A RESOLUTION OF THE COMMON COUNCIL
FOR THE CITY OF SOUTH BEND, INDIANA
FINDING IT NECESSARY TO LEASE RENTAL PROPERTY
FOR THE SOUTH BEND WATER WORKS
WHEREAS, the City of South Bend, Indiana is the owner of
certain real property and improvements located at 224 North Main
Street and known as the South Bend Water Works Administration
Building, which building houses the administrative offices of the
South Bend Water Works; and
WHEREAS, the Water Works Administration Building is used and
staffed by employees of South Bend Water Works who did not relocate
to the new headquarters, located at 125 West Colfax; and
WHEREAS, said Water Works Administration Building is scheduled
for demolition, and the new Water Works building, located at 125
West Colfax, will not accommodate the employees who will be
displaced by the demolition; and
WHEREAS, the most efficient and cost effective allocation of
resources warrants the relocation of the Water Works
administrative, computer, and billing operations from said Water
Works Administration building to a leased premises, rather than
constructing an addition to the new Water Works headquarters; and
WHEREAS, the owners of the real estate and improvement at 209
North Main Street, South Bend, housing the Main Street Row, are
desirous of leasing such real estate and improvements to the City
for use as the City's Water Works Administrative, computer, and
billing operations; and
WHEREAS, the Director of the South Bend Water Works has
inspected said Main Street Row property and has found it to be
adequately sized, comprising 3,883 square feet and, with
improvements, otherwise suited for use as the City's Water Works
Administrative, Computer, and Billing operations; and
WHEREAS, the Director of the South Bend Water Works has
inspected other facilities for rental; and
WHEREAS, said rental at Main Street Row is for a period of
five (5) years for $213,565.00 for a term of five (5) years, with
a monthly rental of Three Thousand Five Hundred Fifty -Nine and
42/100 Dollars ($3,559.42) with an option to renew for two (2)
additional five (5) year terms. The rental rate for the second
five (5) year term shall be Twelve and 50/100 Dollars ($12.50) per
square foot per year. The rental rate for the third five (5) year
term shall be Thirteen Dollars and 00/100 ($13.00) per square foot
per year; and
WHEREAS, the Director of the South Bend Water Works has
recommended to the Board of Water Works Commissioners of the City
of South Bend that it offer to lease the Main Street Row space for
$213,565.00, subject to compliance with I.C. 36- 1 -10 -1 et seq.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL FOR THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
1. That the Common Council for the City of South Bend,
Indiana, hereby declares it necessary for the protection of the
public health and welfare of the inhabitants of the South Bend
Water Works district and the safeguarding of the property within
the district that the City of South Bend, Indiana, for the use and
benefit of its Water Works, and acting by and through its Board of
Water Works Commissioners lease the following real property,
situated in St. Joseph County:
3,883 Square feet of space at 209 North Main Street,
South Bend, Indiana
2. That the Common Council for the City of South Bend,
Indiana, hereby declares it to be of public utility and benefit to
lease the space in Main Street Row.
3. That the Common Council for the City of South Bend,
Indiana, hereby establishes the maximum proposed lease of the Main
Street Row space to be $213,565.00 for a period of five years.
4. This resolution shall be in full force and effect from
and after its adoption.
