AN ORDINANCE AMENDING ORDINANCE
NO. 2243 CORDIONLY KNOWN AS
BUILDING CODE OF THE CITY OF
SOUTH BEND, INDIANA
SECTION 1. Be it ordained by the Common Council of the City of
South Bend, Indiana, that Sections No. 832, 835, 836, 838, 842, 84
'S' commonly known as the
and 849, Article XLV of Ordinance No. 2243, Y
Building Code of the City of South Bend, Indiana, be and the same
are hereby amended to read as follows, to -wit=
BOND. Sec, 832. Every person, firm or corporation4an
g signboard &, billboardq, sky signf
or banner sign within the City of South Bend shall annually file
with the City Controller a good and sufficient bonds running to the
City of South Bend, in the penal sum of $5,000.00 to indemnify,
save and keep harmless the City of South Bend from any and all costs
and /or damages, which may be suffered by the City of South Bend or
expense of any kind whatsoever to which it may be put or which may
accrue against said City boy reas on of the granting of permission to
erect or alter Any signboard, billboard, sky -sign or banner sign
or from or by reason of any acts or things done under or by authority
of permission granted by said City to erect any signboard, billboard,
sky -sign or banner sign in said City of South Bend, as well as to
indemnify any and all persons who may suffer injury or damages by
reason of the erection and constructionAof any such signboard,
billboard, sky -sign or banner sign.
HEIGHT OF TOP AND BOTTOM. Sec, 835. No signboard or billboard
hereafter erected on an•open lot shall be set with its top no higher
than 22 feet above the ground at its highest point, nor with its
bottomless than two and one -half feet above the ground at its
nearest point. If, however, the level of the ground where the bill-
board or signboard is to be erected is above the level of the street
then the bottom of the face of the same must be at least two and one -half
feet above the level of the ground at the point where the board is
to be erected. Every such billboard or signboard must be constructed
and located in accordance with the provisions of this article and
shall be subject to the approval of the Commissioner of Buildings.
The space beneath such billboards or signboards shall not be closed,
except wire screen, Mesh or open lattice may be used to prevent
trespass.
1 DISTANCE FROM STREET OR LOT LINE. Sec. 836. No signboard
�J or billboard larger than 12 square feet (unless erected flat against
the wall of a building) shall be located within 5 feet of the street
lot line on any street or public highway, except where the lot on
which said board is located is adjoined on both sides by business
buildings situated nearer to the street lot line, in which event,
the signboards or billboards may be even with the front main building
line of the building next on either side of such board which is
farthest from the street lot line, except in Commercial or Industrial
Zones, in which localities signboards and billboards can be built
von the building line. No signboard or billboard shall be erected
or maintained closer to any building than three feet, except as
herein otherwise provided.
CHANGE IN EXISTING BILLBOARDS AND SIGNBOARDS. Sec. 838.
No surface billboard or signboard constructed or erected prior to
the passage of this amendment shall be maintained after January 1,
1941 where the height of such signboard or billboard exceeds 22 feet
or is closer to the street lot line than herein permitted. No
such billboard or signboard shall be maintained after such date,
unless there is a clear space of at least two and one half feet above
the level of the adjoining street, with the exception that open
lattice may be used on this space.

If, however, the level of the
ground where the billboard or signboard is erected or maintained
is above the level of the street, then there must be a clear space
of at least two and one —half feet between the bottom or face of the
billboard or signboard and the level of the ground at the point
where the signboard or billboard is erected or maintained.
SUPPORTS AND ANCHORS. Sec. 842• All signs, signboards
or billboards attached to or placed upon roofs, walls or any other
parts of buildings shall be thoroughly secured thereon in an approved
manner by iron or metal anchors, bolts, supports, chains, guys or
braces.
SKY OR ROOF SIGNS. Sec, 814, All sky or roof signs or
billboards having the bottom ed;e placed 25 feet or more above
the ground or grade level, and all other sky or roof signs, or
billboards over 25 square feet in area shall be made entirely of
metal or other non— combustible material with exception that wood
may be used on face for trim and bottom lattice. No sky or roof
sign or billboards shall be placed so that the face of said sky or

roof sign or billboard shall come within three feet of the inner
plane of the outer wall of such building, or so that the bottom of
such sky, roof sign or billboard shall be less than one foot or more
than ten feet above the surface of such roof, provided however, that
the provisions of this paragraph shall not apply to sky, roof signs
or billboards having the bottom edge placed not more than 25 feet
above the ground or grade level and having a height of not more
than twelve feet.
EXISTING BOARDS. Secs 849, All signs, signboards and
billboards, when the same are repaired, altered or changed, shall
be made to conform to the provisions of this ordinance. All double
deck sign or billboards and all signboards the height of which
exceeds 22 feet, or the length or location of which does not comply
with the provisions herein contained and all signs the construction
or location of which does not comply with the provisions herein

contained, shall be made to conform with this ordinance, or removed
entirely. This article shall not apply to electric signs*
SECTION 2. Be it further ordained by the Common Council
of the City of South Bend, Indiana, that Section 833 of Article
XLV of Ordinance No. 2243, commonly ]mown as the BuildingCode
of the City of South Bend, Indiana, which said section is entitled
"Billboards on Buildings ", be and the same is hereby repealed,
SECTION 3e This ordinance shall be-in full force and
effect after its passage and legal publication, and the penalties
provided in Section 867 for violation of the several provisions
of said original Ordinance No. 22143 shall apply to the sections
as amended hereby.
