees and fifty -six
(56) minutes East Eighty -four and eight - tenths (84.8)
feet; thence South Six (6) degrees and ten (10)
minutes East Eighteen Hundred eighty -five and six -
tenths (1885.6) feet, to the South (left) bank of
the St. Joseph River; thence North Fifty -eight (58)
degrees and thirty -four (34) minutes West Four
Hundred seven and four- tenths (407.4) feet to the
place of beginning.
Also a strip of land Fifty (50) feet in width
lying to the West of and immediately adjacent to the
following described line: Beginning at a point on
the left bank of the St. Joseph river, which point
is Eleven Hundred and Sixty -two and Ninety -two
hundredths (1162.92) feet mast and Eleven Hundred two
and ninety -four hundredths (1102.94) feet North of
the Southwest corner of said Section Twenty -six (26),
Township and Rae aforesaid, running thence North
Twenty -seven (27) degrees and thirty -seven (37)
minutes West Three hundred sixty -eight and seven -
tenths (368.7) feet; thence by a six (6) degree
curve to the right having a central angle of Fifty-
four 54) degrees and a radius of Nine Hundred fifty-
five (955) feet, Nine Hundred (900) feet; thence North
Twenty -six (26) degrees and twenty- t,�Lree (23) minutes
East Six Hundred and Seven (607) feet to the top of
the North (left) bank of the St. Joseph River.

SECTION 2. The said Department of Public Parks and the Mayor
and Clerk of the City of South Bend, Indiana, are
hereby authorized and permitted to make such con-
veyance and grant of said easement as may be neces-
sary in the premises.
SECTION 3. - The Judge of the St. Joseph Circuit Court is hereby
requested to appoint three (3) disinterested free-
holders of the City of South Bend, to appraise the
easement rights to overflow by water the above des -
cribed premises.
SECTION 4. - This Ordinance shall be in full force and effect
from and after its passage.
