ALT ORDINANCE AUTHORIZING T: SALE OF A TRACT OF LAND 90KED BY THE MUNICIPAL CITY OF SOUTH BEND LOCATED IN THE CITY OF SOUTH BEND, ST. JOSEPH COU31=, INDIANA, DESCRIBED AS FOLL0193: Beginning on the north line of Pokagon Street at the west line of the alley west of Michigan Street said point being twenty and four tenths feet (20.41) west of the southwest corner of Lot No. 26 of Leeper's Revised 2nd Addition to the City of South Bend, Indiana, thence Northwesterly along a line a distance of fifty -one and three tenths feet (51.31) to a point, said point being three and twenty -five hundredths feet (3.251) north of the north line of Pokagon Street projected west and on the east line of the Ifilichigan Central Rail- road right of way line, thence Northwesterly on a one degree twenty -four minute (10241) curve to the right along said right of way line to the south line of Angela Blvd., thence East on the south line of said Angela Blvd. fifty -one and one tenth feet (51.1') to the west line of the alley west of Michigan Street, thence Southeasterly on a one degree twenty -four minute (1024') curve to the left along the said west line of the alley west of Michigan Street to the place of beginning. WHEREAS, the City of South Bend is the owner of a certain tract of land located in the City of South Bend, St. Joseph. County, Indiana, described in Quit Claim Deed of Conveyance recorded in the Office of the Recorder of St. Joseph County, Indiana, November 5, 1935 in Deed Record Book 278, page 157 in which Raymond R. Smith, Receiver of the Northern Indiana Railway, Inc, and Northern Indiana Railway, Inc., are the grantors and, li'MEREAS, the said real estate hereinafter described is conducive to no public use by the municipal City of South Bend, Indiana, and in the best interest of said City should be sold; NOW, THEREFORE, BE IT ORDAINED By the Common Council of the City of South Bend, Indiana: Sectionl. That the Judge of the Circuit Court of St. Joseph County, Indiana be requested to appoint three disinterested freeholders of the City of South Bend, Indiana to appraise a tract of land now owned by the municipal City of South Bend, located in the City of South Bend, St. Joseph County, Indiana, described as follows: - 2 - Beginning on the north line of Pokagon Street at the west line of the alley west of Michigan Street said point being twenty and four tenths feet (20.41) west of the southwest corner of Lot No. 26 of Leeper's Revised 2nd Addition to the City of South Bend, Indiana, thence Northwesterly along a line a distance of fifty -one and three tenths feet (51.31) to a point, said point being three and twenty -five hundredths feet (3.251) north of the north line of Pokagon Street projected west and on the east line of the Michigan Central Railroad right of way line, thence Northwesterly on a one degree twenty -four minute (10241) curve to the right along said right of way line to the south line of Angela Blvd., thence Bast on the South line of said Angela Blvd., fifty - one and one tenth feet (51.1') to the west line of the alley west of Michigan Street, thence Southeasterly on a one degree twenty -four minute (1024') curve to the left along the said west line of the alley west of Michigan Street to the place of beginning. Section 2. That the City of South Bend sell, assign, transfer, convey, and set over by proper instrument, in writing, to any pur- chaser thereof the teal estate hereinabove described for not less than the full appraised value thereof as reported by the appraisers appointed by the Judge of the Circuit Court of the St. Joseph County, Indiana; and the iviayor is hereby ordered, directed and authorized to execute and deliver to such purchaser or purchasers thereof, upon the payment of the appraised value thereof, a good and sufficient deed, and this shall be sufficient authority to him in said premises. .Section 3. (a) That there shall be reserved in said instrument of conveyance a public utilities eas"'ent a distance of ten feet (10') in width extending Northwesterly and Southeasterly from the south line of Angela Blvd. to the north line of Pokagon Street adjoining and parallel to the east line of the Michigan Central Railroad right of way line. (b) That the real estate herein authorized to be sold and trans- (erred shall be used exclusively for the purpose of parking and /or housing of automobiles, save and except a triangular piece of land taken out of the above described premises to accommodate a portion or corner of an apartment building proposed to be constructed on - 3 - and /or adjacent thereto, which triangular piece of land is described as follows: Commencing at a point located on the west side of an alley a. distance of thirty feet (301) Southeasterly from a point on the south line of West Angela Blvd., this point being twenty and four tenths feet (20.41) west of the northwest corner of Lot No. 27 of Leeper's Revised 2nd Addition in the City of South Bend; thence due south sixty feet (601); thence due east twelve feet six inches (1216 ") to the west line of said alley; thence Northwesterly along the west line of said alley to the place of beginning. (c) That the triangular tract of land described in sub- section (b) above is hereby zoned and /or classified for use and occupancy purposes the same classification and /or zoning as the lots and alley adjoining are now classified. That this ordinance shall be in full force and effect from and after its passage by the Common Council and its approval by the Mayor.
