A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, APPROVING THE
FIVE YEAR INTERLOCAL AGREEMENT WITH
ST. JOSEPH COUNTY FOR
EMERGENCY MEDICAL SERVICES
WHEREAS, the City of South Bend, Indiana, has a long and successful history of providing
emergency medical services to its residents; and
WHEREAS, St. Joseph County, Indiana, wishes to provide the very best emergency medical
services to its residents and feels that this can be provided by the City of South Bend; and
WHEREAS, I.C. 36 -1 -7, the Interlocal Cooperation Act, authorizes one or more
governmental entities to exercise jointly or by one entity on behalf of the other powers that may be
exercised by such units severally; and
WHEREAS, the City of South Bend and St. Joseph County, Indiana have been operating
under an Interim Interlocal Agreement concerning Emergency Medical Service; and
WHEREAS, the Executives of both the City of South Bend and St. Joseph County have
approved the Five Year Interlocal Agreement Concerning EMS Services attached hereto.
NOW, THEREFORE AND PURSUANT TO THE AUTHORITY GRANTED BY THE
CITY OF SOUTH BEND, INDIANA, UNDER I.C. 36 -1 -7, BE IT RESOLVED BY THE
COMMON COUNCIL OF THE CITY OF SOUTH BEND AS FOLLOWS:
Section I. That the Common Council of the City of South Bend, Indiana has considered and
hereby approves and ratifies the Five Year Interlocal Agreement Concerning EMS Services attached
hereto.
Section 11. This resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

FIVE YEAR INTER -LOCAL AGREEMENT
CONCERNING EMS SERVICES
1. This agreement is between St. Joseph County (hereinafter "St. Joseph ") and the City
of South Bend (hereinafter "South Bend ").
2. The purpose of this agreement is to help provide ambulance service for those
portions of St. Joseph County which do not otherwise have it available. The area to be
served shall be referred to herein as "Unincorporated County" and is more specifically
described as: all portions of St. Joseph County except for South Bend, Mishawaka, and
property owned or operated by the University of Notre Dame (which is served by South
Bend under a separate contract with Notre Dame).
3. This agreement shall remain in full force and effect from January 1,1998 until
December 31, 2002.
4. This agreement shall be administered through ajoint board consisting of six (6)
members who shall be;
a. The three (3) County Commissioners of St. Joseph;
b. The Mayor of South Bend, The South Bend Fire Chief, and The South Bend
City Controller.
Each member shall have the right to a give a written power of attorney to any other
person for a particular meeting.
5. The staffing and supplying of paramedical services shall be by South Bend. South
Bend will operate three (3) Advanced Life Support ( "ALS ") Ambulances, each properly
equipped and staffed to serve the Unincorporated County.
6. St. Joseph shall own and supply South Bend with one (1)advance support vehicle
with all necessary equipment and with three (3) heavy duty ambulances with all
necessary equipment, including any additional equipment required by the ALS
Committee of St. Joseph County. St. Joseph may delay delivery of the advance support
vehicle until May 1, 1998 and receive an appropriate credit on its monthly payment. St.
Joseph shall pay to South Bend an annual payment of $1,360,789.00 in 1998, payable
in equal monthly increments of $113,399.09, which annual payment shall be increased
in 1999 and 2000 by 4% each year and shall be appropriately increased by the parties
in 2001 and 2002 to reflect additional costs to South Bend. Parties to meet by June 1,
2000 to discuss annual payments by St. Joseph to South Bend for the years 2001 and
2002. If the parties are unable to reach an agreement by October 15, 2000 either party
may terminate this agreement by written notice to the other not later than November 15,
2000. In November 1998 parties agree to review revenues collected by South Bend
under this agreement. In addition St. Joseph shall reimburse South Bend for any
necessary costs it actually incurs in connection with any on -duty injury suffered in
connection with the agreement, either under I.C. 36 -8 -4 -5 or, if recall is necessary, for
the replacement cost of the firefighter so injured. Parties agree that there will be a
fourth heavy duty ambulance with all necessary equipment, to be supplied by St.
Joseph and used by South Bend as a reserve ambulance, and that this vehicle need
not be delivered to South Bend until April 1, 1998.
7. Until such time as modified by the joint board, South Bend may charge the following
maximum fees:
a. For Basic Life Support Services, a sum not to exceed $200.00;
b. For Advanced Life Support Services, a sum not to exceed $300.00;
c. For Non - transport calls at which ALS treatment is given, a sum not to
exceed $75.00.
d. In addition to the above, a $5.00 per mile charge (one -way) shall be imposed;
e. In addition to the above, South Bend shall charge an additional $60.00 fee to
non - residents of St. Joseph County.

8. South Bend shall make reasonable efforts to collect from the Unincorporated County
ambulance patients served under this agreement all due payments and shall return all
such monies collected to St. Joseph within thirty (30) days of receipt, except as
provided herein. South Bend will provide detailed monthly reports to St. Joseph
concerning collections, payments, and runs made pursuant to this agreement. South
Bend shall reimburse Liberty Township Ambulance Service, the town of Walkerton,
Union North Ambulance Service and New Carlisle Ambulance Service fifty percent
(50 %) of any payment received for services rendered for an AILS assist in said localities
prior to disbursal of funds to St. Joseph.
9. Both parties recognize that under certain circumstances proper medical procedure
may require that the two (2) persons assigned to the ambulance provide medical care
to the patient and that the ambulance be driven by an EVOC- Certified volunteer
firefighter from another township within St. Joseph County. In the event of an
automobile accident or occurrence under such circumstances, St. Joseph agrees to
indemnify and hold harmless South Bend from any and all claims, actions, causes of
actions, demands, damages, costs and expenses whatsoever for which South Bend
might be liable.
10. South Bend shall remain liable for the acts of its agents, employees and servants
during the performance of this contract. South Bend hereby undertakes and agrees to
indemnify and hold harmless St. Joseph and its employees, officers, and agents from
any and all loses, expenses, damages, claims, causes of actions, or judgments arising
out of any negligent or intentional act (s) or omission (s) of South Bend or its
employees, servants or agents. The forgoing indemnification, hold harmless and
undertaking of St. Joseph by South Bend shall not apply to any loss, damage, expense,
demand, claims, cause of action or judgment arising out of or caused by instances
covered in Paragraph 9 of this agreement or arising out of a communications system
other than the South Bend Police Department Communications Center.
11. In addition to the monies mentioned in Paragraph 6, St. Joseph shall reimburse
South Bend for all overtime costs incurred by South Bend arising out of the pregnancy
of any female firefighter regularly assigned to an ambulances covered by this
agreement.
12. The Governing Board of this joint agreement shall meet at least quarterly, starting
on the third Tuesday of January, 1998.
13. South Bend shall be responsible for performing all routine maintenance on the
ambulance. In the event a major repair or replacement of the ambulance is needed, it
shall be the responsibility of St. Joseph, except where the damages are solely the
result of the willful or grossly negligent act of an employee of South Bend.
14. The City Controller of the City of South Bend has the duty to receive, disburse, and
account for all monies generated under this agreement.

Attached you will find a Resolution addressing the five year agreement with St. Joseph County
as it relates to the City of South Bend Fire Department providing Emergency Medical Services
throughout the County.
I feel this E.M.S. expansion will enhance the overall E.M.S. service for the County. In mid
January 1998, there will be 3 dedicated ALS ambulances providing service for the County.
