Presented by me to the Mayor of the City of South Bend, Indiana August 11, 92 19 Approved and signed by me-O � I 9 - Clerk Mayor RESOLUTION NO. 1y[ A_ - :&j A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS THE 1200 BLOCK OF WEST WASHINGTON, TO BE AN ECONOMIC REVITALIZATION AREA FOR THE PURPOSES OF A TEN YEAR REAL PROPERTY TAX ABATEMENT FOR WEST WASHINGTON STREET HOUSING WHEREAS, a petition for real property tax abatement has been filed with the City Clerk for consideration by the Common Council of the City of South Bend, Indiana requesting that the area com- monly known as the 1200 block of West Washington Street, South Bend, Indiana, and which is more particularly described as follows: Parcel I: a parcel of land in the Northwest Quarter of Section 11, Township 37 North, Range 2 East, Portage Township in the City of South Bend, St. Joseph County, Indiana, being lots 1 through 8 inclusive and a portion of Spruce Street of John K. Fowler's Sub- division of Bank outlots No. 85 and 86 as recorded in Plat Book 2, Page 13 in the office of the St. Joseph County Recorder; Parcel II: a parcel of land in the Northwest Quarter of Section 11, Township 37 North, Range 2 East, Portage Township in the City of South Bend, St. Joseph County, Indiana, being lots A, B, C, and 103 through 106, parts of Lots 102, 107, 108, and 109, and a vacated alley of Commissioner's Subdivision of Bank Outlot No. Seventy Nine (79) of the Second Plat of Outlots of the Town, now City of South Bend as recorded in Plat Book 3, Page 40, in the office of the St. Joseph County Recorder and being more particu- larly described as follows: Beginning at the southwest corner of Lot A in said subdivision (also being the intersection of the north line of Washington Street and the east line of Walnut Street); thence North, along the east line of Walnut Street, 166.20 feet to the northwest corner of said Lot A; thence East, along the south line of a 14 foot alley, 313.07 feet to the east line of Spruce Street; thence North, along the east line of Spruce Street, 32.9 feet to the south line of a 14 foot alley; thence East, along the south line of said 14 foot alley, 125.05 feet to the east line of a vacated 14 foot alley; thence South, along the east line of said vacated alley, 198.41 feet to the north line of Washington Street; thence West, along the north line of Washington Street, 439.60 feet to the Point of Beginning; Parcel III: a parcel of land in the East half of the Northwest Quarter of Section 11, Township 37 North, Range 2 East, Portage Township in the City of South Bend, St. Joseph County, Indiana, being lots 9 and 10 of Rockafeller's addition to South Bend as recorded in Plat Book 2, Page 8 in the office of the St. Joseph County Recorder; with said real estate having the following Key Nos.: Parcel I: 18- 3072 -2831 18- 3072 -2832 18- 3072 -2833 18- 3072 -2834 18- 3072 -2835 18- 3072 -2836 18- 3072 -2837 18- 3072 -2838 18- 3072 - 2838.01 18- 3072 -2840 18- 3072 - 2841.01 18- 3072 -2841 18- 3072 -2842 Parcel II: 18- 1044 -1903 18- 1044 -1905 18- 1044 -1906 18- 1044 -1907 18- 1044 -1908 18- 1044 -1909 18- 1044 -1910 18- 1044 -1911 18- 1044 -1912 18- 1044 -1913 18- 1044 -1914 18- 1044 -1915 18- 1044 -1917 Parcel III: 18- 1040 -1764 18- 1040 -1763 18- 1040 -1762 be designated as an Economic Revitalization Area under the provi- sions of Indiana Code 6 -1.1- 12.1 -1 et seq. and South Bend Municipal Code sections 2 -76 et sec., and; WHEREAS, the Department of Economic Development has conclu- ded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1- 12.1 -1, et sec. and South Bend Municipal Code sections 2 -76 et seq., and has further prepared maps and plats showing the boundaries and such other information regarding the area in question as required by law; and WHEREAS, the Human Resources and Economic Development Com- mittee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area, NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby determines and finds that the Petition for Real Property Tax Abatement and the State- ment of Benefits form completed by the Petitioner meet the requirements of Indiana Code 6 -1.1- 12.1 -1 et seq., and qualifies under the relevant provisions of South Bend Municipal Code Sections 2 -76 et seq., for tax abatement. SECTION II. The Common Council hereby determines and finds the following A. That the description of the proposed redevelopment or rehabilitation meets the applicable standards for such development. B. That the estimate of the value of the redevelopment or rehabilitation is reasonable for projects of this nature; C. That the estimate of the number of individuals who will be employed or whose employment will be retained by the Peti- tioner can reasonably be expected to result from the proposed described redevelopment or rehabilitation; D. That the estimate of the annual salaries of those indi- viduals who will be employed or whose employment will be retained by the Petitioner can reasonably be expected to result from the proposed redevelopment or rehabilitation; E. That the other benefits about which information was requested are benefits that can be reasonably expected to result from the proposed described redevelopment or rehabilitation; and F. That the totality of benefits is sufficient to justify the deduction, all of which satisfy the requirements of Indian Code 6 -1.1- 12.1 -3. SECTION III. The Common Council hereby determines and finds that the proposed described redevelopment or rehabilitation can be reasonably expected to yield benefits identified in the Statement of Benefits set forth as Sections I through II of the Petition for Real Property Tax Abatement Consideration and that the Statement of Benefits form prescribed by the State Board of Accounts are sufficient to justify the deduction granted under Indiana Code 6- 1.1- 12.1 -3. SECTION IV. The Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Economic Revitalization Area and hereby adopts a Resolution designating this area as an Economic Revitalization Area for purposes of real property tax abatement. SECTION V. The designation as an Economic revitalization Area shall be limited to two (2) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION VI. The Council pursuant to Section 2 -84 of the South Bend Municipal Code finds that ten (10) years is a proper designation in light of the following: (1) 100% of the units will be rented to low income families; (2) $3,450,000 in hard dollar costs is 80% of the $4,000,000 guideline and far exceeds the $1,000,000 guideline for a six (6) year abatement; and (3) The project would be integral part of the neighborhood's larger revitalization plan and the City's redevelopment plans for the area. The Common Council hereby determines that the property owner is qualified for and is granted property tax deduction for a period of ten (10) years. SECTION VII. The Common Council directs the City Clerk to cause notice of the adoption of this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana Code 5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing notice of the public hearing before the Common Council on the proposed confirming of said declaration. SECTION VIII. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
