A RESOLUTION RECONFIRMING THE ADOPTION OF A
DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND, INDIANA,
COMMONLY KNOWN AS
2422 VIRIDIAN DRIVE
TO BE AN ECONOMIC REVITALIZATION
AREA FOR PURPOSES OF A THREE (3) YEAR REAL
PROPERTY TAX ABATEMENT FOR
JOHN R. AND LAI -LO GOULD
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Economic Revitalization
Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as 2422
Viridian Drive and which is more particularly described as follows:
That part of the Southeast quarter of Section 28, T. 38 N., R. 2 E., City of
South Bend, St. Joseph County, Indiana which is described as: Beginning at a
Point which is the intersection of the West Right of Way line of Bendix Drive
and the North line of Viridian Drive which is N. 00 °- 02' -06" W., 771.89 ft.
from a Point on the South line of said Section which is N. 90 °- 00' -00" W.
(assumed bearing), 40.00 ft. from an Iron in a Monument Box marking the
Southeast Corner of said Section; thence around a 40.00 ft. Radius curve to
the Right an Arc distance of 72.33 ft. to the end of a chord which bears S.
51 °- 46' -11" W. and having a distance of 62.87 ft.; thence around a 210.00 ft.
Radius curve to the Right an Arc distance of 77.97 ft. to the end of a chord
which bears N. 65 °- 47' -20" W. and having a distance of 77.52 ft.; thence
around a 586.97 ft. Radius curve to the Left an Arc distance of 357.00 ft. to
the end of a chord which bears N. 720- 34' -35" W. and having a distance of
351.52 ft.; thence S. 900- 00' -00" W., 268.26 ft.; thence N. 00 °- 22' -17" E.,
169.87 ft.; thence N. 69 °- 21' -01" E., 771.91 ft. (771.89 ft., Record); thence
S. 000- 02' -06" E., 152.84 ft.; thence S. 900- 00' -00" W., 125.00 ft.; thence S.
00 °- 02' -06" E., 264.00 ft.; thence N. 90 °- 00' -00" E., 125.00 ft.; thence S.
00 °- 02' -06" E., 123.38 ft. To the Point of Beginning. Containing 4.92
Acres.
with said real estate having the following Key No.: 25- 1010 - 040804, as an Economic
Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public
hearing before the Council has been published pursuant to Indiana Code 6- 1.1 -12.1-
2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an
economic revitalization area have been met; and
WHEREAS, the Council issued a Confirmatory Resolution confirming the
adoption of the Declaratory Resolution as Resolution No. 2215 -95 on January 23,
1995; and
WHEREAS, the Council issued a second Confirmatory Resolution
reconfirming the adoption of the Declaratory Resolution as Resolution No. 2423 -96
on November 25, 1996, which among other things, extended the economic
revitalization designation from two years to three years; and
WHEREAS, the Petitioner has requested an additional period of time to
complete construction of the planned project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. The Common Council hereby reconfirms its Declaratory
Resolution and its Confirmatory Resolution's designating the area described herein as
an Economic Revitalization Area for the purposes of property tax abatement. Such
designation is for Real property tax abatement only and is limited to four (4) calendar
years from the date of adoption of the Declaratory Resolution by the Common
Council.
SECTION II. The Common Council hereby determines that the property
owner is qualified for and is granted Real property tax deduction for a period of three
(3) years, and further determines that the petition complies with Chapter 2, Article 6,
of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et sea.
SECTION III. This Resolution shall be in full force and effect from and after
its adoption by the Common Council and approved by the Mayor.
