ESTATE; DIRECTING AND AUTHORIZING THE PROPER OFFICERS OF THE CITY OF SOUTH BUD TO KUM AND EFFECT THE PURCHASE OF CER- TAIN REAL ESTATE AT THE PRICE OF $16 #0001 AUTHORIZING THE PROPER OrPICERS OF THE CITY OF SOUTH BEND TO ASSIGN SAID PROPERTY TO THE DEP;IRTMENT OF PUBLIC PARKS OF SAID CITY FOR USE FOR PARK PURPOSES; AND DECLARING AN EMERGENCY. Whereas* the Department of Public Parks of the City of South Bend is, and has been, desirous of furnish - ing park and playground facilities readily accessible to the residents of said city living in that portion thereof, commonly known as the Northwest section, and has an offer for.the sale of approximately sixteen acres of land lying insaid Northwest section which land is the only open area in said neighborhood upon which there is a substantial woods or grove; and, Whereas, the said neighborhood is greatly in need of improved park and recreation facilities which will be more difficult and more expensive to obtain if this offer of sale is not accepted and said land is disposed of in small parcels to other purchasers; and, Whereas, the said land as it now exists is over- grown with weeds and underbrush,ead is an unsightly area and a place in which many incidents.enbarrass.ing to the neighbors and leading to the delinquency of minors have been committed; and, Whereas neither the Department of Public Parks nor the City of South Bend has any appropriation out of which this land may be purchased, Now, therefore, be it ordained by the Common Council of the City of South Bend that; v/ Section 1, The amount of ;16,000 be, and the same iss hereby transferred from the General Fund of the City Of South Bend, Indiana to the budget of the Board of Public Works and Safety of said City. The said amount , and the same is, hereby appropriated for the purchase of the following de. scribed real estate located in the City of South Bend, County of St, Joseph, State of Indiana, towit: A parcel or tract of land located in the Northwest quarter ( -) of Section No, 2, Township 37 North, Flange 2 East, and bounded by a line running as follows. Beginning at a point thirty (Sot) feet East and twenty (201) feet South of the Northwest corner of said Section 2, which said point is the Southeast corner of E1- mood Avenue and WilberYStreet in the city of South Bend, Indiana, thence running East on the South line of said Elwood,Avenue three hundred forty -two (3421) feet# thence South four - hundred (4001) feet, thence East one hundred eight (1081) feet, thence South twelve hundred thirty - eight and four tenths (1238.4+) feet to the North line of Vassar :venue in the City of South Bend, Indiana thence nest a- long the North line of said Vassar Avenue., four hundred fifty (450+) feet to the North- east corner of said Wilbur Street and said Vassar Avenue, thence North on the East line of said Wilbuxg Street Sixteen hundred and thirty%ine and four tenths (1639.44) feet to the place of'. beginning, containing fif- teen and .ninety -four (15.944) hundredths acres aaore or less, exclusive of streets, commonly known as muessel Grove. Section 3. The proper officers of the City of South Bend be, and the same are, hereby directed to make and effect the purchase of the real estate described in Section 2 hereof at the price of X1600008 in accordance with the terms of an Option to Purchase, a copy of which is attached hereto, and made part of this Ordinance, Section 4. The proper officers of the City of South Bend be, and the same are, hereby authorized to assign the real estate described in Section 2 hereof subsequent to its purchase to the Department of Public Parks of said City for use for park purposes, Section 5." The need of the real estate described in 5eetio.0 2 hereof, and of the appropriation of funds to purchase same is hereby declared to be an emergency. Section 8.
