AN ORDINANCE AMENDING SECTION 22 DF AN ORDINANCE
NUT,MERED 2682, BEING AN ORDINANCE REGULATING THE PRODUCTION,
GRADING, LABELING, HANDLING, PASTEURIZATION, DISTRIBUTION AND
SALE OF MILK, CREAM AND CERTAIN MILK PRODUCTS AND PROVIDING FOR
ISSUING LICENSES THEREFOR.
Be it ordained by the Common Council of the City
of South Bend, Indiana;
Section 1. That Section 22 of `rdinance Numbered
2682 be and the same is hereby amended by adding thereto Section
22 -B, to read as follows:
'Section 22 -B. No person, firm or corporation
shall deliver any milk and /or cream to any residence except be-
tween the hours of 6:00 A.M. and 1 :00 P.M. of any day, provided,
however, that the hours during which delivery may be made can be
changed by the Secretary of the Board of Health, whenever in his
judgment the public health and welfare require such change, pro-
vided, however, that this section shall not be applicable in any
case where such person, firm or corporation shall have obtained
permission, due to an emergency, from the Secretary of the Board
of Health to make delivery and operate a vehicle or vehicles
during the remaining hours of any day, provided, however, that
this section shall not apply to the delivery of raw milk and /or
cream for pasteurizing to a licensed pasteurizing plant."
Section 2. That this "rdinanee shall be in full
force and effect from and after its passage and legal publication
thereof.
