JOSEPH COUNTY TREASURER UNDER THE CITY'S BLANKET PERFORMANCE BOND STATEMENT OF PURPOSE AND INTENT The current version of Chapter 2, Article 8, Section 2-116 of the South Bend Municipal Code sets fixed bond amounts for specifically designated City officials. It also provides for a blanket bond of one million dollars ($1,000,000.00) to cover all other employees. The Indiana Code at I.C. 5-4-1-18 permits a City to obtain a single faithful performance blanket bond covering all its officials and employees, including those whom the Ordinance now identifies with individual official bonds amounts. Furthermore, the South Bend Municipal Code presently does not expressly include the St. Joseph County Treasurer as one of the persons included within the City of South Bend's blanket performance bond. Although the St. Joseph County Treasurer is not a City employee, he/she frequently acts on behalf of the City of South Bend in the performance of his/her duties as County Treasurer. Indiana Code Section 5-4-1-18 authorizes a City's blanket bond to include persons acting on behalf of the municipality including a treasurer. This amendment, therefore, provides that City officials required by state law to be bonded will be covered under the City's blanket performance bond which shall also expressly include the St. Joseph County Treasurer for any act that he/she performs "on behalf of" the City of South Bend. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AS FOLLOWS SECTION I. Chapter 2, Article 8, Section 2-116 of the South Bend Municipal Code shall be and hereby is amended to read as follows: ARTICLE 8. CITY OFFICERS AND EMPLOYEES Sec. 2-116. Official bonds. (a) --- .... .... All City officials specifically includin tg he City Controller, the Director of City Finance, the Director of Budgeting and Financial Reporting, the City Clerk, any Barrett Law Custodian and the Superintendent of Parks, together with all City employees and Commission members as well as those persons acting on behalf of the City of South Bend including the St. Joseph County Treasurer when acting in the City's behalf, shall be subiect to a blanket bond in the sum of one million dollars ($1.000.000.001 which the Citv shall obtain to cover the faithful performance of said~ersons' duties on behalf of the City. fib) of tlzc£~tp. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and publication as required by law. The purpose of this Ordinance is to provide that City officials whom state law requires to be bonded will be covered under the City's blanket performance bond which shall also expressly include the St. Joseph County Treasurer for any act that he/she performs "on behalf of the City of South Bend.
