AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN DREMIBG
UNITS OMD BY TEE MD1ICIPAL.CITY OF SOUTH, BEND,.IPDIANA.
MfflREASp on the 6th day of Mmy, 1946, the Federal Public Housing. Authority$
as Agency of the Government of the.united.States of.Amerioa., cemveyed to the
Municipal City of South Bend Indiana, full right,.title.and intsrest.ia and to
one hundred tbirtywfour (134 wits of. movable dwelling aceomodations ;.and
WHEREAS, the aforesaid dwelling aocomodations were. placed on land owned
by the Bendix. Products. Corporation, the lease to which has since expired and
cannot be renewed; and
WHRREAS& the Canon Council of the City of South Bend, Indians, has by
Resolution adopted.on July 26, IW O provided that any unit of said dwelling
a000nmodations which became vacant thereafter shall. remain vacant and not
subject to further rental; and
TWREAS& 106 units are now vacant and, the remaining. ones. are expected
to be vacated in the near future; and
WHEREAS, it is to the best interests of the City of South Bend that said
vacated units be sold and that the units still 000upled_be sold as -soon as they
are vacatede
NOW THEREFORE BE IT ORDAINED by the Comma Council of the City of South
Bend,, Indiana:
Section l• That the Judge of the Circuit Court of St. Joseph_Cenaty,
Indiema, be requested to appoint three disinterested fresholders.of the City
of South Bend, Indiana, to appraise the.buildings, oommoniy. called %wmble
dwelling. aoconmodationse, and located - on Late mambered ninety -one. (91) to one
hundred siaty« one (161),both inclusive.1n.Westehester Second Unit,,& subdivision
within the City of -South Bend, St• Joseph County, Indiana, which said buildings
are new owned by the Manieipal City.of South Bend•.
Section 70 That the City of. South Bend sell, assigns transfer, convey
and not over by proper instruasnt, In writing, to any purchaser or purchasers
thereof the buildings hersimsbove described for not less than the full appraised
value thereefi as reported by the appraisers appointed by the Judge of the
Circuit. Court of St• Joseph. County,.Indiana,.and subject to such other terns
and conditions as,the:Board of Public - Worts. and Safety, of_the_City of South
Bend shall detersins, and the Mayor is hereby ordered# directed and authorised
to execute and deliver.to such purchaser or purehasers.thersof# upon.t1w payment
of the appraised value thereof# &.-good and sufficient instrumen_of.transfer
of right# title and interest# and this shall be sufficient authority to hia in
said preeisese
Section 3e That this ordinance shall be in fall force and.effeet from
and after its passage by the _Comnon_Council and its approval by the Heyor•
