HomeMy WebLinkAboutAppropriating $500,000.00 be Applied on the Cost of Construction & Improvement of StreetsORDINANCE No. 3616 Passed by the Common Council of the City of South Bend, MAY Presented by me to the Mayor of the City of South Bend, Approved and signed by MAY Clerk of Common Council 7 a, Clerk ORDINANCE NO. 3816 An Ordinance of the City of South Bend, Indiana, appropriating the sum of Five Hundred Thousand Dollars ($5002000.00) to be applied on the cost of construction and improvement of streets, and expenses incurred in connection therewith WHEREAS, the Board of Public V +orks and Safety of the City of South Bend, Indiana, has found that it would be for the best interests of said City and its citizens to provide for the construction and improvement of streets in said City, thereby relieving and improving the existing street system, and has determined that the estimated cost of said project, and the incidental expenses necessary to be incurred on account of said project and in connection with the issuance of bonds on account thereof, will be in the approximate amount of Five Hundred Thousand Dollars ($500,000.00); and WHEREAS, the Board of Public Works and Safety has filed a request for an appropriation in the amount of Five Hundred Thousand Dollars ($500,000.00) for said purpose, which request has been approved by the City Controller of said City, with the recommendation that the funds necessary to cover such appropriation be obtained by the issuance and sale of general obligation bonds of the City; and WHEREAS, a petition has been filed under the provisions of Chapter 119 of the Acts of 1937 by more than fifty (50) owners of taxable real estate in the City of South Bend, Indiana, requesting the Common Council to issue bonds in an amount not exceeding the sum of Five Hundred Thousand Dollars ($500,000.00) for the purpose of procuring funds to be applied on the cost of construction and im- provement of streets in said City, which petition the Council has found to be sufficient under the provisions of said act; and WHEMUS, the Council now finds that the construction of said street project will improve and relieve the existing street system and will be of general benefit to the City and its citizens; and WHEREAS, the Council now finds that the City has no funds available or provided for in the existing budget and tax levy which may be applied on said project, making it necessary to authorize the issuance of bonds of the City in order to procure such funds, and that an extraordinary emergency exists for - 2 - for the making of the additional appropriation hereinafter set out; now there- for, BE IT ORDAINED BY THE COALFION COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1. That the sum of Five Hundred Thousand Dollars ($500,000.00) be appropriated out of the proceeds of the bonds heretofore authorized to be issued by the Common Council, designated as "City of South Bend Municipal Bonds .<,_ . of 1951 ", for the use of the Board of Public Works and Safety in paying the cost of construction and improvement of streets, and the incidental expenses necessary to be incurred in connection with said project, including the issuance of bonds on account thereof. Section 2. This ordinance shall be in full force and effect from and after its passage and signing by the Mayor. The Common Council of the City of South Bend, Indiana, met in the Council Chambers on the lLith day of 14ay, 1951, at the hour of 8 o'clock P. in regular session in accordance with the rules of the Council The meeting was called to order by the President Clem Niezgodski, who presided. On call of the roll, the members of the Council were shown to be present or absent as follows: Present: Councilmen Clem Niezgodski, Stanley Korpal, Albert Tellson, Cloyd Beetle, Walter Glass, Alvin Kemper and Walter Erler• Absent: Councilman Chester Muszynski (Among other proceedings had and actions taken were the following:) The City Clerk presented to the Council proofs of publication and Posting of the notice of the public hearing on the appropriation proposed to be made for the purpose of paying the cost of construction and improvement of streets in the City of South Bend, referred to in Ordinance No. 3816 rhich the Council did consider on first and second readings on the 23rd day of April, 1951, showing that said notice had been published and posted at least ten days Nrior to this date. On motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved. The Comrattee of the Vlhole reported on Ordinance No. 3816 entitled "an Ordinance of the City of South Bend, Indiana, appropriating the sum of Five Hundred Thousand Dollars ((5001000.00) to be applied on the cost of construction and im- provement of streets and expenses incurred in connection therewith", and recommended that said ordinance be passed as introduced. The presiding officer then announced that the Council was ready to hear all taxpayers interested on the Question of the necessity for the appropriation provided for in said ordinance. - z - After hearing all taxpayers desiring to be heard on said ordinance Councilman Alvin Kemper moved that Ordinance No. 3816 be read a third time in full and placed upon its final passage. This motion was seconded by Councilman Cloyd Bestle and unanimously carried. The Clerk then read Ordinance No. 3516 in full and Councilman Alvin Kemper moved that the ordinance be adopted as read. This motion was seconded by Councilman Cloyd Bestle and on ca-11 of the roll was passed on the following votes: Ayes: Councilmen Clem Niezgodski, Stanley Korpala Albert Tellson' Cloyd Bestle, Walter Glass,, Alvin Kemper and Walter Erler• Nays: None The presiding officer declared said ordinance to have been duly passed and adopted. . . . . . . . . . . . . (other business) . . . . . . . . . . There being no further business presented, on motion duly made' seconded and unanimously carried, the meeting thereupon adjourned.
