AN ORDINANCE AUTHORIZING THE SALE OF ALL
OF THE RIGHT, TITLE, AND INTEREST OF THE
CITY OF SOUTH BEND, INDIANA, IN AND TO
ANY BONDS, COUPONS, AND /OR ASSESSMENTS
HERETOFORE ISSUED UNDER IMPROVEMENT RESO-
LUTION NO. 1687, APPROVED JUNE 15, 1926s
COVERING ASSESSMENT ROLL NO. 2003, THE
WASHINGTON AVENUE, FROM JACOB STREET TO
ESTHER STREET, ASPHALT PAVEMENT AND WATER
TAPS.
WHEREAS, the City of South Bend, by virtue of the judgment and
decree of the St. Joseph Superior Court No. 2 in the case of Read et al.,
vs. Becziewicz, et al., being Cause No. 54558, is the owner of certain right,
title, and interest in and to certain improvement bonds and coupons and
assessments in Improvement Roll No. 2003s The Washington Avenue, from Jacob
Street to Esther Street, asphalt pavement and water taps, which said bonds
and coupons were issued and said assessments were levied pursuant to the
provisions of Resolution No. 1687 of the Board of Public Works of the City
of South Bend on the 15th day of June, 1926 and,
WHEREAS, one John Dunnuck has offered to purchase all of the right,
title, and interest of said city in and to said bonds, coupons, and
assessments;
NOW, THEREFORE, BE IT ORDAINED BY the Common Council of the City
of South Bend, Indiana, that the Judge of the Circuit Court of St. Joseph
County is hereby requested to appoint three disinterested freeholders of
this city for the appraisement of the right, title, and interest of the City
in and to the bonds, coupons, and /or assessments of the Improvement Roll No.
2003, issued pursuant to Resolution No. 1687 of the Board of Public Works on
the 15th day of June, 1926, now owned by the City of South Bend, Indiana.
BE IT FURTHER. ORDAINED by the Common Council of the City of
South Bend, Indiana, that the City of South Bend sell, assign, transfer, and
set over by proper instrument of assignment to John Dunnuck all of the
right, title, and interest of said City of South Bend in and to the bonds,
coupons, and /or assessments issued or levied pursuant to the provisions
of Resolution No. 1687 of the Board of Public Works dated June 15a 1926,
and being Improvement Roll No. 2003, the Washington Avenue, Jacob Street to
Esther Street, asphalt pavement and water taps, for not less than
the full appraised value thereof, as reported by the appraisers
appointed by the Judge of this St. Joseph Circuit Court, pursuant hereto;
and the Mayor is hereby ordered, directed, and authorized to execute and
deliver to said John Dunnuck upon the payment of said sum of money a good
and sufficient assignment and bill of sale therefore; and this shall be
a sufficient authority to him in said premises.
