HomeMy WebLinkAboutRegulating & Licensing Amusement Parks and Providing a Penalty for Violation ThereofORDINANCE No. Passed by the Common Council of the City of South Bend, M Presented `me-to the Mayor of the City of South Bend, Approved and signed by me -NeW7 FA Clerk of Common Council Clerk ORDINANCE NO. 32 13' AN ORDINANCE REGULATING AND LICENSING AMUSEMENT PARKS AND PROVIDING A PENALTY FOR VIOLATION THEREOF BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. That it shall be unlawful for any person, firm or corporation to operate and maintain within the City of South Bend any amusement park without first having obtained and received a license for the same from the City Controller. Section 2. Any such person, firm or corporation desiring to operate and maintain such an amusement park within said city shall be required to pay to said City Controller for such license an annual fee of One Hundred ($100.00) Dollars. Section 3. The words, "amusement park,^ shall be construed to include and mean any plot of ground upon which is operated for profit a general amusement and recreation business, consisting of rides, concessions, exhibitions, shooting galleries and similar games of skill, strength - testing devices, shows, acts, musical pro- grams, theatrical productions, refreshment and food dispensing units, dances, roller skating, swimming, athletic contests and all other productions, performances, programs, events and concessions designed and intended for the amusement, recreation, comfort, con - venience and pleasure of the patrons thereof. Section 4. The annual license fee hereinabove prescribed shall cover such amusement park and all such exhibitions, amusement rides, concessions, shows and performances therein, which shall be exempt from other licenses and permit fees prescribed by other ordinances now in force and effect and from the application of any such ordinances applying thereto. Nothing contained herein, however, shall exempt automobile races, motorcycle races, dance halls, roller - 1 - skating rinks or restaurants operated and maintained in said amuse- ment parks from the operation of particular ordinances of said City now in force and effect, prescribing license and permit fees therefor. Section 5. No provisions of this ordinance shall be so construed so as to prevent the holding of any fair, bazaar, perform- ance, concert or entertainment, the,profits of which are to be devoted exclusively to any religious, charitable, literary or scientific purpose, without license therefor. Section 6. No person, firm or corporation to whom any license may have been granted under the provisions of this ordinance shall conduct or maintain any such amusement park or any such performance, show, exhibition or concession in an indecent or immoral manner. For any violation of this provision, said license may be revoked and the offender shall be subject to the penalty hereinafter provided. Section 7. No license granted under the provisions of this ordinance shall be transferable. Section 8. All ordinances regulating and licensing amuse- ment parks in conflict herewith are hereby repealed. It is express- ly ordained that licenses heretofore granted by said City under then existing ordinances shall be good and valid till the time of ex- piration of such licenses. Section 9. Any person, firm or corporation violating any provisions of this ordinance shall be fined in any sum not exceeding One Hundred ($100.00) Dollars and each day of violation shall consti- tute 'a separate offense. Section 10.
