AN ORDINANCE APPROVING THE ACTION OF THE BOARD OF PUBLIC
WORKS ,AND SAFETY UNDER DATE OF MAY 17 IN PURCHASING
SAID DESCRIBED REAL ESTATE FOR THE PURPOSE OF OB-
TAINING GRAVEL FOR THE CITY SPONSORS SHARE OF
WORKS PROJECT 165 -52 -1130 AND FURTHER AUTHOR-
IZING CONTROLLER TO DRAW CHECKS OUT OF THE
FUND ESTABLISHED FOR THE CITY SPONSORTS
SHARE FOR THE PURPOSE 0^ PAYING FOR
SAID REAL ESTATE.
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana;
Section I. That the action of the Board of Public
Works and Safety under date of May 17, 1937, in entering into
a certain contract as hereinafter set forth be in all things
ratified and approved, it being the understanding of this
Council that this is not a new appropriation but for the
purchase of materials in the form of gravel as a part of the
City Sponsor's Share of Works Project 165 -52 -1130, which
contract is in the following words and figures, as follows,
to -wit;
"CONTRACT FOR THE PURCHASE OF CERTAIN
REAL ESTATE
This agreement entered into by and between Thomas
H. Jackson and Laura Dell Jackson, husband and wife, of St.
Joseph County, and George W. Jackson, single, of St. Joseph
County, <and Emma M. Jackson and Charles R. Jackson, her husband,
of Elkhart County, hereinafter referred to as parties of the
first part and Frederick J. Anderson, Edwin W. Hunter and Fred
Woodward, constituting the Board of Public Works and Safety of
the Municipal City of South Bend, hereinafter referred to as
parties of the second part.
WITNESSETH:
THAT WHEREAS, parties of the first part are owners
of the following described real estate situated in St. Joseph
County, Indiana:
The East z of the North a of the Southwest
4 of the Northwest 1 of Section 34, Town-
ship 38 North, Range 2 East, containing 10
acres more or less.
AND WHEREAS, it is the desire of the parties of the
second part to purchase said property for a gravel pit for the
Municipal City of South Bend.
IT IS STIPULATED AND AGREED by and between the parties
that parties of the second part, subject to the approval of the
Common Council of the City of South Bend, Indiana, will purchase
the property above described from parties of the first part for
the sum of Five Thousand Dollars ($5,000.00) upon the furnishing
to parties of the second part or their assigns of good and
merchantable title to the property described showing no incum-
brances or liens against s &id real estate, and that parties of
the first part stipulate and agree, upon the approval of the
action of the Board of Public Works and Safety in purchasing said
property above described by the Common Council of the City of
South Bend, that they will furnish and deliver unto the said
City of South Bend a Warranty Deed with abstract showing good
and sufficient right to convey the property set out in this
agreement upon the payment by the Municipal City of South Bend
to parties of the first part or their assigns the sum of Five
Thousand Dollars ($5,000.00) as set out in this agreement.
To the carryin; out of this agreement and the pro-
visions and terms hereof the parties bind themselves, their
heirs and successors this 17th day of May.. 1937.

Section II. It is further the sense and order of this
body that upon the furnishing to the Board of Public Works and
Safety of an abstract showing good and merchantable title in the
property described the City Controller and the proper officers
are authorized to make payment in accordance of the terms of
said contract and charge the payment to Account I -12, which is
Appropriated for the purpose of paying the Sponsor's Share of
Works Project 165 -52 -1130.
Section III. This ordinance shall be in full force
and effect from and after its passage and signature by the
Mayor.
