Carroll St.ORDINANCE No.-,3,;2 /7 X1_ Passed by the Common Council of the City of South Bend, 193 City Clerk Presented by me to the Mayor of the City of South Bend, Approved and signed by / -:)V • , -40107 of Common Council Clerk i, i/ ORDINANCE N0. 3 a Zd WHEREAS, the Grand Trunk Western Railroad Company now maintains automatic flasher signals at the crossing of its tracks over South Eddy Street, South Notre Dame Avenue, South Columbia Street and South Carroll Street, in the city of South Bend, Indiana, .,. WHEREAS, arrangements are now being made by the Grand Trunk Western Railroad Company and the receiver of Northern Indiana Railway, Inc. for the use of the Grand Trunk's tracks in transferring street ears owned by Northern Indiana Railway, Inc. from the North to the South side of the St. Joseph River, and WHEREAS, it will be necessary for the tracks of the Grand Trunk Western Railroad Company to be grounded with a.high voltage current in order to make possible the use of said tracks for the operation of electric cars over the same, and WHEREAS, the electrification of said tracks will interfere with the operation of the flasher signals at the above mentioned crossings, and WHEREAS, the Grand Trunk Western Railroad Company maintains regularly, only four (4) switching movements over said crossings and streets daily, and WHEREAS, said Railroad Company is willing to protect and guard said street crossings by placing a member of the train crew to watch for traffic and act as flagman while said train movements are operating over said streets, NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of douth Bend, Indiana, that the Grand Trunk Western Railroad -1- Company is hereby relieved of any obligation to maintain automatic flasher signals at the crossings of its tracks over South Eddy Street, South Notre Dame Avenue, South Columbia Street and South Carroll Street in the city of South Bend, provided, however, that whenever any trains are crossing any of said streets, it shall be necessary for said Railroad Company to protect the crossings by having 9 member of the crew of any such train operating over said streets, to act as flagman and warn and stop.any traffic-that may be using said streets during the time of said train operations over the same. Section 11. `This ordinance shall be in full force and effect from and after itd''enaetment,, and the approval of the Mayor.
