AN ORDINANCE TO PROMOTE PUBLIC HEALTH BY PROVIDING SANITARY AND
HEALTH REGULATIONS FOR BARBER SHOPS AND ESTABLISHMENTS AND IN
THE PRACTICES OF BARBERING; PROVIDING FOR SUPERVISION AND
INSPECTION AND PRESCRIBING PENALTIES FOR VIOLATIONS.
SECTION ONE. DEFINITIONS: Unless the context otherwise
requires, the following terms as used in this ordinance shall
be construed according to the definitions given below.
BARBER. Every person who shaves or trims the beard or
cuts the hair, or gives facial or scalp massage or facial or
scalp treatments with oil or cream and other preparations made
for that purpose, either by hand or by mechanical appliances,
or singes or shampoos the hair, or applies hair tonic to or
dyes the hair of any person, provided; however, nothing in this
ordinance shall be construed to include a person performing such
services upon members of his immediate family, person licensed
by law of this state to practice medicine or surgery also under-
takers, morticians and registered nurses, in connection with
their professional duties. Registered beauty culturists under
the Indiana Beauty Culture Act, shall be exempt from this Act
insofar as covered in the Beauty Culture Act, and they shall be
permitted to cut, trim or snip, the stray or straggling ends
of hair of a patron or customer incidental to and in connection
with arranging or dressing of a woman's hair.
BARBER SHOP. Any place where the aforesaid work of business
of a Barber is performed; the term shall include Barber School,
and Barber College and shall be any premises, buildings, or any
parts of a building or place whereupon or within which any
combination of the practice of barbering as herein defined is
carried on.
BARBER CHAIR. Shall include each and every chair, stool
or contrivance on which a person sits or reclines for the purpose
of receiving any of the services rendered by a Barber as de-
fined by this Ordinance.
PERSON: To include an individual, firm, corporation or
o- partnership.
SINGULAR.
Shall
include

GENDER.
Shall
include feminine gender.
SECTION TWO. It shall be unlawful for any person to engage
in the business of Barbering or operating a Barber Shop without
first having obtained a City License therefor.
SECTION THREE. APPLICATION REQUIREMENTS. Every person
esiring a license to engage in the business of Barbering or
onducting or operating a Barber Shop in the City of South Bend
hall appear in person at the office of the Health Director, in the
ity of South Bend and make application therefor, giving the
ollowing information:
1. _Name of Applicant
2. Number of Indiana-Certificate of license for the
year in which the person applies for a. City License.
S. Location of Shop or place where_ 'it is` proposed to
carry on business.
INSPECTION OF PROSPECTIVE -PLACE OF BUSINESS. It shall -be
the duty of the Health Director and the Inspector of Health
to investigate such proposed place of business, and if-it-shall
appear to the Health Director, and the Inspector of Health, that
the applicant has complied with all the provisions of this
Ordinance and the Indiana State Barber Law, and any act con-
cerning cosmetology, and that the place where the applicant pro-
poses to carry on business is a proper and sanitary place there-
for within the provisions of this Ordinance, the Health Director
and the Inspector of Health, shall endorse a° recommendation
to the Qity..Comptroller that .a. license be issued to such,app-
licant and upon the receipt °of such recommendation, it shall '
be the duty of the City Comptroller to issue such license:
Applications must be submitted within 15 days after the eff-
ective date of this Ordinance.
This procedure for granting license shall apply only -to`
such persons as are found to be'practieing the profession of
Barbering in the City of South Bend at the time this'- 'Ordinance
becomes effective. Any person entering the City of South Bend
after this ordinance becomes effective, who may be desirous of
procuring.a license - hereunderi shall appear in person at the
office of the Health Director in the City of South Bend. The
Health Director-shall ascertain the name of the applicant, - -'
number of state certificate of license, and location of Shop or
place where it is proposed to carry on business. If the appli-
cant is s.Journeman he.shall give the name of the Shop owner
who desires the service of the Applicant Applicant shall pay
$2.00 in advance on applying for license. If the applicant
shall have qualified, then on recommendation of the Health
Director, the City Comptroller shall issue'a City License to`
the Applicant.
SECTION FOUR. LICENSE FEE AND RENEWAL. Each and every,
person now engaged in the business of Barbering it the City of
South Bend or-operating a Barber Shop,' shall pay to' the City
of South Bend, through the City Comptroller, a license fee of.
$2.00 in advance, said license to terminate one year from date
of issuance,`and vay be reneged upon expiration, by payment in
advance of an annual fee of $2.00.
Any Barber who is now a resident of the City of South Bend,
shall apply for license within fifteen days from the effec-
tive date. of this ordinance, and shall pay a license fee of
$2.00 in advance on applying for a license.
SECTION FIVE. LICENSE NOT T.0 BE TRANSFERRED. Such license
shall not be transferable, but nothing herein contained shall
present any person licensed under the terms of this Ordinance
from using his or her license in case or removal of his or her
business to another location within the City Limits of the City
of South Bend. = Any license issued under' the terms of this
Ordinance shall" "be placed in a .conspicuous place in said Barber
Shop.
SECTION SIX. SANITARY REQUIPMaNTS.
1. Separate Room. A Barber License shall not be issued
where the Barber Shop (or Barber Chair) shall be loc-
ated in a residence or in connection with living,.dining
or sleeping rooms or in connection with any business
which serves the public with drinks or eatables Pro -
vided, that this prohibition shall not apply to hotels.
2. Shop To Be Sanitary, Well Lighted and Ventilated.
Every Barber or person in charge of any Barber Shop
shall keep said Shop in a clean and sanitary condition.
Every Barber Shop shall be well lighted and ventilated.
All wood floors shall be covered with Linoleum, tile or
other hard surfaced floor coverings.
3. Care of Walls and Ceilings. The walls and ceilings steal
be painted, whitened or papered and kept free from dust,
grease or grime.
4. Maintenance. The floors, ceilings, sidewalls, furniture
and fixtures, must be kept free from all unsightly and
unsanitary dust and grime. All Barber Shops shall be
open for inspection at all times during ubsiness hours
to the Health Director or his Assistants. Hot and Cold
running water from the public water system in such quan-
tities as are necessary to conduct such establishemt
shall be at all times kept in a thoroughly clean con-
ditions. All waste water lavatories, commodes or other
drains must be connected to the City sewer.
5. Barbers To Be Free From Contagious or Venereal Disease.
No person suffering from a contagious or venereal dis-
east shall be licensed to Barber in the City of South
Bned. When it becomes known that a Barber is oper-
ating a Barber Chair while suffering from a contagious
or venereal disease, said Barber shall have his City
License revoked until such time as he is pronounced heal
ed by the Health Director. The Health Direeotor shall
have the right and power to call any Barber in the City
of South Bend for a health examination at any time.
6. Barbers Must Wash Their Hands with soap and water before
attending any person.
7: No Barber Shall Permit Any Person To Usd The Head
Rest of any Barber's Chair under his control unless
the head rest is covered by a clean new paper.
8. Shaving Persons With Skin Disease. No person with
any communicable or contagious disease of the face or
scalp, shall be served in a public Barber Shop.
9. For Shaving, Barbers shall use a separate.lather of
each customer.
10. Common Towel Prohibited. No Barber shall use for the
service of any customer any towel or wash cloth that
has not been boiled and laundered since last used.
11. Care of the Hair Cloth. No hair cloth shall be placed
around the neck of any customer unless the same is
placed over a clean fresh laundered towel, sanitary
cloth or other material, and such towel, sanitary cloth
or other material used shall not be used:on any other
person.
12. Shaving Brushes, Hair Brushes and Combs shall be washed
thoroughly with hot water immediately after each use
of same. After each service of a customer, and the comb
used shall be placed in a liquid disinfectant and a
clean comb used on each customer.
13. All Razors, Needles, Shears and other analogous equip-
ment shall be sterilized by immersion in formaldehyde
of at least forty per cent strength, or any bona fide
sterilizer after each separate use.
14. No Alum or Other Astringent shall be used in stick
form. If used to stop the flow of blood, it must be
applied in the form of a powder or liquid form only.
15. The use of powder puffs, powder brushes and sponges
is prohibited.
16. Sleeping In Shop Prohibited. No Barber Shop shall
be used as sleeping quarters.
17: No Blings Shall be.Drawn or public view obstructed
at any time.
18. All Barber Shops shall remain closed on Sundays and
the following holidays: New Year's Day, Memorial Day,
July 4th., Labor Day Thanksgiving Day, and Christmas
Day. In cases of holidays falling on Sunday, Barber
Shops shall be kept closed on the following Monday/
SECTION SEMEN. REVOCATION OF LICENSE - OR CLOSING OF
BARBER SHOP. If at any time the Health Director deems it nec-
essary to order a Barber Shop closed or a license revoked for
conviction of crime, habitual drunkenness gross incompetency,
or failing to comply with the sanitary rues, he shall so order
the shop closed or licens a revoked until such time as the Health
Director shall declare the shop or barber fit for the continuance
of business. If, however, a shop is closed for lack of sani-
tation and is not declared fit for the continuance of business
within (5) days the Health Director shall declare the shop in
question closed for all times against the present management and
the manager's license permanently revoked.
SECTION EIGHT. PENALTY. Any person violating any of the
provisions of this Ordianane shall upon conviction thereof be
fined not less than$10.00 nor not more then $100.00 for each
offense; and a separate offense shall be deemed committed on each
day during or on which a violation occurs or continues.
SECTION NINE. INVALIDITY. The invalidity of any section
part of a section of this ordinance shall not effect the val-
ty of the remainder of said section or the remainder of this
inance.
SECTION TEN. EFFECTIVE DATE. This Ordinance shall be in
Full force and effect from and after its passages approval and
publication according to law.
