A RESOLUTION OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND ADOPTING A
WRITTEN FISCAL PLAN AND ESTABLISHING A
POLICY FOR THE PROVISION OF SERVICES TO
AN ANNEXED AREA IN CLAY TOWNSHIP
WHEREAS, there has been submitted to the Common Council of the
City of South Bend, Indiana, an ordinance which proposes the
annexation of the hereinafter described real estate located in Clay
Township, St. Joseph County, Indiana; and
WHEREAS, the territory proposed to be annexed encompasses
approximately 27.1 acres of land, located in Clay Township, north of
State Road No. 23, west of Ironwood Drive, south of Dunn Road (Hepler
Street), east of Willis Avenue; contiguous to the City of South Bend,
twenty -six percent (260) of its aggregate external boundaries
coinciding with the boundaries of the City of South Bend;
approximately ninety -six percent (96 %) subdivided; with a resident
population density in excess of three (3) persons per acre; and
commercially and residentially zoned. The development of the
territory proposed to be annexed will require a basic level of
municipal public services, which services shall include the provision
of water service; and
WHEREAS, the Common Council of the City of South Bend, Indiana
now desires to establish and adopt a fiscal plan and establish a
definite policy showing (1) the cost estimates of services of a
non - capital nature, including street and road maintenance, police and
fire protection and other non - capital services normally provided
within the corporate boundaries, and services of a capital improvement
nature, including street construction, street lighting, water
facilites, sewer facilities, and storm water drainage facilities to be
furnished to the territory to be annexed; (2) the method(s) of
financing those services; (3) the plan for the organization and
extension of those services; (4) that services of a non - capital nature
will be provided to the annexed area within one (1) year after the
effective date of the annexation, and that they will be provided in a
manner equivalent in standard and scope to similar non - capital
services provided to areas within the corporate boundaries of the City
of South Bend, that have characteristic of topography, patterns of
land use, and population density similar to that of the territory to
be annexed; (5) that services of a capital improvement nature will be
provided to the annexed area within three (3) years after the
effective date of the annexation in the same manner as those services
are provided to areas within the corporate boundaries of the City of
South Bend that have characteristics of topography, patterns of land
use and population density similar to that of the territory to be
annexed and in a manner consistent with federal, state and local laws,
procedures, and planning criteria; and (6) the plan for hiring the
employees of other governmental entities whose jobs will be eliminated
by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, the
Board of Public Safety of the City of South Bend, and the Board of
Water Works Commissioners of the City of South Bend have approved a
written fiscal plan and established a policy for the provision of
services to the territory to be annexed, which plan and policy the
Common Council finds appropriate and the adoption of which as the plan
and policy for the City of South Bend the Common Council finds to be
in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. That it is in the best interest of the City of South
Bend and of the area proposed to be annexed that the real property
located in Clay Township, St. Joseph County, Indiana, described at
Exhibit "A," attached hereto and made a part hereof,
be annexed to the City of South Bend.
Section II. That it shall be and hereby is now declared and
established that it is the policy of the City of South Bend to furnish
to said territory services of a non - capital nature, such as street and
road maintenance, police and fire protection, within one (1) year of
the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other
areas of the City which have characteristics of typography, patterns
of land utilization and population density similar to said territory;
and to furnish to said territory services of a capital improvement
nature, such as street construction, street lighting, water
facilities, sewer facilities, and storm water facilities, within three
(3) years of the effective date of the annexation, in the same manner
as those services are provided to areas within the corporate
boundaries of the City of South Bend that have characteristics of
topography, patterns of land use and population density similar to
that of the territory to be annexed and in a manner consistent with
federal, state and local laws, procedures, and planning criteria.
Section III. That the Common Coucil for the City of South Bend
shall and does hereby now establish and adopt the fiscal plan
described in Exhibit "B ", attached hereto and made a part hereof, for
the furnishing of said services to the territory to be annexed.

SECTION I. INTRODUCTION
This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation
of property in Clay Township, St. Joseph County (hereinafter, "Annexation Area "), and was
developed through the cooperative efforts of the Are Plan Commission of St. Joseph County and
the following City Departments:

Department of Code Enforcement
Department of Community and Economic Development
Department of Administration and Finance
SECTION II. GENERAL DATA
A. Location
The Annexation Area is generally located north of State Road #23; West of Ironwood Drive;
South of Dunn Road (Hepler Street); and East of Willis Avenue. An Annexation Map (Map 1)
can be found in the back of this Fiscal Plan.
B. Legal Description
The Annexation Area is part of the East '' /z of the Southeast 1/4 of Section 31, Township 38 North,
Range 3 East, Clay Township, St. Joseph County, Indiana. A complete legal description (Table I)
for the Annexation Area can be found in the back of this Fiscal Plan.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City of South Bend limits.
Twenty -Six percent (26 %) of the aggregate external boundaries of the Annexation Area are
contiguous with the boundaries of the City:

D. Size and Topography
The Annexation Area is approximately 28.6 acres in area. The topography is relatively flat, with a
gentle sloping towards the southwest.
E. Buildings and Land Use
• 0 single - family residences
• 1 apartment complex (Campus View)
• 7 free standing business /commercial structures (Dairy Queen, Pizza Hut, Kentucky Fried
Chicken, NBD Bank, Burger King, Coldwell Banker, St. Joseph Medical Supply)
• 1 shopping center (Martins Supermarket, Osco Drug Store, and additional store fronts)
F. Zoning and Subdivisions
The area is currently zoned 'B" Business, "C" Commercial and "R -2" Residential in
unincorporated St. Joseph County. Upon annexation, the Area Plan Commission will propose a
zoning plan for the Annexation Area. The South Bend Common Council will have final approval
following established procedures for the zoning of property.
The area is approximately 96% subdivided, consisting of the following recorded subdivisions:

G. Population and Density
The Annexation Area is part of Census Track 113.01, Blocks 516 and 517:

The adjusted figures represent the seven (7) single - family units within Census Block 517 which
are not a part of the Annexation Area. The adjusted population figure is an estimate.
The estimated population of the Annexation Area is therefore 265 people.
The estimated density of the Annexation area is therefore 10 persons per acre.
H. Tax Rate
The tax rates used are those of 1995 payable in 1996.
The Township Rate will decrease with the deletion of the Fire Fighting and the Cumulative Fire
Fund assessments.
The tax rate for the Annexation Area will increase by the addition of the City and Town Rate, the
Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be $6.5829 per $100.00 of assessed valuation. Table 2,
located in the back of this Fiscal Plan, shows representative tax rate information as published by
the St. Joseph County Auditor.
I. Assessments

J. Councilmanic District
The Annexation Area will be in City Councilmanic District 4.

K. Comparable Area
The area located north of State Road 23, South of Vaness Street, North of Edison Road and East
of Ivy Road, is comparable to the Annexation Area in terms of its topography, patterns of land
use, and population density. This comparable area, within Census Tract 113.01, Blocks 518 and
519A, is zoned and used for residential, business, and commercial purposes, as is the Annexation
Area.

The City will provide services to the Annexation Area in a manner equivalent in standard and
scope to those provided within the comparable area.
L. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Existing Sanitary Sewer Location
Hepler Street 8 -inch gravity from the second lot east of Willis to George Street; 4-
inch forced main from George Street to Ironwood.
Ironwood Drive 12 -inch gravity main.
State Road 23 10 -inch gravity main that terminates approximately 240' south of the
intersection of Vaness Street.
Sewage from all developed property within the annexation area, with the exception of the Access
Home Medical Supply building at 18191 State Road #23, is discharged into the sewage works of
the City of South Bend. The provision of sewer service to the St. Joseph Medical Supplysite will
require extending the sewer line located in State Road #23 approximately 240 feet, installing a

sewage lift station in the vicinity of the intersection of Vaness Street and State Road 23, and
extending a sewer line from the lift station to the St. Joseph Medical Supply site.
The cost to the City of installing the lift station and the sewer line extension is approximately
$200,000. The extended sewer line and lift station will be operational not latter than three (3)
years from the effective date of the annexation
No other costs are anticipated in connection with the provision of sewer service to the Annexation
Area.

State Road 23
8 -inch from Vaness to entrance of Ironwood Plaza North.
All development, with the exception of the St. Joseph Medical Supply building at 18191 State
Road #23, is receiving municipal water service. Municipal water service is available to the St.
Joseph Medical Supply building, and may be utilized at any time upon the request of the property
owner, following the standard procedures of the Board of Public Works.
No additional costs are anticipated in connection with the provision of water service to the
Annexation Area.
General
The wastewater treatment and collection systems can provide service to the proposed area without
any additional expenditures by the City, other than what was noted above. Water mains are
adequate and available to the Annexation Area. All properties have access to the water lines
without any further capital expenditures.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C.
8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility.
The City can and will provide appropriate solid waste collection services, if applicable, to the
Annexation Area immediately upon annexation.

B. Police Protection
The Annexation Area is contiguous to Beat 11 and will be added immediately upon annexation to
that patrol Beat. Routine patrol, law enforcement, traffic enforcement and emergency responses
will be provided. The development of other tracts in the area has already increased the demands
on the Police Department for traffic control and crime preventive patrols.
C. Fire Protection
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. The Annexation Area is located approximately 2 miles from Station #3 located at
1805 E. Mckinley, and Engine #9 located approximately 3 miles away at 2520 Mishawaka
Avenue. The Department will respond to calls from the Annexation Area immediately upon
annexation.
Fire officials note that response times will be comparable to other areas of the City, and that no
additional equipment will need to be purchased or personnel hired to service the Annexation Area.
D. Code Enforcement
The Department of Code Enforcement can provide services to the Annexation Area without any
additional expenses over the present budget.
E. Administrative Services
The incorporation of the Annexation Area will not effect the provision to the Annexation Area of
other services currently provided on a county-wide basis. The St. Joseph County Health
Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph
County/South Bend Building Department will continue to provide the same type and level of
services to the Annexation Area.

SECTION IV. FISCAL IMPACT
The cost of providing city services to the Annexation Area can be absorbed by Department
budgets. The cost to install a lift station and extend sewer lines in the vicinity of Vaness Street
and State Road# 23, as described in Section III, will be paid for out of sewer revenue sources
available for capital expenditures.
Summary Table - Fiscal Impact
All figures are estimates. Final cost of capital expenditures will not be determined until bids are
publicly solicited and contracts awarded. Property Tax is based on 1994 payable 1995 City/Town
Rate, minus State tax Credit. Property tax is based on 1995 payable 1996 estimated tax receipts if
the Annexation Area was already in the City. Tax rates are subject to change every year.
