AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTERS 4,5, AND 10
OF THE SOUTH BEND MUNICIPAL CODE TO REVISE PROVISIONS FOR
SOME OF THE LICENSING FEES GOVERNED BY THE CITY OF SOUTH BEND

STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to fulfill the requirement of Section 4-18 of the
South Bend Municipal Code. That Section requires the Common Council to review
annually all license fees charged by the City. That Section further states that all fees
shall be reasonably related to the costs incurred by the City in regulating specified
businesses.
The Common Council of the City of South Bend determines that certain licensing
fees should be adjusted to reflect the actual costs incurred by the City of South Bend in
issuing licenses and providing services related to the enforcement of licensing
ordinances of the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
Section I. Chapter 4, Article 3, Section 4-18, of the South Bend Municipal Code
shall be, and hereby is, amended to read as follows:
Sec. 4-18. Annual licensing report and review of license fees.
a. On or before November 1St of each year, the Office of the City Controller
shall provide a written "Annual Licensing Fee Report". Said report shall provide a
cost/benefit analysis for license fees charged by the City. A summary for each fee and
criteria used for all recommended changes shall be included.
b. The Common Council shall review ++y-all license fees charged by
the City. The Personnel and Finance Committee shall recommend to the Common
Council on an annual basis an r~proposed changes following the review of the Annual
Licensing Fee Report. All fees shall be reasonably related to the cost incurred by the
City in regulating activities requiring a license to operate.
Section II. Chapter 4, Article 4, Section 4-19, Subsection (d) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-19. Arborist license.

(d) issuance fee. Upon recommendation of the Board of Park Commissioners and
proof of public liability insurance, the Controller shall issue an arborist's license to an
applicant upon payment of the following fees:
(1) For engaging in the arborist business, sixt
dollars ($60.00) per year.
(2) For each vehicle used in conducting the arborist business,
three dollars ($3.00) per year, for which numbered license
plates shall be issued.

Section III. Chapter 4, Article 4, Section 4-20, Subsection (E) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-20. Automotive repair and service centers.
(E) License fee. If the applicant meets the requirements of this section, the
Controller shall issue a license upon payment of an annual fee of
two hundred dollars ($200.00).
Section IV. Chapter 4, Article 4, Section 4-22, Subsection (g)(1) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-22. Carnivals and circuses.

(g) License fees:
(1) The fee for the issuance of a license under this section shall be-tv~e

Section V. Chapter 4, Article 4, Section 4-23, Subsection (E) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-23. Fertilizer manufacturing facilities.

(E) License Fee. The annual fee for a license to operate a fertilizer manufacturing
facility shall be two hundred dollars ($200.00),
payable to the Controller at the time of issuance of the license.

Section VI. Chapter 4, Article 4, Section 4-25, Subsection (e) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-25. Food vending vehicles.
***************************************************************************************************
(e) Food vending vehicle license. A food vending vehicle license shall be required
for every such vehicle for use and operation in the City. Said license shall be issued
upon compliance with this chapter and upon payment of -
sixty-five dollars ($65.00) per vehicle. Each metal sign issued for a vehicle should be
securely fastened to the vehicle and in plain view.

Section VII. Chapter 4, Article 4, Section 4-30, Subsection (d) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-30. Hotels and motels.

(d) Fees. The fee for the issuance or renewal of each license under this section shall
be ninety-five dollars ($95.00) per year_ pef-rear~-

Section VIII. Chapter 4, Article 4, Section 4-34, Subsection (c) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-34. Self-service laundries.

(c) License fees. The applicant for aself-service laundry license shall pay an annual
fee of three dollars ($3.00) for each washing
machine, dryer or combination washing machine-dryer or dry cleaning machine used in
the licensed establishment, or a minimum of forty-five dollars

Section IX. Chapter 4, Article 4, Section 4-35 Subsection (c)(5)(a) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-35. Massage establishments and technicians.

(5) License fee:
a. The fee for an annual license to operate a massage establishment shall
be one hundred twenty dollars ($120.00) payable to the
City Controller at the time of the issuance of said license.

Section X. Chapter 4, Article 4, Section 4-36 Subsection (f) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-36. Pool halls.

(f) License issuance. The city controller shall issue a pool hall license to all persons
complying with this section upon the favorable recommendations of the police, building
and fire departments and the payment of a #tfty~affa~ one hundred dollar ($100.00)
licensing fee.
Section XI. Chapter 4, Article 4, Section 4-38 Subsection (d) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-38. Open-air businesses.

(d) The license fee for an open-air business conducted on private property shall be

fee for an open-air business conducted upon public property shall be ~t

by the Controller under this section until the zoning, ingress and egress of the
location(s) have been approved by the appropriate City Departments.

Section XI I. Chapter 4, Article 4, Section 4-39 Subsection (e) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-39. Public parking facility.

(e) Public parking facility. A fee of

for each license issued under this section.

Section XII I. Chapter 4, Article 4, Section 4-40 Subsection (e) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-40. Outdoor motion picture theaters.

(e) License fee. If the applicant meets the requirements of this Code, the Controller
shall issue a license upon payment of an annual fee of

Section XIV Chapter 4, Article 4, Section 4-43 Subsection (f) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-43. Peddlers and canvassers.

(f) Peddler's and canvasser's license fees; bonds:
(1) The fees or licenses for peddlers or canvassers using a pushcart, wagon,
motor vehicle or any type of vehicle shall be
qs fifty dollars ($50.00) per year.
(2) The license fee for pack peddlers or canvassers shall be etewe
fifty dollars $50.00) per year.
(3) The City Controller may require an applicant to file a personal or surety
bond with a maximum limit of Fifteen Hundred Dollars ($1,500.00).

Section XV. Chapter 4, Article 4, Section 4-44 Subsection (b)(6) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-44. Precious metals dealers.

b. License and place of operation:
(6) The applicant for a precious metals dealer license shall pay an annual fee
of seventy-five dollars ($75.00) to the Controller,
upon issuance of the license.

Section XVI. Chapter 4, Article 4, Section 4-45 Subsection (e) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-45. Restaurants, generally.

(e) License fees:
(1) Restaurants: The City Controller shall issue a restaurant license to all
persons complying with this section upon payment of
ninety dollars ($90.00) per
year for restaurants having a seating capacity of up to one hundred fifty (150)
patrons and one hundred ten dollars ($110.OOZper year for restaurants having_a
seating capacity of one hundred fifty-one (151) patrons and over.
(2) Itinerant restaurants: The City Controller shall issue an itinerant restaurant
license to all persons complying with this section upon payment of #we-daH~rs

Section XVI I. Chapter 4, Article 4, Section 4-48 Subsection (e) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-48. Rubbish and garbage removal.

(e) License fees:
(1) Nonrestricted license: Upon compliance of an applicant with this section,
and after payment of thtrtp sixty dollars ($39-69 60.00) per vehicle per year, a
nonrestricted license shall be issued by the Controller.
(2) Restricted license: Upon compliance of an applicant with this section, and
after payment of sixthdollars ($60.00) per vehicle per year,
a restricted license shall be issued by the Controller.
(3) Plate: For each vehicle granted a license, the Controller shall furnish a
number plate, which the owner or lessee of such vehicle shall display on such
vehicle in a prominent place so as to be visible at all times.

Section XVIII. Chapter 4, Article 4, Section 4-51 Subsection (g) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-51. Scrap metal dealers, junk dealers, recycling operations, and transfer
stations.

(g) License fee. The fee for an annual license to operate a scrap or junkyard,
recycling operation or transfer station shall be one
hundred ninety dollars ($190.00), payable to the Controller at the time of the issuance
of such license.
Section XIX. Chapter 4, Article 4, Section 4-53 Subsection (d) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-53. Secondhand stores.
(d) License fee. The applicant for a secondhand store license shall pay an annual
fee of one hundred fifteen dollars {~r1-99-60 115.00 to the Controller, upon approval
of the Board and Police Department and issuance of the license.

Section XX. Chapter 4, Article 4, Section 4-53 Subsection (j) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-53. Secondhand stores.

(j) Display out of doors prohibited. No person required to obtain a license under this
section shall cause or permit clothing, furniture, goods, wares or merchandise of any
kind, except for boats, trailers or vehicles, to be displayed for sale out of doors or
outside the building at the premises where such items are sold, unless that person first
obtains a permit for outdoor display and pays an outdoor permit fee of ~rl#q-efatla~s
{;6-59:09] forty dollars ($40.00) to the City of South Bend. The following requirements
must be met to obtain and retain an outdoor display permit:
Section XXI. Chapter 4, Article 4, Section 4-55 Subsection (e) of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 4-55. Charitable solicitations.

Section XXI I. Chapter 4, Article 4, Section 4-60 Subsection (g) of the South
Bend Municipal Code shall be, and hereby is, amended to read as follows:

(g) License fees.
(1) The license fee for a transient merchant shall be
{tGJ69:9~) one hundred thirty-five dollars ($135.00) for a continuous period of not
more than fifty-nine (59) days of operation at the location approved by the Board
of Public Works. Operation at another location within the City during the fifty-nine
(59) day period shall require the issuance of a separate license.
(2) Transient merchants obtaining a license for proposed business operations
during the months of November and/or December, which sell only live or natural
Christmas trees or natural wreaths, shall pay a license fee of

Respectfully report that they have examined the matter and that in their opinion, this bill is being
recommended to the full Council with a favorable recommendation, as amended. Section 4-18
Annual Licensing Report and Review of License Fees. a. On or before November ls` of each

Attached please find a proposed ordinance amending several sections of the South Bend
Municipal Code, governing the fees charged for business licenses. This proposed
ordinance was drafted to comply with Section 4-18 of the South Bend Municipal Code,
which requires the Common Council to review licensing fees annually, and requires that
such fees be reasonably related to the City's costs of regulating businesses.
