AN ORDINANCE TO AMEND SECTION 3, SECTION 4 -A,
OF ORDINANCE NO. 3702, ADOPTED BY THE COMMON
COUNCIL ON JUNE 13, 1949, COMMONLY KNOIT;d AS
THE ZONING ORDINANCE, AND ADDING THERETO
SECTION 17 -A.
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. That Section 3, "A" Residence District
of Ordinance No. 3702, adopted by the Common Council of the
City of South Bend, Indiana, on June 13, 1949, and commonly
known as the Zoning Ordinance, be, and the same hereby is
amended to read as follows:
Section 3.- "A" Residence District. In the "A"
Residence District buildings or premises may be used, and
buildings may be erected or structurally altered, for the
following uses only:
(1) One family dwellings
(2) Churches
(3) Libraries
(4) Farming and truck gardening
(7) Uses customarily incident to any of the above
uses and not involving the conduct of a
business.
(6) Home occupation, office of physician, surgeon,
dentist, when located in the dwelling place
of such person, provided no nameplate exceedin
one square foot in area is used.
(7) Accessory buildings including one private
garage whether attached to the house or as
a separate building.
(8) Signs, not exceeding 8 square feet in area,
appertaining to the lease, or sale of a
building or premises.
(9) Uses which are uncertain in their classificati
under foregoing headings shall be reviewed by
the board of Zoning Appeals and the inter-
pretation of said Board shall govern.
Section 2. That Section 4 -A, "C -1'' Commercial District
of said Ordinance No. 3702, be, and the same is hereby amended to

Section Z -A. - "C -1" Commercial District. In the
"C -1" Commercial District buildings or premises may be used
and buildings may be erected or structurally altered, for the

(1) Any use permitted in the "B" use district exce
one and two family houses.
(2) Antique and gift shops
(3) Barber Shop
(4) Beauty Shop
(5) Book and stationary shop
(6) Clothing and apparel stores
(7) Confectionery store
(8) Drug store
(9) Florist shop
(10) Grocery and food stores
( 11) Lunch room
(12) Office Building
(13) Buildings that are accessory to uses permitted
in this district.
(14) Uses which are uncertain in their classificati
under the foregoing headings shall be reviewed
by the Board of 'Zoning Appeals and the inter-
pretation of said Board shall govern.
Sect -ion 3. That there be, and hereby is added to said
Ordinance No. 3702, a new Section, to be 'known as Section 1117 -A"
and the same is to read as follows:
Section "17 -A" The provisions in this Ordinance
regulating the use of lands, buildings, and occupancies shall
not apply to lands, buildings and occupancies which are
pucl_cly owned and involve publ_c health, welfare or safei;y.
Section 4. This Ordinance shall be in full force and
affect from and after its passage, approval ay the Pdayor, and le
publication.
