Presented by me to the Mayor of the City of South Bend, May 28, 97 19 City Clerk Approved and signed by me May 30 19_ 97 Mayor RESOLUTION NO. c /66 -�7 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA IN CENTRE AND PENN TOWNSHIPS (EMRO /NDCU ANNEXATION) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an ordinance which proposed the annexation of the real estate described hereinafter as Exhibit "A," located in Centre and Penn Townships, St. Joseph County, Indiana; and WHEREAS, the territory proposed to be annexed encompasses approximately 9.5 acres of land, used primarily for commercial and office purposes located at the northwest and southeast corners of Ironwood and Ireland Roads, fifty -one percent (51%) of its aggregate external boundaries coinciding with the boundaries of the City of South Bend; approximately seventy -two percent (72%) subdivided. Sewer and municipal water service is available to the Annexation Area but development of the territory proposed to be annexed will require additional street lighting and additional police protection, street and road maintenance; WHEREAS, the Common Council of the City of South Bend, Indiana now desires to establish and adopt a fiscal plan and establish a definite policy showing (1) the cost estimates of services of a non - capital nature, including street and road maintenance, police and fire protection and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street, construction, street lighting, water facilities, sewer facilities, and storm water drainage facilities to be furnished to the territory to be annexed; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner equivalent in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, that have characteristic of topography, patterns of land use, and population density similar to that of the territory to be annexed; (5) that services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend that have characteristics of topography, patterns of land use and population density similar to that of the territory to be annexed and in a manner consistent with federal, state and local laws, procedures, and planning criteria; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; WHEREAS, the Board of Public Works of the City of South Bend, the Board of Public Safety of the City of South Bend, and the Board of Water Works Commissioners of the City of South Bend, have approved a written fiscal plan and established a policy for the provision of services to the territory to be annexed, which plan and policy the Common Council finds appropriate and the adoption of which as the plan and policy for the City of South Bend the Common Council finds to be in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. That it is in the best interest of the City of South Bend and of the area proposed to be annexed that the real property located in Centre and Penn Townships, St. Joseph County, Indiana, described at Exhibit "A" attached hereto and made a part hereof, be annexed to the City of South Bend. Section II. That it shall be and hereby is now declared and established that it is the policy of the City of South Bend to furnish to said territory services of a non - capital nature, such as street and road maintenance, police and fire protection, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City which have characteristics of topography, patterns of land utilization and population density similar to said territory; and to furnish to said territory services of a capital improvement nature, such as street construction, street lighting, water facilities, sewer facilities, and storm water facilities, within three (3) years of the effective date of the annexation, in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend that have characteristics of topography, patterns of land use and population density similar to that of the territory to be annexed and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. That the Common Council for the City of South Bend shall and does hereby now establish and adopt the fiscal plan described in Exhibit "B ", attached hereto and made a part hereof, for the furnishing of sale services to the territory to be annexed. INTRODUCTION This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in Centre and PennTownships, St. Joseph County (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission of St. Joseph County and the following City Departments: Department of Law Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located at the northwest and southeast corners of Ironwood and Ireland Roads. An Annexation Map (Map 1) can be found in the back of this Fiscal Plan. B. Legal Description A Parcel of Land Located in the E. 1/2 of the NE 1/4 of Section 30 T. 37 N., R. 3 E., Centre Township, St. Joseph County, Indiana; and in the W. 1/2 of the SW 1/4 of Section 29 T.37 N., R. 3 E., Penn Township, St. Joseph County, Indiana. A legal description (Table I) for the Annexation Area can be found in the back of this Fiscal Plan. C. Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City of South Bend limits. Approximately fifty one percent (51 %) of the aggregate external boundaries of the Annexation Area are contiguous to the boundaries of the City: Contiguous Non - Contiguous Total 2,290.42 feet 2,213.88 feet 4,504.03 feet 50.8% 49.2% 100% EMRO / NDCUAnnexation Area - Fiscal Plan D. Size and Topography The Annexation Area is approximately 9.5 acres in area. The topography is relatively flat, with a gentle sloping downward towards the north. E. Buildings and Land Use 0 single - family residences 4 free standing business /commercial structures (Notre Dame Federal Credit Union, Hickey Associates, Speedway gas station, Ironwood Dental Associates). F. Zoning and Subdivisions The area is currently zoned "O/B" Office /Business, "C" Commercial and "O" Office in unincorporated St. Joseph County. Upon annexation, the Area Plan Commission will propose a zoning plan for the Annexation Area. The South Bend Common Council will have final approval following established procedures for the zoning of property. The adjusted population figure is based on field observation. The estimated population of the Annexation Area is therefore 0 people. The estimated density of the Annexation area is therefore 0 persons per acre. EMRO I NDCUAnnezation Area -Fiscal Plan H. Tax Rate The tax rates used are those of 1996 payable in 1997. Centre Township - The Township Rate will decrease with the deletion of the Fire Fighting Fund, the Fire Debt Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $6.5486 per $100.00 of assessed valuation. Table 2, located in the back of this Fiscal Plan, shows representative tax rate information as published by the St. Joseph County Auditor. Penn Township - The Township Rate will decrease with the deletion of the Fire Fighting Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $6.7477 per $100.00 of assessed valuation. Table 2.1, located in the back of this Fiscal Plan, shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments Net Assessment, 1996 payable 1997, from the St. Joseph County Auditor tax records: Net Assessment: $251,030.00 I Councilmanic District The Annexation Area will be in City Councilmanic District 5. EMRO I NDCU Annexation Area -Fiscal Plan K. Comparable Area The area located due west of the Annexation Area, between Ironwood Road and Sampson Street (extended) on either side of Ireland Road, is comparable to the Annexation Area in terms of its topography, patterns of land use, and population density. This comparable area is zoned and used for office, business, and commercial purposes, as is the Annexation Area. Annexation Area Topography: Flat to moderately sloping Land Use: Commercial & Office Zoning: "O /B "Office /Business "O" Office "C" Commercial Density: @ 0 persons /acre Comparable Area Flat to moderately sloping Commercial & Office "O" Office "C" Commercial @ 0 persons /acre The City will provide services to the Annexation Area in a manner equivalent in standard and scope to those provided within the comparable area. L. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. There has been no response from Centre and Penn Townships that Township employees will be eliminated as a direct result of the Annexation. SECTION III. MUNICIPAL SERVICES A. Public Works Existing Sanitary Sewer Location E. Ireland Road 8 -inch abuting the properties proposed to be annexed. Ironwood Drive 24 -inch in the east right -of -way, approximately 300 feet south from Ireland, thence south to Jackson Road in the west right -of -way. The capacity of all sewers in the Annexation Area are capable of handling future tap -ins of sanitary and storm sewers. Sanitary sewer service is available to the Annexation Area and may be utilized at any time upon the request of the property owner, following the standard procedures of the Board of Public Works. EMRO / NDCUAnnexation Area -Fiscal Plan Existing Water Mains Ironwood Rd 12 -inch and 8 -inch. Ireland Rd 12 -inch Municipal water service is available to the Annexation Area and may be utilized at any time upon the request of the property owner, following the standard procedures of the Board of Public Works. No additional costs are anticipated in connection with the provision of water service to the Annexation Area. General The City proposes to install additional street lighting at an estimated cost of $5,000.00. The cost of installation will be provided by the Board of Public Works. The wastewater treatment and collection systems can provide service to the proposed area without any additional expenditures by the City, other than what was noted above. Water mains are adequate and available to the Annexation Area. All properties have access to the water lines without any further capital expenditures. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. The City can and will provide appropriate solid waste collection services, if applicable, to the Annexation Area immediately upon annexation. B. Police Protection The Annexation Area is contiguous to Beat 15 and will be added immediately upon annexation to that patrol Beat. Routine patrol, law enforcement, traffic enforcement and emergency responses will be provided. Calls to the Annexation Area will increase slightly as this is a heavily travelled area. It is not anticipated though that it will be necessary to increase police patrols beyond the already existing patrol beat. EMRO / NDCUAnnexation Area -Fiscal Plan C. Fire Protection The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. The Annexation Area is located approximately 2 miles from Station #10 located at 308 West Ireland. Additional Units would respond including Station 8 located 2 miles away at 2402 Twyckenham Drive. Fire officials note that response times will be comparable to other areas of the City, and that no additional equipment will need to be purchased or personnel hired to service the Annexation Area. D. Code Enforcement The Department of Code Enforcement can provide the full range of services to the Annexation Area without any additional expenses over the present budget, and with a comparable response time to the rest of the City. E. Administrative Services The incorporation of the Annexation Area will not effect the provision to the Annexation Area of other services currently provided on a county -wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South Bend Building Department will continue to provide the same type and level of services to the Annexation Area. EMRO I NDCUAnnexation Area -Fiscal Plan SECTION IV. FISCAL IMPACT The cost of providing city services to the Annexation Area can be absorbed by Department budgets. The cost to install street lighting will be paid for out of sources available for capital expenditures. Summary Table - Fiscal Impact All figures are estimates. Final cost of capital expenditures will not be determined until bids are publicly solicited and contracts awarded. Property tax is based on 1995 payable 1996 estimated tax receipts if the Annexation Area was already in the City. Tax rates are subject to change every year. SECTION V. The resolution indicates the approval and adoption by the Common Council of the writen plan and policy attached thereto concerning the provision of services, both capital and non - capital in nature, to the territory to be annexed. I would ask that the attached resolution be considered under the Special Business agenda item of the agenda of the Common Council meeting at which the companion ordinance is given public hearing, final reading and vote.
