AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, IlVDIANA, AMENDING SECTIONS 17-46 AND 17-47
AND ADDING A NEW SECTION TO THE SOUTH BEND MUNICIPAL CODE,
SECTION 17-46.4 REGARDING NONRECURRING CHARGES FOR
CUSTOMERS OF THE SOUTH BEND WATER WORKS
STATEMENT OF PURPOSE AND INTENT
The South Bend Water Works imposes fees and chazges for services such as installation of
taps, surface initiation, and reconnection of utility services. It is anticipated that such fees and
charges will be incurred only on an isolated basis and aze referred to as nonrecurring charges.
The South Bend Water Works has not increased these fees and chazges in some yeazs, and
therefore, these fees and chazges aze well below the cost of providing the service. The increased
fees and charges provided in this ordinance will compensate the South Bend Water Works for the
costs incurred in providing these services.
NOW, THEREFORE, BE TT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND AS FOLLOWS:
Section I. Sec. 17-46. Collection or Deferred Payment Charge.
All bills for water services, not paid within five (5) days from the due date thereof, as
stated in such bills, shall be subject to a collection or deferred payment chazge of six (6) percent
of the current monthly bill. All bills for water services which are turned over to a collection
agency shall be subject to a collection charge equal to twenty (20) percent of the unpaid bill.
Section II. Sec. 17-46.4. Suburban Hydrant Rates.
Customers with water service outside the Citv limits will incur hydrant fees as follows:

Section III. Sec.17-47. Nonrecurring Charges.
(a) Deposits: Security deposits, payable upon service initiation and refundable upon
service termination, shall be no more than one-sixth (1/6) of the estimated annual bill for each
meter size. Governmental entities shall be exempt from deposits.
(b) Tap Charges: The charge for installation of a one-inch tap shall be 6nc~nndre~ct
- Three Hundred Seventy Dollars ($370.00), which shall include the
installed tapping valve and the material for the curb valve and box, but shall not include any
service line. Charges for taps larger than one-inch shall be at cost.
(c) Other Nonrecurring Charges:

Section IV. If any one or more of the provisions of this ordinance shall for any reason be
held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, ar
unenforceability shall not affect any other provision hereof, and this ordinance shall be construed as
if such invalid, illegal, or unenforceable provision was not contained therein.
Section V. This ordinance shall be in full force and effect from and after its passage by the
Common Council, approval of the Mayor, and approval by the Indiana Utility Regulatory
Commission.

Council, approval of the Mayor, and approval by the Indiana Utility Regulatory Commission.
