Approved and signed by me City Clerk Boma Mayor RESOLUTION NO. 2.`1 �1 -1 1 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 2442 JACLYN COURT TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A THREE (3) YEAR REAL PROPERTY TAX ABATEMENT FOR JTG DEVELOPMENT INC. WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 2442 Jaclyn Court, South Bend, Indiana, and which is more particularly described as follows: A PARCEL OF LAND LOCATED IN THE WEST '/2 OF THE NORTHWEST 1/4 OF SECTION 22, TOWNSHIP 37 NORTH, RANGE 2 EAST, CITY OF SOUTH BEND, PORTAGE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT A PK NAIL MARKING THE NORTHWEST CORNER OF SAID SECTION 22; THENCE NORTH 89 °27'04" EAST, ALONG THE NORTH LINE OF SECTION 22, A DISTANCE OF 60.00 FEET; THENCE SOUTH 00 022'57" EAST, A DISTANCE OF 40.00 FEET TO A CAPPED 5/8" IRON REBAR ON THE EAST LINE OF NEW ENERGY DRIVE (FORMERLY KNOWN AS MAPLE ROAD); THENCE NORTH 89 027'04" EAST, ALONG A LINE 40.00 FEET SOUTH OF AND PARALLEL TO THE NORTH LINE OF SAID SECTION 22, A DISTANCE OF 1247.65 FEET; THENCE SOUTH 00 °11'31" EAST, A DISTANCE OF 366.27 FEET TO THE "POINT OF BEGINNING" OF SAID PARCEL OF LAND HEREIN DESCRIBED; THENCE SOUTH 00 °11'31" EAST, A DISTANCE OF 278.88 FEET; THENCE SOUTH 89 027'02" WEST, A DISTANCE OF 337.65 FEET; THENCE ALONG A CURVE, CONCAVE WESTERLY, WHOSE ELEMENTS ARE: CENTRAL ANGLE OF 34 022'37 ", RADIUS OF 330.00 FEET, ARC LENGTH OF 198.00 FEET AND A CHORD THAT BEARS NORTH 16 059'47" EAST, 195.04 FEET; THENCE NORTH 00 °11'31" WEST, A DISTANCE OF 92.91 FEET; THENCE NORTH 89 °27'02" EAST, A DISTANCE OF 280.01 FEET TO THE "POINT OF BEGINNING ". CONTAINING 1.871 ACRES, MORE OR LESS. and which has Key Number 18- 1013 - 0325.13, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of three (3) years, and further determines that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1- 12 et sea. SECTION III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approved by the Mayor. (Ideal Interiors Inc.) Dear Council Member Kelly: ANN E. KOLATA DEPUTY EXECUTIVE DIRECTOR PHONE 219 /235 -9371 Fax 219/235 -9021 TDD 219/ 235 -5567 Please find attached the Department of Community & Economic Development's report on a real property tax abatement petition for JTG Development Inc. to be located at 2442 Jaclyn Court, South Bend. Also attached is a copy of the petition, Statement of Benefits form and supporting information. The report contains the Department's findings relativeto the above petition. JTG DevelopmentInc. proposes the construction of a 14,000 sq ft office /warehouse split block or brick and metal building. This building will be the new site for Ideal Interiors Inc. which is currently located on 310 West Ewing. The petitioner states development of this land will keep it from remaining idle, increase tax base, raise area property values and allow surrounding neighborhoods the ability to take advantage of the sewer system being installed. The estimated project cost is $565,000. The project does not meets the qualifications for three years of real property tax abatement and a representative from JTG Development Inc. will be available to meet with the Committee on Monday, July 12, 1999.
