RESOLUTION OF THE SOUTH BEND COMMON COUNCIL
DETERMINING, AFTER INVESTIGATION, THAT THE LEASE OF
OFFICE SPACE FOR THE OFFICES OF THE CITY OF SOUTH BEND
DEPARTMENT OF ECONOMIC DEVELOPMENT, DIVISION OF PLANNING
IS NECESSARY
WHEREAS, the Board of Public Works of the City of South Bend,
Indiana ( "Board "), on October 28, 1996, received a Petition signed by
fifty (50) owners of real property of the City of South Bend,
requesting that the Board provide office space for the offices of the
City of South Bend, Department of Economic Development, Division of
Planning, by entering into a Lease Agreement with the 1st Source Bank
of South Bend, Indiana, for approximately 2498 square feet within the
building known as the First Bank Building, 205 West Jefferson
Boulevard, South Bend, Indiana, for a term of one (1) year, with an
annual rental of Twenty -seven Thousand Four Hundred Seventy -eight
Dollars ($27,478.00) with an option to renew for two (2) additional
one -year (1) periods years at this same rental; and
WHEREAS, the Board also received, on October 28, 1996, a
certificate of the St. Joseph County Auditor certifying that the
verifier of the Petition and the signatories of the petition are
taxpayers of property located within the corporate limits of the City
of South Bend; and
WHEREAS, pursuant to IC 36- 1 -10 -7 (2) requires, prior to the Board
of Public Works entering into such a lease agreement, that the Common
Council, after investigation, determine that the same is needed.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND COMMON COUNCIL,
AS FOLLOWS:
1. That the Common Council has conducted a public hearing on this
resolution, and has heard persons desiring to speak in favor and
opposed to the adoption of this resolution.
2. That the Common Council finds that the City of South Bend does
not have adequate space available in the County -City Building located
at 227 West Jefferson Boulevard, South Bend, Indiana, to house the
staff and operations of the Department of Economic Development,
Division of Planning ( "Department ").
3. That the most efficient and cost effective allocation of
resources warrants the continued lease of office space outside the
County -City Building.
4. That approximately 2498 square feet of office space is
available within the building known as the First Bank Building, 205
West Jefferson Boulevard, South Bend, Indiana, and is proposed to be
leased to the City of South Bend for the use of the Department.
5. That on October 28, 1996, a petition signed by fifty (50)
taxpayers of the City of South Bend, Indiana, was filed with the Board
of Public Works of the City of South Bend, Indiana requesting that it
provide office space for the offices of the City of South Bend,
Department of Economic Development, Division of Planning, by entering
into a lease agreement with the 1st Source Bank of South Bend,
Indiana, for approximately 2498 square feet within the building known
as the First Bank Building, 205 West Jefferson Boulevard, South Bend,
Indiana, for an annual rental of Twenty -seven Thousand Four Hundred
Seventy -eight Dollars ($27,458.00).
6. That on October 28, 1996, the Board of Public Works received a
certificate signed by the St. Joseph County Auditor, certifying that
the verifier and the signatories of the petition are taxpayers of
property located within the corporate limits of the City of South
Bend.
7. That on October 28, 1996, a proposed Lease Agreement was filed
with the Board of Public Works.
8. That having heard all speakers at the presentation and hearing
on this resolution on the 28th day of October, 1996, and having taken
into consideration facts adduced at this hearing and in documents and
presentations, as well as all personal investigations, discussions and
consideration by individual Council members, the South Bend Common
Council hereby finds, pursuant to I.C. 36- 1 -10 -7 (2), that the
provision of office space for the offices of the City of South Bend,
Department of Economic Development, Division of Planning by lease, as
petitioned by the fifty (50) taxpayers of the City of South Bend, as
certified by the St. Joseph County Auditor, is needed.
9. This resolution shall be in full force and effect from and
after its adoption by the Common Council and approval by the Mayor.
