Be it ordained by the Common Council of the City of South Bend, Indiana: Section 1. That Ordinance No. $T02j adopted by the Common Council of the City of South Bend, Indiana, on the 11th day of December, 1950, and commonly known as the Zoning Ordinance, be and the same is hereby amended as follows, to -wit: That the property situate in the City of South Bend, Indiana, and described as follows, to -wit: Lots numbered 16, 17 and 18 in J. G. Bartlett's First Addition to the Town, now City of South Bend, Indiana; Lots numbered 37, 36, 35 and 39 in J. G. Bartlett's Second Addition to the Town, now City of South Bend, Indiana; and that part of Bank Out Lot No. 124 of the Second Plat of Out Lots to the Town, now City of South Bend, Indiana, platted by the State Bank of Indiana, adjacent to Lot No. 39 as shown on the recorded plat of J. G. Bartlett's Second Addition to the Town, now City of South Bend, which part of said Bank Out Lot No. 124 is also described as beginning at the Northeast corner of said Lot No. 39 in J. G. Bartlett's Second Addition to the Town, now City of South Bend, Indiana; thence North on the West line of Michigan Street, 50 feet, more or less, to the South line of Park Lane in said city; thence West on the South line of Park Lane, 165 feet to the East line of a public alley; thence South on the East line of said alley to the N orthwest corner of said Lot No. 39 in said Bartlett's Second Addition; thence east on the North line of said Lot No. 39 of said Bartlett's Second Addition to the place of beginning. Said tract is further described as commencing at the Northwest corner of the intersection of Bartlett Street and Michigan Street in the City of South Bend, Indiana, thence running North along the West line of said Michigan Street to the Southwest corner of Park Lane and Michigan Street, thence West along the South line of Park Lane, a distance of 165 feet to the East line of a public alley; thence South along the East line of said public alley to the North line of Bartlett Street; thence East along said North line of Bartlett Street, a distance of 165 feet to the place of beginning. Ettl appeared before the Board of Park Commissioners February 6, 1953 with reference to a petition before the City Plan Commiss- ion for a change in zoning of the west -side of North Michivn Street between Bartlett Street and Park Lane from Residential"to "C- Commercial ". After a study of all of the uses allowed in a "C" Commer- cial District the Board is of the opinion that there are several classified uses permitted in this classification which might be in conflict with the public welfare and safety of persons using Leeper Park which is directly across both Michigan Street and Park Lane from the property covered in the petition. However, it was the opinion of the Board of Park Commiss- ioners that they do not wish to pass judgement until those persons residing in the neighborhood and directly affected by the change in classification shall make their decision. The Board of Park Commissioners respectfully suggest that a "C -1" Commercial District classification with a "C" Height and Area limitation would be more suitable if a change is made to a Commercial District. It is their opinion that the type of laundry that Mr. Conboy proposes to operate would not be objectionable in a C -1 Commercial District and that the zoning ordinance could be amended to include his type of commercial use in that classification.
