AN ORDINANCE AMENDING ORDINANCE NO. 3571 ENTITLED
AN ORDINANCE REGULATING METHODS OF DESIGN AND
INSTALLATION OF WARM AIR, WINTER AIR CONDITIONING
SYSTEMS AND OF GRAVITY WARM AIR HEATING SYSTEMS
AND REGULATING THE ALTERATION, REPAIR, REMODELING
AND REPLACEMENT OF SUCH SYSTEMS OR PARTS OF
SYSTEMS IN BUILDINGS OF THE CITY OF SOUTH BEND,
INDIANA: PROVIDING PENALTIES FOR THE VIOLATION HERE-
OF; REPEALING ANY AND ALL ORDINANCES IN CONFLICT
THEREWITH.
Be it ordained by the Common Council of the City of South Bend,
That Sub - section (f) of Article VII of Ordinance No. 3571 adopted by
the Common Council of the City of South Bend, Indiana, on the 14th day of
September, 1945, be and the same is hereby amended by adding thereto the
following provision:
Pre -cast prefabricated chimneys made of materials other than those
specified in this section may be installed in one and /or two story structures
provided such chimneys have an inner liner of fire clay tile at least Seven
(7 ") inches in diameter and the walls of which are at least Five- eighth
(5/8 ") inch thick surrounded by a Thaee— eighth (3/8 ") inch thick wall of
masonry type proprietary insulation reinforced by an expanded metal external
binder. When used as a flue for any heating unit installed in the basement or
on the first floor of a structure without basement, chimney shall extend to floor
and be placed upon a non combustible base of suif bent area to support the
weight of the flue, or flue may extend to joists immediately above unit if
supported by hanger designed for this purpose.
If flue is used in connection with gas fired heating unit, a drain
must be placed at bottom of hanger or bottom of flue if same extends to

If flue is used in connection with heating unit using fuel other than
gas, a clean -out door must be provided at base of flue placed in such position
so as to be easily accessible. When installed through living space the flue
must be enclosed with Three - eighth (3%8 ") inch thick plaster board or
equivalent material and with a minimum clearance from combustibles of not
less than Two (2) inches.
All sections of the flue must be sealed with high temperature
chimney cement.
This Ordinance shall be in full force; and effect from and after its
passage and legal publication.

Gentlemen.
Subject: VAN PACKER CHINIDih'Y.
The above captioned subject referred to the City Plan
Commission for consideration was discussed with the joint code com-
mittee and we wish to report as follows:
The sponsors of the Van Packer Chimney have submitted
evidence that their product has been approved by the State Adminis-
trative Building Council. It is our feeling that the approval has
been as a material only, and it will still be subject to the same
installation procedure of any recognized material used for chimney
flues. Further, the joint code committee is now working on a -new
city-building ordinance in which the State Administrative Building
Code will be adopted in full. With this intention the City Plan
Commission proposes to offer for your consideration at an early date
an ordinance adopting all of the measures in the State Administrative
Building Code and voiding all of the subjects in the city code in con-
flirt with said state code. This will be an interim measure until
the final city code is ready for presentation for your action.
Therefore, it is recommended that the Council refuse to e-
nact the ordinance proposed by the manufacturer of the Van Packer
Chimney as it will automatically be covered when the interim ordinance
is written.
