AN ORDINANCE AUTHORIZING THE SALE OF ALL
OF THE RIGHT, TITLE, AND INTEREST OF THE
CITY OF SOUTH BEND, INDIANA, IN AND TO
ANY BONDS, COUPONS, AND /OR ASSESSMENTS
HERETOFORE ISSUED UNDER IMPROVEMENT RESO-
LUTION NO. 1544, APPROVED OCT. 63 1926,
COVERING ASSESSMENT ROLL NO. 1952, THE
FAIRVIEW- -MAIN STREET TRUNK SEWER.
WHEREAS, the City of South Bend, by virtue of the judgment and
decree of the St. Joseph Superior Court No. 2 in the case of Read et al.,
vs. Beczkiewica, et al, being Cause No. 54558, is the owner of certain right,
title, and interest in and to certain improvement bonds and coupons and
assessments in Improvement Roll No. 1952, the Fairview —Main Street Trunk
Sewer, which said bonds and coupons were issued and said assessments were
levied pursuant to the provisions of Resolution No. 1544 of the Board of
Public Works of the City of South Bend on the 6th day of October, 1926; and
WHEREAS, one Wilford V. Walz has offered to purchase all of the
right, title, and interest of said city in and to said bonds, coupons, and
assessments;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana, that the Judge of the Circuit Court of St. Joseph
County is hereby requested to appoint three disinterested freeholders of
this city for the appraisement of the right, title, and interest of the city
in and to the bonds, coupons, and /or assessments of the Improvement Roll No.
1952, issued pursuant to Resolution No. 1544 of the Board of Public Works on
the 6th day of October, 1926, now owned by the City of South Bend, Indiana,
BE IT FURTHER ORDAINED by the Common Council of the City of
South Bend, Indiana, that the City of South Bend sell, assign, transfer, and
set over by proper instrument of assignment to Wilford V. Walz all of the
right, title, and interest of said City of South Bend in and to the bonds,
coupons, and /or assessments issued or levied pursuant to the provisions of
Resolution No. 1544 of the Board of Public Works dated October 6, 1926, and
being Improvement Roll No. 1952, the Fairview —Lain Street Trunk Sewer, for
not less than the full appraised value thereof, as reported by the apprais-
ers appointed by the Judge of the St, Joseph Circuit Court, pursuant hereto;
and the Mayor is hereby ordered, directed, and authorized to execute and
deliver to said Wilford V. Walz upon the payment of said sum of money a good
and sufficient assignment and bill of sale therefore; and this shall be a
sufficient authority to him in said premises.
