A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA IN CENTRE TOWNSHIP (U.S. 31 SOUTH ANNEXATION) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an ordinance which proposes the annexation of the real estate described hereinafter as Exhibit "A ", located in Centre Township, St. Joseph County, Indiana, and which also proposes a reclassification of the zoning to a combination of "C" Commercial, "A" Height & Area; "C" Commercial, "C" Height & Area; "D" Light Industrial, "A" Height & Area; and "A" Residential, "A" Height & Area; and WHEREAS, the territory proposed to be annexed encompasses approximately 196.29 acres of varied use land including residential, commercial, and industrial, among others, located south of the St. Joseph Valley Parkway, between U.S. 31 and Main Street, in Centre Township, St. Joseph County, Indiana, with approximately 15.1% of its aggregate external boundaries coinciding with the boundaries of the City of South Bend, and which property is needed and can be used by the City of South Bend for commercial and residential development. Such development of the territory proposed to be annexed will require a basic level of municipal public services, including services of a non - capital nature such as fire and police protection, and street and road maintenance, and services of a capital improvement nature, including street lighting, roads, curbs, sidewalks, sanitary sewer and storm facilities, and water facilities; and WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including street and road maintenance, police and fire protection, and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street lighting, roads, curbs, sidewalks, water facilities, and sewer facilities; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density; (5) that services of a capital improvement nature will be provided to the annexed area within four (4) years after the effective date of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, the Board of Public Safety of the City of South Bend, and the Board of Water Works Commissioners of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory to be annexed, which plan and policy the Common Council finds appropriate and the adoption of which as the plan and policy for the City of South Bend the Common Council finds to be in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. That it is in the best interest of the City of South Bend and the area proposed to be annexed that the real property located in Centre Township, St. Joseph County, Indiana, described in Exhibit "A" attached hereto and made a part hereof, be annexed to the City of South Bend, and that it be zoned upon annexation in the manner provided within the Ordinance submitted to the Common Council for annexation of the proposed U.S. 31 South area. Section II. That it shall be and hereby is now declared and established that it is the policy of the City of South Bend, to furnish services to said territory of a non - capital nature, such as street and road maintenance, police and fire protection within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City regardless of similar topography, patterns of land use, or population density; and to furnish to said territory services of a capital improvement nature, such as street lighting, roads, curbs, sidewalks, sanitary sewer and storm facilities, and water facilities, within four (4) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. That the Common Council for the City of South Bend shall and does hereby now establish and adopt the fiscal plan described in Exhibit "A ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed. Section IV. This Resolution shall be in full force and effect from and of its date of adoption by the Common Council and approval by the Mayor. INTRODUCTION US 31 South Annexation Area 3 A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in Centre Township, St. Joseph County (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located south of the St. Joseph Valley Parkway, between US 31 and Main Street, and thence south on US 31 for approximately 2,600' on the east side, and thence approximately 1,900' on the west side. See Map 1. B. Legal Description The Annexation Area is part of the southwest and southeast quarters of Section 26; southwest quarter of Section 25; northwest, northeast and southeast quarters of Section 35; northwest and southwest quarters of Section 36, all in Township 37 North, Range 2 East, Centre Township, St. Joseph County, Indiana; part of the northeast and southeast quarters of Section 2, Township 36 North, Range 2 East, Centre Township, St. Joseph County, Indiana. For a complete legal description see Tablel. C.Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous Non - Contiguous Total (approx.) 4,705.8' 26,350.6' 31,056.4' 15.1% 84.9% 100.00% US 31 South Annexation Area 4 D. Size The Annexation Area is approximately 196.29 acres. E. Buildings and Land Use The Annexation Area has a variety.of buildings and land uses. There are approximately 33 residences, 5 vacant parcels, 32 commercial structures, one industrial user (AEP), a portion of a church property, and a portion of a cemetery. F. Zoning & Subdivisions The Annexation Area is currently zoned "R" Residential, "C" Commercial, `B" Business and "M" Manufacturing in unincorporated St. Joseph County. The Annexation Area will be at least 66% subdivided upon the effective date of the annexation ordinance. The Area is proposed to be zoned "A" Residential, "C" Commercial and "D" Light Industrial upon annexation. Population The population within the Annexation Area is approximately 82. H. Tax Rate The tax rates used are those of 1997 payable in 1998. The Township Rate will decrease by $.4098 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $7.3263 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $6.9165 per $100.00 of assessed valuation. Table 2 shows representative tax rate information as published by the St. Joseph County Auditor. US 31 South Annexation Area 5 I. Assessments Net Assessment 1997 payable 1998, St. Joseph County Auditor property tax records: Net Assessment: $1,379,070.00 I Councilmanic District The Annexation Area will be in Councilmanic District 6. K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The German Township Trustee has been notified of this annexation. US 31 South Annexation Area 6 SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - An existing 30 -inch sanitary sewer is located at the intersection of Ruby and Topaz Streets. This sewer can be extended with a 24 -inch sewer south on Ruby Street to Johnson Road, then east to Main Street, then south to US 31 South, then south to Kem Road. The sewer would be reduced in size to an 18 -inch pipe, which would continue south on US 31 South for approximately 4,000'. This sanitary sewer extension has the capacity to handle the additional load and service the Annexation Area. The cost extend the sewer is $435,000. A seperate sewer extension to service the residential properties around Jackson Road and Main Street will be required. The cost for this extension is estimated at approximately $80,000. Water - There is an existing 12 -inch water line at the intersection of Johnson Road and US 31 South. This 12 -inch water line would be extended west to Main Street, then south to US 31 South, then south to the proposed commercial development. This water line extension has the capacity to service the Annexation Area. The cost to extend the water is $375,592.00. A seperate water extension to service the residential properties around Jackson Road and Main Street will be required. The cost for this extension is estimated at approximately $250,000. Storm Sewer - No storm sewers exist in the area. All storm water is to be retained on site. Street Lights - The estimated cost to install street lights is $50,000 Other Capital Expenditures - An increased capital expenditure to maintain streets is estimated to be at $50,000 Public improvements within the Annexation Area, such as street lights, roads, curbs and sidewalks are to be at the expense of the developers. Improvements will be able to be maintained without additional expense. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utilities. Exact locations and routes of the sewer and water extensions will be determined at the design stage B. Police Department The Annexation Area will be added to Beat 15. The expansion of Beat 15 will extend the Beat approximately 1.5 miles south of the present City limits currently at the St. Joseph Valley Parkway and US 31 interchange. Police coverage can be expected to begin shortly after the effective date of the annexation. The Department notes that the annexation of this area will require police officers to respond to typical residential property crimes such as vandalism and auto larcenies. Commercial areas are generally prone to drive -offs and robberies, although this area has not been subject to a high US 31 South Annexation Area 7 volume of such incidences in the past. The proposed retail stores may require additional police response. The Department further notes that traffic enforcement is a concern in this area. The volume of traffic and the number of accidents over the past year indicates that the request for police assistance will increase in the Beat. The Department notes that police units could be expected to provide service to the proposed annexation area. Beat 15 may need future reconfiguration to better service its area, especially since other Beats may not be able to provide efficient support for back up calls. Additional growth on the southside may require a new police beat, which would effect other beats in the City. C. Fire Department The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. The Annexation Area is located approximately 2 miles from Station #10, located at 308 West Ireland Road. Additional Fire Department units would respond from the new Fire Station #10 to be located at York Road, just south of Jackson Road, approximately 5 miles away. Fire officials note that response times will be comparable to other areas of the City, and that no additional equipment will need to be purchased or personnel hired to service the Annexation Area. D. Code Enforcement The Department of Code Enforcement can provide services to the Annexation Area with no additional increase in manpower or equipment. E. Environmental Services The Division of Environmental Services notes that service will be offered as needed. The service will be offered at a rate of $8.00 per month, or $5.50 per month for senior citizens. F. Administrative Services The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county -wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South Bend Building Department are some of the county -wide agencies that will continue to provide the same type and level of services to the Annexation Area. US 31 South Annexation Area 8 SECTION IV. FISCAL IMPACT The cost of providing city services to the Annexation Area can be absorbed by Department budgets: 1) essential city services and facilities are or can be made available to the residents of the Annexation Area 2) the city is physically and financially able to provide city services to the territory sought to be annexed Summary Table - Fiscal Impact All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. Property tax estimates are based on 1997 payable 1998 tax rates, taxes paid in previous years by a comparable development, estimates of units built, and no tax abatements. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA IN CENTRE TOWNSHIP (U.S. 31 SOUTH ANNEXATION) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an ordinance which proposes the annexation of the real estate described hereinafter as Exhibit "A ", located in Centre Township, St. Joseph County, Indiana, and which also proposes a reclassification of the zoning to a combination of "C" Commercial, "A" Height & Area; "C" Commercial, "C" Height & Area; "D" Light Industrial, "A" Height & Area; and "A" Residential, "A" Height & Area; and WHEREAS, the territory proposed to be annexed encompasses approximately 196.29 acres of varied use land including residential, commercial, and industrial, among others, located south of the St. Joseph Valley Parkway, between U.S. 31 and Main Street, in Centre Township, St. Joseph County, Indiana, with approximately 15.1% of its aggregate external boundaries coinciding with the boundaries of the City of South Bend, and which property is needed and can be used by the City of South Bend for commercial and residential development. Such development of the territory proposed to be annexed will require a basic level of municipal public services, including services of a non - capital nature such as fire and police protection, and street and road maintenance, and services of a capital improvement nature, including street lighting, roads, curbs, sidewalks, sanitary sewer and storm facilities, and water facilities; and WHEREAS, the Board of Public Works of the City of South Bend, the Board of Public Safety of the City of South Bend, and the Board of Water Works Commissioners of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory to be annexed, which plan and policy the Common Council finds appropriate and the adoption of which as the plan and policy for the City of South Bend the Common Council finds to be in the best interests of the City. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation of property in Centre Township, St. Joseph County (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located south of the St. Joseph Valley Parkway, between US 31 and Main Street, and thence south on US 31 for approximately 2,600' on the east side, and thence approximately 1,900' on the west side. See Map 1. B. Legal Description The Annexation Area is part of the southwest and southeast quarters of Section 26; southwest quarter of Section 25; northwest, northeast and southeast quarters of Section 35; northwest and southwest quarters of Section 36, all in Township 37 North, Range 2 East, Centre Township, St. Joseph County, Indiana; part of the northeast and southeast quarters of Section 2, Township 36 North, Range 2 East, Centre Township, St. Joseph County, Indiana. For a complete legal description see Table]. C.Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous Non - Contiguous . Buildings and Land Use The Annexation Area has a variety of buildings and land uses. There are approximately 33 residences, 5 vacant parcels, 32 commercial structures, one industrial user (AEP), a portion of a church property, and a portion of a cemetery. F. Zoning & Subdivisions The Annexation Area is currently zoned "R" Residential, "C" Commercial, "B" Business and "M" Manufacturing in unincorporated St. Joseph County. The Annexation Area will be at least 66% subdivided upon the effective date of the annexation ordinance. The Area is proposed to be zoned "A" Residential, "C" Commercial and "D" Light Industrial upon annexation. Tax Rate The tax rates used are those of 1997 payable in 1998. The Township Rate will decrease by $.4098 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $7.3263 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $6.9165 per $100.00 of assessed valuation. Table 2 shows representative tax rate information as published by the St. Joseph County Auditor. US 31 South Annexation Area I. Assessments Net Assessment 1997 payable 1998, St. Joseph County Auditor property tax records: Net Assessment: $1,379,970.00 J. Councilmanic District The Annexation Area will be in Councilmanic District 6. K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The German Township Trustee has been notified of this annexation. US 31 South Annexation Area SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - An existing 30 -inch sanitary sewer is located at the intersection of Ruby and Topaz Streets. This sewer can be extended with a 24 -inch sewer south on Ruby Street to Johnson Road, then east to Main Street, then south to US 31 South, then south to Kern Road. The sewer would be reduced in size to an 18 -inch pipe, which would continue south on US 31 South for approximately 4,000'. This sanitary sewer extension has the capacity to handle the additional load and service the Annexation Area. The cost extend the sewer is $435,000. A seperate sewer extension to service the residential properties around Jackson Road and Main Street will be required. The cost for this extension is estimated at approximately $80,000. Water - There is an existing 12 -inch water line at the intersection of Johnson Road and US 31 South. This 12 -inch water line would be extended west to Main Street, then south to US 31 South, then south to the proposed commercial development. This water line extension has the capacity to service the Annexation Area. The cost to extend the water is $375,592.00 Storm Sewer - No storm sewers exist in the area. All storm water is to be retained on site. Street Lights - The estimated cost to install street lights is $50,000 Other Capital Expenditures - An increased capital expenditure to maintain streets is estimated to be at $50,000 Public improvements within the Annexation Area, such as street lights, roads, curbs and sidewalks are to be at the expense of the developers. Improvements will be able to be maintained without additional expense. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utilities. B. Police Department The Annexation Area will be added to Beat 15. The expansion of Beat 15 will extend the Beat approximately 1.5 miles south of the present City limits currently at the St. Joseph Valley Parkway and US 31 interchange. Police coverage can be expected to begin shortly after the effective date of the annexation. The Department notes that the annexation of this area will require police officers to respond to typical residential property crimes such as vandalism and auto larcenies. Commercial areas are generally prone to drive -offs and robberies, although this area has not been subject to a high volume of such incidences in the past. The proposed retail stores may require additional police response. US 31 South Annexation Area The Department farther notes that traffic enforcement is a concern in this area. The volume of traffic and the number of accidents over the past year indicates that the request for police assistance will increase in the Beat. The Department notes that police units could be expected to provide service to the proposed annexation area. Beat 15 may need future reconfiguration to better service its area, especially since other Beats may not be able to provide efficient support for back up calls. Additional growth on the southside may require a new police beat, which would effect other beats in the City. C. Fire Department The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. The Annexation Area is located approximately 2 miles from Station #10, located at 308 West Ireland Road. Additional Fire Department units would respond from the new Fire Station #10 to be located at York Road, just south of Jackson Road, approximately 5 miles away. Fire officials note that response times will be comparable to other areas of the City, and that no additional equipment will need to be purchased or personnel hired to service the Annexation Area. D. Code Enforcement The Department of Code Enforcement can provide services to the Annexation Area with no additional increase in manpower or equipment. E. Environmental Services The Division of Environmental Services notes that service will be offered as needed. The service will be offered at a rate of $8.00 per month, or $5.50 per month for senior citizens. F. Administrative Services The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county-wide agencies that will continue to provide the same type and level of services to the Annexation Area.
