AN ORDINANCE APPROVING A CONTRACT ENTERED
INTO BY AND BETWEEN THE BOARD OF PUBLIC WORPu9 AND
SAFETY OF THE CITY OF SOUTH BEND, INDIANA, AND THE
MUNICIPAL SUPPLY COMPANY FOR THE PURCHASE OF A STREET
SWEEPER.
WHEREAS, the Board of Public Works and Safety has prepared and
filed specifications and advertised and received bids for the purchase of
one small street sweeper for the street department of the city of South Bend,
and after having received bids, entered into a contract with the Municipal
Supply Company of South Bend, Indiana, for the purchase of a street sweeper,
said company being the lowest bidder, which contract calls for the furnishing
of said sweeper to the city of South Bend, Indiana, for the sum of Thirty -four
Hundred ($3400.00) Dollars.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the city of
South Bend, Indiana;
SECTION ONE. That the contract entered into between the Board of
Public Works and Safety of the city of South Bend, and the Municipal Supply
Company, on the 17th day of June, 1940, which contract provides for the fur-
nishing of a "Gutter Snipe" motorized street sweeper for the South Bend Street
Department by the Municipal Supply Company, for the sum of $3400.00, to be
paid by the city of South Bend, in accordance with the provisions of said con-
tract, a copy of which contract, specifications,and proposal of the Municipal
Supply Company being attached hereto, be, and the same is, in all things hereby
confirmed, ratified and approved by the Common Council of the city of South
Bend, Indiana.
SECTION TWO. This ordiaanee shall be in full force and effect from
and after its enactment and approval by the mayor.

This agreement entered into this 17th day, of June, 1940, by
and between the City of South Bend by and thru its Board of Public
Safety, hereinafter referred to as the "City ", and the Municipal
Supply,Co«., of South Bend, Indiana, hereinafter referred to as
the "Contractor %.
WITNESSETH: Whereas the City has adopted a resolution for the
purchase of one street sweeper and has adopted specifications for
said street sweeper and received bids thereon, and thi: Municipal
Supply Coo, having been the lowest and bast bid for said equipment,
it is now agreed by and between the parties hereto, that the
"Contractor" will furni h to the "City ", one (1) "Gutter Snipe"
sweeper as called for by the specifications of the "City", and
as is more particularly described in the proposal submitted with
the bid of the "Contractor ". Said apecifications and proposal are
both made a part of this contract, and marked exhibits "A" and "B"
respectively..
Said equipment will be delivered to the "City" on or before
the lst of July$ 1940.

Said "Contractor" warrants that said equipment will be free
from all defects of workmanship and material, and that they will
furnish an instructor to teach designated employees of the "City"
the proper use of the equipment,: and in consideration for furnish-
ing said equipment by the "Contractor ", the "City" agrees to pay
to the "Contractor", the sum of 53400 -.:00, thirty days after delivery..
It is further agreed by and between the "City ", that before
final acceptance of said equipment, it shall pass such tests as
may be prescribed by the Street Department and/or the rmgineering
Department of the City of South Bend..
IN WITNESS '411SRECPs both parties set the hands and seals hereon,
