ORDINANCE NO 3 '5Z&
AN ORDINANCE AUTHORIZING THE SALE OF
STREET CAR TRACKS, South Bend, Indiana.
WHEREAS, the city of South Bend, Indiana, and the North-
ern Indiana Transit, Inc., have entered into a contract for the
substitution of bus service for street car service in the city of
South Bend, and
WHEREAS, by the terms of said contract the Northern
Indiana Transit Inc., gave to the city of South Bend, steel rails
constitutiong the tracks of their street car lines, and
WHEREAS, it is desirable to remove said rails from the
streets and dispose of them as rapidly as possible in order that
the streets may be reconditioned in the track areas,
NOW THEREFORE, BE IT ORDAINED by the Common Council of
the City of South Bend, Indiana.
Section 1. That the Mayor and Board of Public Works and
Safety are hereby authorized and empowered to sell all rails which
constituted the tracks of the former street car system of the city
of South Bend, and also the rails on that portion of the Notre Dame
line which lie outside of the city of South Bend; said sale to be
made only after the Circuit Court Judge has appointed three disin-
terested citizens of the city of South Bend, Indiana, to appraise
said property, and afterthe report of said appraisers has been made
and filed with the B oard of Public Works and Safety, and said prop-
erty shall be sold for not less than the full appraised value as the
same is determined by said appraisers.
Section 2. Said propetty may be sold by the Mayor and
the Board of Public Works and Safety in bulk, in sections or on a
tonnage basis, or in any manner which is deemed to be to the best
advantage of the city.

Section 3. This ordinance shall be in full force and ef-
