Cove Replat Property Transfer with Parks Department
On October 16, 2014, the Commission approved a professional services agreement with
Jones Petrie Rafinski, for the replatting and rezoning of the Cove block properties under
ownership of the Parks Department and Commission.
As part of this process, and to maximize development parcels under Commission
ownership and those used by Parks for the Cove, certain sections and slivers of land
currently under one entity's ownership need transferred to the other entity.
The attached replat, being submitted the first week of January, lays out the resulting six
new lots.
Resolution No. 3261 approves the transfer of property from and to the Parks Dept. as a
result of the replat.
Staff requests approval of Resolution No. 3261.

RESOLUTION NO. 3261
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING TRANSFERS OF REAL PROPERTY TO AND FROM
THE SOUTH BEND PARKS AND RECREATION DEPARTMENT
WHEREAS, the South Bend Redevelopment Commission (the "Commission"), the
governing body of the City of South Bend, Indiana, Department of Redevelopment (the
"Department"), which exists and operates under the provisions of I.C. 36-7-14 (the "Act"), holds
certain real property situated in the City of South Bend, Indiana; and
WHEREAS, the City of South Bend, Indiana, Parks and Recreation Department, by and
through its Board of Park Commissioners (the"Board"), holds certain real property situated in the
City of South Bend, Indiana; and
WHEREAS, pursuant to I.C. 36-1-11-8, the Commission and the Board may transfer or
exchange property with one another upon terms and conditions agreed upon by the entities as
evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the City, acting by and through the Board, has over time accepted certain
parcels of real estate within the Coveleski Park block in the City's downtown area, as depicted in
the proposed plat attached hereto as Exhibit A; and
WHEREAS, the Commission has agreed to replat the Coveleski Park block, and effect
certain conveyances of real property to and from the Board to facilitate the redevelopment efforts
of the Coveleski Park area; and
WHEREAS,the Commission desires to authorize the staff of the Department to cause the
preparation of the necessary quit claim deeds effecting these transfers, and to accept and present
for recording said quit claim deeds, upon execution by the Commission or the Board, as the case
may be; and
WHEREAS, the Board is expected to adopt a corresponding resolution consistent with
I.C. 36-1-11-8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. The following transfers of real property situated in St. Joseph County, Indiana,
shall be, and hereby are, authorized and approved:
a. The Commission's interest in all land within the boundaries of Lot 1 (as more
particularly described in Exhibit A), shall be conveyed by the Commission to
the Board by quit claim deed; and
b. The Commission shall accept the conveyance of the Board's interest in all land

within the boundaries of Lot 4 (as more particularly described in Exhibit A)
by the Board to the Commission by quit claim deed.
2. The staff of the Department shall be, and hereby are, authorized to cause the
preparation,acceptance, and recordation with the St.Joseph County Recorder's Office of the quit
claim deeds necessary to effect the transfers stated above.

3. This Resolution shall be in full force and effect upon its adoption.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on December
22, 2014, at 227 West Jefferson Boulevard, Room 1308, South Bend, Indiana 46601.
