A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF
SOUTH BEND, INDIANA, COMMONLY KNOWN AS
131 South Taylor Street
TO BE AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A THREE (3) YEAR REAL
PROPERTY TAX ABATEMENT FOR
AAK PROPERTIES, LLC
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Economic Revitalization
Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as 131
South Taylor Street, South Bend, Indiana, and which is more particularly described as follows:
Parcel II: Lots Numbered One (1) to Twelve (12) as shown on the recorded Plat
of Jefferson Place Subdivision in the City of South Bend.
Parcel III: A lot or parcel of land bounded by a line running as follows, viz:
Beginning at the Southeast corner of Bank Out Lot Numbered 46; thence North
on the West line of Taylor Street 103.6 feet; thence West 1303/4 feet; thence
curve to left a distance of 76.3 feet on the perimeter of a circle described with a
radius of 54.2 feet; thence South 9° West 14.68 feet; thence South 44 feet to a
point distant East 31 feet from the Northwest comer of the East Half of Bank
Out Lot Numbered 46; thence East 191.15 feet to the place of beginning, all as
shown on the First Plat of Out Lots of the Town, now City of South Bend,
platted by the State Bank of Indiana.
Parcel IV: Beginning at a point that is 3.27 feet North and 130.75 feet West of
the Northeast corner of Bank Out Lot Numbered 46 of the First Plat of Out Lots
of the Town, now City, of South Bend, platted by the State Bank of Indiana;
thence West 164.20 feet; thence South 26.25 feet; thence West 5.84 feet; thence
South 173.75 feet; thence East 11.30 feet; thence South 49.50 feet; thence West
26.30 feet; thence South on a line parallel with the East line of Scott Street 56.06
feet to the North line of an alley in Weaver's Subdivision, being 2.56 feet South
of the North line of Lot Numbered Forty-nine (49) of said Bank Out Lots; thence
East along the North line of said alley 109.30 feet; thence North 32.35 feet;
thence North 11'25'00" West 71.50 feet to the Southwest corner of the East Half
of Bank Out Lot Numbered Forty-seven (47); thence North 99.00 feet to the
Northwest corner of the East Half of Bank Out Lot Numbered 47; thence East
31 feet on the North line of said Bank Out Lot Numbered 47; thence North 44.00
feet; thence North 09 °00'00" East, 14.68 feet; thence 76.30 feet along an arc of
a curve concave to the Southeast, with a radius of 54.20 feet, to the point of
beginning.
Excepting therefrom the following three tracts of land:
Tract 1: The East 10.00 feet of the West 152.00 feet of Bank Out Lot Numbered
47 and the East 10.0 feet of the South 24.75 feet of the West 152.00 feet of Bank
Out Lot Numbered 46 in the State Bank of Indiana's First addition of Outlots in
the Town, now City of South Bend.
Tract II: All that part of the West 152.00 feet of the South Half (49.50 feet) of
Bank Out Lot 48 in the State Bank of Indiana's First Addition of Out Lots
presently owned by the Mastic Corporation, and that part of the North 2.56 feet
of Lot 1 in Weaver's Subdivision lying West of a line 152.00 feet East of the
East line of Scott Street in the City of South Bend.
Tract III: Part of Out Lot Numbered Forty -eight (48) in the State Bank of
Indiana's First Addition of Outlots in the Town, now City of South Bend, and
part ofLotNumbered One (1) Weaver's Subdivision, St. Joseph County, Indiana
and being described as follows: Beginning at an iron pin at the Northwest corner
of the East Half of said Outlot 48; thence East along the North line of said Outlot
48 a distance of 70.00 feet to an iron pipe; thence South along a line making an
angle of 90 °05' with the last described course, 55.25 feet to an iron pipe; thence
East on a deflection to the left of 89 °39 from the last described course 151.89
feet to an iron pipe; thence South along the West line of Taylor Street, 44.06 feet
to an iron pin at the Northeast corner of Lot 1 in Weaver's Subdivision; thence
West along the South line of said Lot 48 being also the North line of said Lot 1,
a distance of 115.50 feet to a cross in the concrete; thence South a distance of
2.56 feet to a dril hole; thence West along the North line of the existing alley
being parallel to and 2.56 feet South of the South line of Outlot 48 a distance of
176.75 feet to an iron pipe; thence North parallel to and 152.00 feet East of the
East line of Scott Street, 101.56 feet to a drill hole on the North line of said
Outlot 48; thence East along said North line 70.39 feet to the point of beginning.
and which has Key Number 18- 3047 -1801 as an Economic Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and

WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution designating
the area described herein as an Economic Revitalization Area for the purposes of tax
abatement. Such designation is for Real property tax abatement only and is limited to two (2)
calendar years from the date of adoption of the Declaratory Resolution by the Common
Council.
SECTION II. The Common Council hereby determines that the property owner is qualified for
and is granted Real property tax deduction for a period of three (3) years, and further
determines that the petition complies with Chapter 2, Article 6, of the Municipal Code of the
City of South Bend and Indiana Code 6- 1.1 -12 et se g.
SECTION lII. This Resolution shall be in full force and effect from and after its adoption by
the Common Council and approved by the Mayor.
