ORDINANCE N0. 3708
AN ORDINANCE AUTHORIZING THE SALE OF
LOT NUMBERED THIRTY -FIVE (35) AS SHOWN
ON THE RECORDED PLAT OF NORTH SHORE
TERRACE AN ADDITION TO THE.CITY OF
SOUTH BEND, ST. JOSEPH COUNTY, INDIANA,
OWNED BY THE MUNICIPAL CITY. OF SOUTH
BEND.
WHEREAS, the City of South Bend is the owner of Lot Number
ed Thirty -five (35) in North Shore Terrace, an Addition to the Cit;
of South Bend, St. Joseph County, Indiana, by virtue of a warranty
deed dated September 19, 191+1, in which Taylor and Johnson, Inc.,
is the grantor, and
WHEREAS, the above described real estate is conducive to
no public use by the municipal City of South Bend, Indiana, and
in the best interest of said City should be sold;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of South Bend, Indiana:._
Section 1. That the Judge of the Circuit Court of St.
Joseph County, Indiana be requested to appoint three disinterested
freeholders of the City of South Bend, Indiana to appraise Lot
Numbered Thirty -five (35) in North Shore Terrace, an Addition to
the City of South Bend, St. Joseph county, Indiana, which real
estate is now owned by the municipal City of South Bend.
Section 2. That the City of South Bend sell, assign,
transfer, convey and set over by proper instrument,in writing,
to any purchaser thereof the real estate hereinabove described
for not less than the full appraised value thereof, as reported
by the appraisers appointed by the Judge of the Circuit Court
of St. Joseph County, Indiana; and the Mayor is hereby ordered,
directed and authorized to execute and deliver to such purchaser
or purchasers thereof, upon the payment of the appraised value
thereof a good and sufficient deed, and this shall be sufficient
authority to him in said premises.
Section 3. That this ordinance shall be in full force and
effect from and after its passage by the Common Council and its
approval by the Mayor.
