A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA IN PENN TOWNSHIP (VOCO, INC., ANNEXATION) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an ordinance and a petition by more than 51 % of the property owners which proposes the annexation ofthe real estate located in Penn Township, St. Joseph County, Indiana, more particularly described in Section I of this Resolution, which Ordinance also proposes a change in zoning from "R" Residential, to "C" Commercial, "A" Height and area, effective upon annexation; and WHEREAS, the territory proposed to be annexed encompasses approximately 14 acres of vacant, undeveloped land having general boundaries on the northeast corner of Ironwood and Ireland Roads, which is approximately 76% contiguous to the current City limits. The development of the territory proposed to be annexed will require a basic level of municipal public services, including police and fire protection, street and road maintenance, sewage collection, solid waste and yard pickup as well as recycling services, and services of a capital improvement nature, including construction of streets and roads, a sewer collection system, a water distribution system, and a street lighting system; and WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including street and road maintenance, police and fire protection, and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including a sewer collection system, a water distribution system, and a street lighting system; (2) the method (s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density; (5) that the services of a capital improvement nature will be provided to the annexed area within four (4) years after the effective date of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, the Board of Public Safety of the City of South Bend, and the Board of Water Works Commissioners of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the real property located in Penn Township, St. Joseph County, Indiana, described more particularly as follows, be annexed to the City of South Bend: That part of the Northwest quarter of Section 29, Township 37 North, Range 3 East, Penn Township, St. Joseph County, Indiana which is described as: Beginning at a point on the existing municipal corporate limit line which is N. 89°- 49'-19" E., 165.00 ft. more or less from a point on the West line of said Section 29, which point is S. OOo- 00' -00" W., 1969.76 ft. from the Northwest corner of said Section 29; thence N. 890- 49' -19" E. along said corporate limit line, 827.88 ft. to the West line of a parcel of ground owned by Edward Rose of Indiana and known as tax Key No. 26 -1034- 0578.01 in the records of the Auditor of St. Joseph County, Indiana; thence S. OOo- 05' -50" E. along said West line and its southerly extension, 678.87 ft. more or less to the South right -of -way line of Ireland Road; thence S. 89°- 57-24" W. along said South line, 652.57 ft. more or less to the existing corporate line of the City of South Bend; thence along said corporate line, N. OOo- 08' -23" E., 70.00 ft. more or less to the North line of Ireland Road; thence S. 89o- 57' -24" W., 300.96 ft. more or less along said North line of Ireland Road and its westerly extension and said corporate line of the City of South Bend to a point of intersection with the East line of Ironwood Road extended South; thence continuing along said corporate line and the East line of Ironwood Road and its southerly extension, N. OOo - 00' -00" E., 325.00 ft. more or less; thence continuing along said corporate line for the next two courses, N. 900- 00' -00" E., 125.00 ft. more or less and N. OOo-00' -00" E., 300 ft. more or less to the point of beginning. Section II. It shall be and hereby is now declared and established that it is the policy of the City of South Bend, to famish services to said territory of a non - capital nature, such as street and road maintenance, police and fire protection, street sweeping, flushing, and snow removal, sewage collection, solid waste and yard pick -up as well as recycling services, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City regardless of similar topography, patterns of land use, or population density; and to furnish to said territory services of a capital improvement nature, such as a sewer collection system (existing), a water distribution system (existing water main), road construction (to be done and paid for by the developer), and a street lighting system (to be done and paid for by the developer), within four (4) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. The South Bend Common Council for the City of South Bend shall and does hereby now establish and adopt the fiscal plan described in Exhibit "A ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed. Section IV. This Resolution shall be in full force and effect from and of its date of adoption by the Common Council and approval by the Mayor. Annexation Area 3 SECTION I. INTRODUCTION A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in Perm Township, St. Joseph County (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department 'Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is located at the northeast corner of Ironwood and Ireland Roads. See Map 1. B. Legal Description The Annexation Area is part of the Northwest Quarter of Section 29, Township 37 North, Range 3 East, Perm Township, St. Joseph County, Indiana. For a complete legal description see Table 1. C. Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous Non - Contiguous Total (approx.) 2,728.71 feet 861.92 feet 3,590.63 feet 76% 24% 100.00% VOCO, Inc. Annexation Area 4 D. Size of Annexation Area The Annexation Area is 13.37 acres in area. E. Buildings and Land Use The site is vacant. F. Zoning & Subdivisions The site is zoned "R" Residential in unincorporated St. Joseph County. The Area is proposed to be zoned "C" Commercial upon annexation. There is no recorded subdivision as of the date of the preparation of this fiscal plan. G. Population There is no resident population within the Annexation Area. H. Tax Rate The tax rates used are those of 1999 payable in 2000. The Township Rate will decrease by $.4478 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund, Fire Debt Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $7.7255 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $7.2777 per $100.00 of assessed valuation. Table 2 shows representative tax rate information as published by the St. Joseph County Auditor. I. Municipal Legislative District The Annexation Area will be in the 5th District. WCO, Inc. Annexation Area j K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The Penn Township Trustee has been notified of this annexation. SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - An existing 15 -inch sanitary sewer is located on the north side of Ireland Road. There is a 30 -inch sewer in Ironwood Road, but it is not practical to use it. Water - There is an existing 12 -inch water main on the south side of Ireland Road which could provide service. There is sufficient flow and pressure, and therefor adequate capacity. Drainage - Clyde Creek runs through the Annexation Area. It may be used to dispose of storm water in accordance with regulation by the Indiana Department of Natural Resources and Environmental Management, as well as the U.S. Corps of Engineers. Public .Streets - No new public streets are proposed. The Street Department currently performs street sweeping, flushing, snow removal and street maintenance on Ironwood and Ireland Roads. No additional roadway mileage will be increased with this annexation. Street Lighting - Some street lighting will be needed on Ireland Road. The capital cost is estimated at less than $2,000. Annual operating, cost will be less than 51,000. The developer within the Annexation Area will be required to pay for the full capital cost associated with the installation of the street lights. The City- will be responsible for the annual operating cost. Waivers - No waivers of annexation are in effect. Revenue to the Water Works and the Division of Environmental Services will be sufficient to provide operation and maintenance of the water distribution facilities, the sewage collection facilities, solid waste and yard waste pickup, as well as recycling services. When fully developed, this annexation area is not expected to require major capital outlays for public works vehicles or equipment. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -1 I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. hic. Annexalion Area B. Police Department The Annexation Area will be added to Beat 15. The 1999 Operating Budget for the Department was $19,295,757. This covered an area of approximately 39 square miles, resulting in a cost per square mile of approximately $494,763. Police patrols, traffic enforcement and emergency responses will be part of the services the City will offer to the area. Police services and response time in this area can be expected to be comparable and consistent with that as in other parts of the City. The Police Department will respond to calls for service upon the reprogramming of the 911 Emergency Response System. This may occur approximately one month from the effective date of the Annexation. Full and dedicated police response will be in place within one year of the effective date of the Annexation. C. Fire Department The Annexation Area will be serviced primarily by Station #10, located at 5303 York Road approximately one (1) mile away. The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. The Fire Department will respond to calls for service upon the reprogranuning of the 911 Emergency Response System. This may occur approximately one month from the effective date of the Annexation. Full and dedicated fire response will be in place within one year of the effective date of the Annexation. The 1999 Operating Budget for the Department was $13,633,896. This covered an area of approximately 39 square miles, resulting in a cost per square mile of approximately $349,587. D. Code Enforcement The Annexation Area will be added to Territory 5. The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Full and dedicated response will be in place within one year of the effective date of the Annexation. The 1999 Operating Budget for the Department was $1.348,104. This covered an area of approximately 39 square miles, resulting in a cost per square mile of approximately $34,567. Inc. Annexation Area E. Environmental Services 7 Solid waste service is financed by a user fee and will be offered as needed. Current rates are $8.00, $10.50, $13.00, and $15.00 per month for one, two, three, and four -unit dwellings respectively. There is a discount for senior citizens. Businesses desiring to use the City's sanitation service may do so at their request. The current rate is $10.00 per month. F. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as Animal Control, Weights and Measures, Junk Vehicle, Unsafe Building, Legal Department, Youth Services Bureau, etc. The 1999 Operating Budget for the balance of these services was $11,351,193. This provided services over an area of approximately 39 square miles, resulting in a cost per square mile of approximately $291,056. These services are available upon the effective date of the Annexation. Full and dedicated response will be in place within one year of the effective date of the Annexation. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county -wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South Bend Building Department are some of the county -wide agencies that will continue to provide the same type and level of services to the Annexation Area. County -wide services will continue to be supported by the County and Township tax rates that will remain in effect. SECTION IV. FISCAL IMPACT I ) Essential city services and facilities are or can be made available to the residents of the Annexation Area. 2) The city is financially able to support city services to the territory sought to be annexed. 3) Certain improvements will be made by the petitioner and /or owner. Improvements must be made according the development standards of the City of South Bend. All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. Property tax revenue estimates are based on 1999 payable 2000 tax rates, taxes paid in previous years by a comparable development, estimates of units built, and no tax abatements or adjustments.
