HomeMy WebLinkAbout12/17/2014 Board of Public Safety MinutesPUBLIC AGENDA SESSION DECEMBER 17.2014 86 The Board of Public Safety met in the Public Agenda Session at 8:07 a.m. on Wednesday, December 17, 2014 in the 13" Floor Boardroom, County-City Building, 227 West Jefferson Blvd, South Bend, Indiana, with Board President Laura Vasquez and Board Members Eddie Miller, John Collins, Luther Taylor, and Daniel Jones present. Also present was Assistant Fire Chief Todd Skwarcan, Police Chief Ronald Teachman, Attorney Cory Hamel, and Board Legal Counsel Tasha Outlaw. Board members discussed the following agenda items: - Police 2015 -2016 Working Agreement Attorney Cory Hamel stated the Board previously approved the tentative policies and he is now submitting the new final agreement for signature. He noted the Fraternal Order of Police signed the final agreement already. - Set Hearings of Disciplinary Charges Attorney Hamel suggested the Board set the dates for the Hearings of Charges against Jack Stilp, Theodore Robert, and David Gnoth in their Executive Session and announce them in the regular meeting. - Shot Spotter Policy Police Chief Ronald Teachman stated he presented the draft policy at the last Board meeting, and invited the Board's input. He is now presenting the final policy for approval. Chief Teachman noted they are trying to memorialize what's been in practice already. Historically, Officers complete their normal duties, talk to witnesses and investigate, and take photographs. In addition to their normal investigation processes, this policy requires the officers go to neighbors in the area and have conversations with potential witnesses. - Donation Chief Teachman stated they are grateful when the public extends philanthropy to the programs of the Police Department. He added this donation was for workout equipment for the Police Department boxing program. - Monthly Statistical Analysis Chief Teachman noted the Police Department has weekly meetings to analyze data. He stated he is very concerned about categories showing increases, especially aggravated assault. He noted if they — could get larceny down, it would reduce all the other categories. Chief Teachman added they are also tracking shots fired and the number of people shot and that number is down 16% compared to the last three years, and down at least 42% for the last three years in December. - Leave of Absence — Fire Department Assistant Chief Todd Skwarcan stated Firefighter Grant Baker is a valuable employee, and the skills he will acquire through medical training in the field, will be useful to the department. Mr. Taylor asked what the Chiefs recommendation is. Assistant Skwarcan stated he is inclined to honor the request. He noted it is more cost effective to allow this rather than go back and replace him. Mr. Collins asked who will fill in his job duties and what will they do if he doesn't come back. Chief Skwarcan stated they would replace him in the fall recruit class. - Collective Bargaining Agreement - Fire Department Attorney Hamel stated they have resolved all the prior issues, and the Union ratified the tentative agreement but have not signed it yet. He noted the Board also approved the tentative agreement this is just the final document being presented for signature. PRIVILEGE OF THE FLOOR Police Chief Teachman noted he would like to add two items regarding discussions of Police Department policies with the Board before approval and perhaps giving them a trial run prior to the Board's official approval. He explained one of the policies is regarding the domestic violence calls policy. He stated they would like to add an eleven (11) question form that will be required by officers to fill out that will show if the victim is at risk of getting killed. He noted it would take an hour of training the officers on how to use the form. Chief Teachman stated they would like to run a trial next month to get core officers to use the form and see how it works. The other policy, Chief Teachman stated is the eye- witness identification policy. Chief Teachman noted that most wrongful convictions are based on incorrect eye witness identifications, and studies have shown that sometimes there is suggestiveness that may occur. He explained if the victim is questioned sometime after the event they have difficulty identifying the suspect. He stated they are asking for a blind identification practice in South Bend, explaining they want someone that has nothing to do with the case to be giving the photographs to the victim. Rather than have a homicide officer, they would use apatrol officer, who has no knowledge of the crime, read a script and show PUBLIC AGENDA SESSION DECEMBER 17 2014 87 random photographs. Chief Teachman noted it is much betterto have someone unassociated with the crime to prevent wrongful convictions. Mr. Collins asked i f they can move forward with the testing and bring back the results in January. The Chief agreed they would. Board President Laura Vasquez and Board Members Eddie Miller, John Collins, Luther Taylor, and Daniel Jones were present. Also present were Assistant Fire Chief'fodd Skwarcan, Police Chief Ronald Teachman, Attorney Aladean DeRose, and Legal Counsel Tasha Outlaw. The meeting was held in thelP Floor Boardroom, County -City Building, 227 West Jefferson Blvd., South Bend, Indiana APPROVE MINUTES OF PREVIOUS MEETINGS Upon a motion by Mr. Jones, seconded by Mr. Taylor and carried, the Board approved the Minutes of the Public Agenda Session, Executive Session, and Regular Meetings of November 19, 2014 and the Special Meetings of November 24 and December 3, 2014, as presented. POLICE DEPARTMENT APPROVE AND ENTER FINDINGS OF FACT — JACK STILP President Vasquez stated on June 25, 2014, Police Chief Ronald Tcachman recommended that due to disciplinary charges against Patrolman Jack Stilp, he be terminated from employment with the South Bend Police Department. Patrolman Stilp requested a hearing before the Board of Safety on July 3, 2014. On November 24, 2014 the Board of Safety held a Special Meeting to hear th e charges against Patrolman Stilp. President Vasquez stated the Board is now presentin the disciplinary hearing recommending that Patrolman Jack Sg the Findings of Fact regarding placed on suspension without in tilp pay for a period of ninety (90) calendar days and upon return to work, that he be reduced in rank for a period of six (6) months from Patrolman First Class to Patrolman. President Vasquez stated the effective dates of the suspension and demotion will be determined . Chief President Vasquez Therefore, upon a motion by Mr. Miller, seconded by Mr. Taylor and carried, the Findings of Factn. Therefore, the disciplinary charges were approved. Ms. Vasquez and Mr. Jones voted in opposition of the Findings of Fact, ACCEPT AND APPROVE DECLARATION FOR RETIREMENT — JOSEPH LAUCK President CourelI advised that Police Chief Ronald Teachman has submitted to the Board the Application and Declaration for Retirement for Patrolman Joseph Lauck effective January 15, 2015. Chief Teachman noted that Patrolman Lauck is retiring in good standing after serving twenty-nine (29) years, nine (9) months and thirteen (13) days on the department. Chief Teacltrnan joined the Board in thanking him for his years of service to the South Bend Police Department and the citizens of South Bend. Upon a motion made by Mr. Jones, seconded by Mr. Taylor and carried, the retirement was accepted and approved. APPROVE 2015 -2016 POLICE WORKING AGREEMENT Attorney Cory Hamel presented the Boardthe final 2015 -2016 Working Agreement between the City Of South Bend and the Fraternal Order of Police. He noted the Board approved the agreement at their last meeting of November 19, 2014, subject to the final document being presented at this month's meeting. Upon amotion by Mr. Taylor, seconded by Mr. Jones and carried, the Working Agreement was approved in final form and signed. ADOPT RESOLUTION NO.56 -2014 — ESTABLISHING THE 2015 HOLIDAY SCHEDULE FOR THE SOUTH BEND POLICE DEPARTMENT Upon a motion by Mr. Miller, seconded by Mr. Collins and carried the following resolution was adopted by the Board of Safety setting the 2015 IIoliday Schedule for the South Bend Police Department: RESOLUTION A RESOLUTION OF THE BOARD OF PUBLIC. SAFETY OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING THE 2015 HOLIDAY SCHEDULE FOR THE SOUTH BEND POLICE DEPARTMENT WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by law to establish rules and regulations for the South Bend Police Department; and WHEREAS, it is in the interest of the City of South Bend that the Police Department holidays be set with certainty. REGULAR MEETING DECEMBER 17.2014 89 NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety ofthe City of South Bend: SECTION I. SECTION III. Officers assigned to the South Bend Community School Corporation shall, while so assigned, follow the holiday schedule set by the South Bend Community School Corporation for its clerical employees. SET HEARINGS OF DISCIPLINARY CHARGES — DAVID GNOTH Upon a motion by Mr. Miller seconded by Mr. Jones and carried, the hearing of disciplinary charges for Patrolman David Gnoth was set for February 2, 2015, at 8:30 a.m. in the 13' Floor Boardroom. APPROVE SHOTSPOTTER POLICY Upon a motion by Mr. Jones, seconded by Mr. Taylor and carried, the Board approved the Shot Spotter Policy in final form. APPROVE 2015 SPECIAL POLICE COMMISSIONS In a letter to the Board, Police Chief Ronald Teachman recommended that the following Special Police Commissions be renewed and or issued for the year 2015: SOUTH BEND POLICE DEPARTMENT Traffic Enforcement Officers Jerrid Arnold Shawn Brugh Daniel Bowman Richard Cowper Tom Camren Dennis Eckenberger Emil Eckenberger Garnett Keeys Barbara Leavell Patrick Leavell Kyle Lindzy William Marshall Michael Rhoades Elton Thompson Steven Wieger Michael David It is my recommendation that the following South Bend Police Department personnel be commissioned as members of the South Bend Police Department Special Police Unit, but do not have the authority to be armed nor do they have powers of arrest: Public Service Officers It is also my recommendation that the Special Police Commissions be issued or renewed for the following South Bend Police Department Public Service Officers. These Commissions are issued for the purpose of issuing citations for parking violations where such violations have fines set by Ordinance and State Law. All of their officers are sworn and certified through the State of Indiana by the Indiana Law Enforcement Academy'fraining Board. IVY TECH SOUTH BEND CAMPUS It is my recommendation that a Special Police Commission be assigned to the following security officer of Ivy Tech South Bend Campus. This Commission is issued for the purpose of issuing citations for parking violations where such violations have fines set by Ordinance and State — Law. This officer is sworn and certified through the State of Indiana by the Indiana Law Enforcement Academy Training Board. This Commission has the same authority of as one of our own swom police officers in which they have the authority to carry a weapon and the powers of arrest: James E. Clark Jr This will empowerthe above listed individual to enforce parking violations onthe following streets adjacent to the campus: Main Campus: Michigan St. from Broadway St. north to Sample St. Sample St. east to Fellows. Fellows south to Broadway, including Dean Johnson Blvd. (which runs east and west inside this perimeter). Broadway St. west to Michigan. The property ONLY owned by Ivy Tech at 328 Michigan Street and the property owned by Ivy Tech at 250 Sample St. DEPARTMENT OF CODE ENFORCEMENT It is my recommendation that the following individuals be commissioned for the Department of Code. Enforcement. This Commission is issued for the purpose of writing citations for Ordinance violations where such violations have fines set by Superior Court Judges. This Commission will also empower the below - listed individuals to enforce the Snow Route and Residential Snow Emergencies and to tow vehicles found to be in violation of these Ordinances. This Commission also includes Animal Control officers wito issue tickets for nuisance violations. This Commission does not authorize the powers of arrest nor the carrying or use of a weapon. Chief Teachman noted that any previous Special Police Commissions that were issued to anyone not listed in this letter, are now rescinded. The aforementioned police commissions are in effect until rescinded. All of the aforementioned indi viduals have met the Commission requirements REGULAR MEETING DECEMBER 17.2014 93 Collins and carried, the Special Police Commissions were approved as outlined above. ACCEPT AND FILE DONATION TO SOUTH BEND POLICE DFPARTMEN'f In a letter to the Board, Assistant Chief Scott Ruszkowski, Police Department, advised the Board of generous donation of a Pro -form recumbent bike made to the South Bend Police Department PAT, Boxing Club from Kristin Sheehan. There being no further discussion, the donation was thankfully accepted and filed. — FILING OF QUARTERLY REPORT FOR SPECIALIZED TRAINING —JULY AUGUST AND SEPTEMBER 2014 Captain Morrie Taylor, Training Division, South Bend Police Department, submitted to the Board a written Quarterly Report for Specialized Training for the period of July, August and September 2014. The report indicated the specialized training attended, the names of the officers who attended and the costs involved. There being no questions concerning this report, the Quarterly Report for Specialized Training as submitted was accepted and filed. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — NOVEMBER 2014 President Vasquez stated that unless there were questions or objections by members of the Board, the statistical analysis report for the month of November 2014. as submitted by the Police Department, would be accepted for filing. Chief Cox stated in his letter that Firefighter Lagodney was placed in a special assignment as a Captain on December 18, 2013. Chief Cox stated Captain Lagodney has completed all the requirements of the position in outstanding fashion, and recommended a permanent promotion based on his progress. Upon a motion made by Mr. Miller, seconded by Mr. Collins and carried, the recommended permanent promotion was approved. TABLE REOIMST FOR UNPAID LEAVE OF ABSENCE GRANT BAKER In a letter to the Board, Fire Chief Stephen Cox, stated that Firefighter Grant Baker requests the Board grant him an unpaid leave of absence for approximately six (6) months in order to allow him to take advantage of an opportunity to work with surgeons in the operating room as a Clinical Specialist for a medical device company placing grafts and stents into abdominal and thoracic aneurysms. Chief Cox noted as an Advanced EMT, Firefighter Baker is required to treat patients in the field that are subject to these medical problems and will be able to bring this working knowledge back to the Department and become an EMS instructor. President Vasquez stated the Board would like to table this request for further information and a discussion with Chief Cox upon his return. APPROVE 2015 -2017 FIRE DEPARTMENT COLLECTIVE BARGAINING AGREEMENT REGULAR MEETING DECEMBER 17.2014 94 Attorney Cory Hamel presented to the Board the final 2015 -2017 Collective Bargaining Agreement for the Board's approval. He noted the Board approved the agreement subject to the final document being presented at today's meeting. Mr. Hamel stated he would like to note that both the Police and Fire negotiations were very productive. He stated he was impressed with the professionalism shown by both parties and he would like to thank everyone. Upon a motion by Mr. Jones, seconded by Mr. Collins, and curried, the agreement was approved and signed. RECOGNIZE FORMER BOARD OF SAFETY ATTORNEY The Board of Safety stood and noted Mr. Hamel's resignation from the City and recognized and thanked Mr. Hamel for every thing he has done for them and the education he has provided to the Board. ADOPT RESOLUTIONNO.57- 2014 — ESTABLISHING THE 2015 HOLIDAY SCHEDULEFOR THE SOUTH BEND FIRE DEPARTMENT Upon amotion by Mr. Taylor, seconded. by Mr. Collins and carried the following resolution was adopted by the Board of Safety setting the 2015 Holiday Schedule for the South Bend Police Department: RESOLUTION NO. 57 -2014 A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING THE 2015 HOLIDAY SCHEDULE FOR THE SOUTH BEND FIRE DEPARTMENT WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by law to establish rules and regulations for the South Bend Fire Department; and WHEREAS, it is in the best interest of the City of South Bend that the Fire Department holidays be set with certainty. NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Safety of the City of South Bend: SECTION I. That all firefighters who work 24 -hour shifts are not entitled to holidays off. SECTION B. That for all firefighters who work 24 -hour shifts, Critical Duty Days are as set forth in Article 25 of the Collective Bargaining Agreement for the year 2015, which is in force in 2015 per Article 33 of the Agreement. SECTION M. That all firefighters who are assigned to work a four or five day work week shall have one floating holiday to be taken, upon approval from a supervisor, at the time of their choosing. Martin, Clerk FILING OF QUARTERLY TRAVEL AND TRAINING EXPENDITURES REPORT— AUGUST, SEPTEMBER AND OCTOBER 2014 Fire Chief Steve Cox submitted to the Board a written Quarterly Travel and Training Expenditures Report for the period of August, September, and October 2014. The report summarizes travel and training expenditures for the South Bend Fire Department personnel during this quarterly period. In his letter, Chief Cox slated that training is essential to all aspects of fire service and it is necessary to remain abreast of the most current firefighting technologies and emergency medical services. There being no questions concerning this report, the Quarterly Report for Travel and Training Expenditures was accepted and filed. FILING OF MONTHLY STATISTICAL. ANALYSIS REPORT — NOVEMBER 2014 Fire Chief Stephen Cox submitted to the Board the monthly report for November 2014 compiled by the Prevention/Inspection Bureau of the Fire Department. M- s. Vasquez stated if there were no objections, the Board would accept the report for filing as presented. Sergeant Hinton informed the Board that he is assigned to the Domestic Violence Division and has been working with the County to "train the trainers" in order to enact a lethality policy that includes an eleven question protocol for officers to fallow to determine if a victim should be referred to an advocacy unit. Sergeant Hinton passed out copies of the policy and noted the first three questions officers would ask would automatically determine that the victim should be referred to a victim advocacy unit. Sergeant Hinton noted there are currently twelve (12) counties in Indiana using the policy. President Vasquez stated the Board discussed this at their Agenda Review Session and they look forward to seeing the draft and they are in support of the program. Chief Teachman stated there is another issue they are working on involving wrongful convictions and why they occur. He noted they have determined that the weak link is in witness identification and the possibility of unintended influence. Chief Teachman stated there are several procedures used for witness identification, the most common one being a photo array. Chief Teachman stated they are working on a. policy where the key presenter of the photo array is not involved and doesn't know anything about the case so there is no unintended influence. Attorney Douglas Grimes addressed the Board and stated he appreciates the Board's efforts with Officer Jack Stilp but explained that he felt it necessary to make his objections to the Findings of Facts at this time. Attorney Grimes stated they object to the imposing of ninety (90) days without REGULAR MEETING DECEMBER 17.2014 96 pay. He noted there are additional charges to be heard on February 9, 2015. Also, Officer Stilp is currently on leave with pay that will overlap the other charges. He stated he is requesting to delay the Board's determination until his current leave is over. Attorney Tasha Outlaw stated the effective dates will be determined by the Chief of Police and they have not yet been set. She added Mr. Grime's comments will be duly noted and taken into consideration. Ms. Vasquez added both leaves are subject to the Chief s determination. Attorney Grimes stated this raises further objection to the ninety (90) days without pay leave and questioned whether the current leave continues with pay. President Vasquez stated he is currently on administrative leave with pay until such time Chief Teachman determines what date Officer Stilp will be suspended without pay. Mr. Collins stated the Hearing has been set for February 9, 2015. He suggested these issues will be determined at that time, but once the Chief sets the date of the ninety (90) day suspension, the administrative leave with pay becomes null and void.
