A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND DESIGNATING CERTAIN
AREAS WITHIN THE CITY OF SOUTH BEND COMMONLY KNOWN AS
100 Navarre Place
South Bend, Indiana
AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A SIX (6) YEAR REAL PROPERTY TAX ABATEMENT FOR
MEMORIAL HEALTH SYSTEM, INC. /MEMORIAL HOSPITAL OF SOUTH BEND, INC.
WHEREAS, a petition for real property tax abatement consideration has been filed with the
Common Council of the City of South Bend, requesting that the area commonly known as 100
Navarre Place, South Bend, Indiana, and which is more particularly described as follows:
PARCEL I: The West 25 feet of Lot Numbered One Hundred Forty-five (145)
as shown on the Original Plat of the Town, now City of South Bend, St. Joseph
County, Indiana.
PARCEL II: Lot Numbered One Hundred Forty-five (145) as shown on the
Original Plat of the Town, now City of South Bend, excepting therefrom 25 feet
taken off of and from the entire West side of said Lot Numbered 145.
PARCEL M. The North Half of Lot Numbered One Hundred Forty -six (146) as
shown on the Original Plat of the Town, now City of South Bend.
PARCEL IV: The South Half of Lot Numbered One Hundred Forty-six (146) as
shown on the Original Plat of the Town, now City of South Bend.
PARCEL V: Lot Numbered One Hundred Forty -seven (147) as shown on the
Original Plat of the Town, now City of South Bend, together with the vacated 14-
foot alley lying South and adjacent to Lot 147.
PARCEL VI: Lots Numbered One Hundred Forty-eight (148), One Hundred
Forty -nine (149) and One Hundred Fifty (150) as shown on the Original Plat of the
Town, now City of South Bend, together with the vacated 14 -foot alley lying North
and adjacent to Lot 148.
PARCEL VII: The vacated alley lying between Lots 145 and 156, Lots 146 and
155 and Lots 147 and 154, as shown on the Original Plat of the Town, now City
of South Bend.
PARCEL VIII: Lots Numbered One Hundred Fifty -four (154), One Hundred
Fifty -five (155) and One Hundred Fifty -six (156) as shown on the Original Plat of
the Town, now City of South Bend.
PARCEL IX: The South One -Half (1/2) of vacated Navarre Street lying North
of and adjacent to Lots 145 and 156 as shown on the Original Plat of the Town,
now City of South Bend.
and this property having Key Numbers 18 -1009- 036001, 18 -1009 -0360, 18 -1009- 036101, 18-
1009- 036102, 18 -1009 -0362, 18- 1009 - 036401, 18 -1009 -0355, be designated as an Economic
Revitalization Area under the provisions of IND. CODE Section 6- 1.1- 12.1 -1 al Q., and South
Bend Municipal Code Section 2 -76 r1=.; and
WHEREAS, the Department of Economic Development has concluded an investigation and
prepared a report with information sufficient for the Common Council to determine that the area
qualifies as an Economic Revitalization Area under IND. CODE Section 6 -1.1- 12.1 -1, tt =.,
and South Bend Municipal Code Section 2 -76 et srQ., and has further prepared maps and plats
showing the boundaries and such other information regarding the area in question as required by
law; and
WHEREAS, the Human Resources and Economic Development Committee of the Common
Council has reviewed said report and recommended to the Common Council that the area qualifies
as an Economic Revitalization Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that the Petition for Real
Property Tax Abatement and the Statement of Benefits form completed by the Petitioner meet the
requirements of IND. CODE Section 6- 1.1- 12.1 -1 et sea., and qualify under the relevant
provisions of South Bend Municipal Code Section 2 -76 et sea", for tax abatement.
SECTION II. The Common Council hereby determines and finds the following:
A. That the description of the proposed redevelopment or rehabilitation meets the
applicable standards for such development.
B. That the estimate of the value of the redevelopment or rehabilitation is reasonable
for projects of this nature;
C. That the estimate of the number of individuals who will be employed or whose
employment will be retained by the Petitioner can reasonably be expected to result from
the proposed described redevelopment or rehabilitation;
D. That the estimate of the annual salaries of those individuals who will be employed
or whose employment will be retained by the Petitioner can be reasonably expected to
result from the proposed redevelopment of rehabilitation;
E. That the other benefits about which information was requested are benefits that can
be reasonably expected to result from the proposed described redevelopment or
rehabilitation; and
F. That the totality of benefits is sufficient to justify the requested deduction, all of
which satisfy the requirements of IND. CODE Section 6 -1.1- 12.1 -3.
SECTION III. The Common Council hereby determines and finds that the proposed
described redevelopment or rehabilitation can be reasonably expected to yield benefits identified
in the Statement of Benefits set forth in Sections 1 and 2 of the Petition for Real Property Tax
Abatement Consideration and that the Statement of Benefits form prescribed by the State Board
of Tax Commissioners are sufficient to justify the deduction granted under IND. CODE Section
6- 1.1- 12.1 -3.
SECTION IV. The Common Council hereby accepts the report and recommendation of the
Human Resources and Economic Development Committee that the area herein described be
designated an Economic Revitalization Area and hereby adopts a Resolution designating this area
as an Economic Revitalization Area for purposes of real property tax abatement.
SECTION V. The designation as an Economic Revitalization Area shall be limited to two (2)
calendar years from the date of the adoption of this Resolution by the Common Council.
SECTION VI. The Common Council pursuant to Section 2 -84 of the South Bend Municipal
Code finds that SIX (61 years is the appropriate and rational time period for this tax abatement in
light of the following:
1. The enormous risk the Petitioner takes associated with this type of
development.
2. The additional costs associated with this particular development to
be incurred by the Petitioner.
3. The large overall costs of the development, which is expected to
exceed $33 Million.
The Common Council hereby determines that the property owner is qualified for and is granted
property tax deduction for a period of SIX (6) years.
SECTION VII. The Common Council directs the City Clerk to cause notice of the adoption of
this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to IND.
CODE Section 5 -3 -1 and IND. CODE Section 6- 1.1- 12.1 -2.5, said publication providing notice
of the public hearing before the Common Council on the proposed confirming of said declaration.
SECTION VIII. This Resolution shall be in full force and effect from and after its adoption by
the Common Council and approval by the Mayor.
