RESOLUTION NO. 7 1 5 1
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA EXPRESSING ITS INTEREST IN SELLING THE PROPERTY LOCATED
ADJACENT TO THE ORGANIC RESOURCES PLANT
WHEREAS, the City of South Bend, Indiana desires to sell real property which forms part
of the Organic Resources facility and is located along the south side of Old Cleveland Road between
the Organic Resources facility and the South Bend Regional Airport with a real property address of
22740 West Cleveland Road in the City of South Bend; and
WHEREAS, this parcel is a 15.18 acre tract and three acres are deemed buildable upon
survey and environmental study while 12 acres are nonbuildable upon survey and environmental
study; and
WHEREAS, pursuant to I.C. 36- 1 -11 -1 et seq., the City has had two appraisals of the
property performed and in accordance with I.C. 5 -3 -1 has conducted a hearing to receive bids on the
property; and
WHEREAS, the City received one bid equal to at least 90% of the appraised value of the land
and the City has accepted the bid as being sufficient; and
WHEREAS, the Mayor of the City of South Bend has given his approval for the sale of the
land consistent with I.C. 36- 1- 11- 3(b)(1).
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana as follows:
Section I. The Director of Public Works and the Board of Public Works for the City of South
Bend are hereby authorized to enter into a contract for the sale of the land referred to above.
Section II. Copies of the appraisals are being made available for public inspection by
providing copies of the same to the South Bend Common Council.
Section III. This Resolution shall be in full force and effect from and after its adoption by
the Common Council and approval by the Mayor.

Re: Sale of Land Adjacent to Organic Resources Facility
Dear President Pfeifer:
Attached for filing with the South Bend Common Council, please find a Resolution
authorizing the City of South Bend through its Board of Public Works to sell real estate located
on old Cleveland Road and presently a part of the Organic Resources facility. Please be advised
that the City of South Bend has already received a bid in excess of 90% of the appraised value of
the property which is in excess of what Indiana law requires. The City of South Bend's Board of
Public Works has indicated its approval in entering into the sales agreement. Further, the Mayor
of the City of South Bend has also expressed his intent and desire to enter into the sale of this
property. Your favorable consideration with respect to this resolution is respectfully requested.
