A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY
OF SOUTH BEND, INDIANA, TO BE AN ECONOMIC
REVITALIZATION AREA FOR PURPOSES OF A FIVE (5) YEAR
PERSONAL PROPERTY TAX ABATEMENT FOR
MIDWEST EMBROIDERY, INC.
(DESIGNATING A NEW ADDRESS OF
3431 WILLIAM RICHARDSON DRIVE)
WHEREAS, the Common Council of the City of South Bend, Indiana, adopted a
Declaratory Resolution, No. 2103 -94, designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, the Common Council of the City of South Bend, Indiana, adopted a
Confumatory Resolution, No. 2105 -94, confirming the designation that certain areas within the
City be an Economic Revitalization Area for the purpose of tax abatement consideration; and
WHEREAS, the Petitioner has now installed the equipment at 3431 William Richardson
Drive (as opposed to the original address of 3600 McGill Street); and
WHEREAS, the Common Council of the City of South Bend, Indiana, now wishes to
amend the Declaratory and Confirmatory Resolutions, Nos 2103 -94 and 2105 -94 respectively,
striking the address of 3600 McGill Street, wherever it appears, and replacing it with 3431
William Richardson Drive, and which is more particularly described as follows:
Toll Road Industrial Park, Section 6, Lot 15
and which has Key Number 25- 1013 - 0212.02, to be an Economic Revitalization Area; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met in resolutions 2103 -94 and 2105 -94, and further determines
that the petitioner has met all such qulifications for the new address.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby reconfirms and hereby ratifies its Declaratory and
Confirmatory Resolutions, as amended, designating the area described as 3431 William
Richardson Drive as an Economic Revitalization Area for the purposes of tax abatement. Such
designation is for Personal property tax abatement only and is limited to two (2) calendar years
from the date of adoption of the Declaratory Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is qualified for
and is granted Personal property tax deduction for a period of five (5) years, and further
determines that the petition substantially complies with Chapter 2, Article 6, of the Municipal
Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et sea.
SECTION III. The Council further exercises its authority pursuant to Indiana Code 6-1.1-12.1 -
11.3(c) and waives certain compliance requirements with such waiver taking place after public
hearing. The Council further finds that each of the additional findings required pursuant to
Indiana Code 6 -1.2- 12.1 -4.5 have been met, and that Midwest Embroidery's property located at
3431 William Richardson Drive is declared an Economic Revitalization Area.
SECTION IV. This Resolution shall be in full force and effect from and after its adoption by
the Common Council and approved by the Mayor.
