ORDINANCE NO. 417
AN ORDINANCE AUTHORIZING THE TRANSFER OF CERTAIN DESCRIBED
REAL ESTATE FROM THE CITY OF SOUTH BEND TO THE STATE. ARMORY
BOARD OF THE STATE OF INDIANA BY WAY OF A DONATION; RESERVING
AN EASEMENT OVER CERTAIN OF THE LAND SO DONATED; LIMITING THE
DONATION TO THE USE OF SAID LANDS FOR ARMORY AND MILITARY
PURPOSES; PROVIDING FOR THE REVERSION THEREOF UPON THE CESSATION
OF SUCH USES; DECLARING AN EMERGENCY.
Whereas, the State Armory Board is desirous of pro-
viding additional grounds about the Armory Building in the City
of South Bend,, Indiana and has requested the City of South
Bend, Indiana to make it a donation of such additional grounds,
and
Whereas, the City of South Bend has such grounds
available under the care and management of the Department of
Public Parks; and
Whereas, the Department of Public Parks of the
City of South B9ndand the Boards of Public Works and Safety
of said city h2ve both indicated their willingness Q- such
donation be made; and
Whereas, such donation would be to the benefit
of the City of South Bend and of the State of Indiana in
connection with the present war effort.
Now, therefore, be it ordained by the Common Council
of the City of South Bend that:
Section 1. The proper officers of the City of South
Bend are hereby authorized to make a donation of and to execute
for and on behalf of the said city a deed to the State Armory
Board of the State of Indiana for the following described real
estate in the City of South Bend, St. Joseph County, State of
Indiana, towit:
Beginning at a point one hundred and seventeen and
three- tenths feet (117.3) South measured on the
section line and ten feet (101) West of the South-
easterly corner of Lot 20 in August Beyer's First Ad-
dition to the City of South Bend, Indiana; thence
West a distance of one hundred and sixty feet (1601);
thence South for a distance of one hundred and twenty
feet (1201); thence East a distance of one hundred
and sixty feet (1601) to a point ten feet (101) West
of the East line of Section 12, Township 37 North,
Range 2 East; thence South and Southwesterly parallel
with the West line of Eddy St. to the St. Joseph River;
thence Northwesterly along the river to the West end
of an East -West line which is one hundred and fifty -five
feet (1551) North of the point of beginning; thence
East along this East -West line to North Side Boulevard;
thence Southeasterl along North Side 'boulevard to a
point ten feet (101 West of the East line'of Section 12;
thence South to the place of beginning.
Section 2. Said officers shall in such deed reserve
and retain for and On behalf of the City of South Bend, anc
easement for possible bridge construction or relocation on
that portion of the above described land which is described
as follows; towit:
Beginning at a point two hundred and eighty -seven
and three- tenths feet (287.3) South and ten feet
(101) West of the Southeasterly corner of Lot 20 in
August Beyer's First Addition to the City of South
Bend; thence South 400 West to the St. Joseph River;
thence Southeasterly along the St. Joseph River to
the Sample St. bridge; thence Northeasterly and
North parallel to Eddy St. to the place of beginning.
Section 3. Said officers are ordered and directed to
make the donation of said land, and the transfer thereof contin-
gent upon the use thereof for Armory or Military purposes or both
and to provide that upon the cessation of such use or uses the
land shall revert to the City of South Bend, Indiana for park
purposes.
Section 4. The transfer of said land to the State
Armory Board of the State of Indiana is an emergency matter.
Section 5. Said officers are ordered and directed to
obtain an agreement with the State Armory Board of the State of
Indiana simultaneously with the delivery of the deed herein re-
ferred to providing for the construction of a fence by the State
Armory Board to separate the land donated and the balance of
the property owned by the city and used for park purposes, said
fence to be built when funds and material therefort,: are available.
Section 6. This ordinance shall be in full force
and effect from and after its passage by the Common Council
and its approval by the Mayor.
