ORDINANCE NO. 3
AN ORDINANCE AMENDING ZONING ORD -
NANCE N0.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA:
Section 1•
That Zoning Ordinance No. 3702 be, and the same is
hereby, amended by changing the zoning classification of the follov
ing described property in the City of South Bend, St.Joseph County;
State of Indiana from "El' Height and Area District to "F11 Height
and Area District:
Beginning at a point on the West line of South
Franklin Street, 502 feet South of the intersection
of the South line of DuBail Avenue,formerly Blanche
Street, with the west line of South Franklin Street,
thence West 153 feet to the East line of a 14 foot
alley; thence North on the East line of said 14 foot
alley 200 feet; thence East 153 feet to the West line
of South Franklin Street; thence South on the West
line of South Franklin Street 200 feet to the place
of beginning. Also beginning at a point 502 feet
South of the Southwest corner of DuBail Avenue,
formerly Blanche Street, and Franklin Street as
laid out in Stulls 5th Addition to the City of South
Bend, Indiana; thence West 153 feet; thence South
80 feet; thence East 153 feet; thence North 80 feet
to the place of beginning.
Lots numbered 5, 6 and 7 as shown on the recorded
Plat of the South Bend and Gary Land Companys
Plat to the City of South Bend.
Section 2:
This ordinance shall be in full force and effect
from and after its enactment, approval by the Mayor, and legal
publication.

CHANGE IN HEIGHT AND AREA DISTRICT
TO: THE COMMON COUNCIL OF SOUTH BEND, and
TO: THE PLAN COMMISSION OF THE CITY OF SOUTH BEND:
COPES NOW BOB RAMS WHOLESALE CO.,INC., an Indiana corpora-
tion, by its attorney Robert J. DuComb, and PITTSBURGH PLATE
GLASS COMPANY, a Pennsylvania corporation doing business in the
State of Indiana, by its attorney, Joseph A. Roper, and say:
1. That Bob Rene Wholesale Co.,Inc. is the owner of the
following described real estate situate in St. Joseph County,
Indiana, said real estate being in and part of the City of South
Bend, to -wit:
Beginning at a point on the Guest line of South
Franklin Street, 502 feet South of the intersection
of the South line of DuBail Avenue, formerly Blanche
Street, with the West line of South Frankline Street,
thence blest 153 feet to the East line of a 14 foot
alley; thence North on the East line of said 14 foot
alley 200 feet; thence East 153 feet to the West line
of South Franklin Street; thence South on the [lest
line of South Franklin Street 200 feet to the place
of beginning. Also beginning at a point 502 feet
South of the Southwest corner of DuBail Avenue,
formerly Blanche Street, and Franklin Street as
laid out in Stulls 5th Addition to the City of South
Bend, Indiana; thence West 153 Feet; thence South
80 feet; thence East 153 feet; thence North 80 feet
to the place of beginning.
2. That the Pittsburgh Plate Glass Company is the owner of
the following described real estatesituate in St. Joseph County,
Indiana, said real estate being in and part of the City of South
Bend, to -wit:
Lots numbered 5, 6 and 7 as shown on the recorded
Plat of the South Bend and Gary Land Companys
Plat to the City of South Bend.
3. That said tracts of land are adjacent to each other and
comprise approximately three - quarters of a full city block in

the City of South Bend and which said realty extends north from
Calvert Street in the City of South Bend on the West side of
Franklin Street and is now occupied by the said corporations,
and is zone as Light Industrial and as E Height and Area District.
4. That your petitioners are desirous of changing the
classification in said area from E Height and Area District to
F Height and Area District but do not desire to change the
zoning classification of Light Industrial.
5. That your petitioners believe that a change of the said
Height and Area classification from E to F of said real estate
in the area, not only will not injure in valuation the surround-
ing properties but will enhance the value thereof and permit your
petitioners fuller and freer use of their property to the best
advantage.
6. That your petitioners do hereby request of the Plan
Commission of the City of South Bend and of the Common Council
of the City of South Bend that the afore - described real estate
be changed from its present classification of E Height and Area
District to F Height and Area District and for all other in-
cidental relief necessary to the proper accomplishment of said
purpose.
