A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA. APPROVING A COMPREHENSIVE PLAN
'Q bgrM, Indiana Code § 36 -7- 4-500, et seq., entitled "500 Series- Comprehensive
Plan" sets forth the state law which empowers the Area Plan Commission of St. Joseph County to
prepare, approve and certify a Comprehensive Plan for its area of jurisdiction; and
VOIMOe, the Area Plan Commission of St. Joseph County provides planning and zoning
services for the City of South Bend, the unincorporated portions of St. Joseph County; and the
towns of Lakeville, New Carlisle, North Liberty, Osceola and Roseland; and
'j$ bit"as, since the Summer of 1998 the Area Plan Commission of St. Joseph County
and its consultant have been working on the proposed comprehensive plan; and
O &V9aO, pursuant to Indiana Code § 36 -7- 4-508, the attached Comprehensive Plan for
South Bend and St. Joseph County, Indiana, dated April 2002, was certified by the Executive
Director of the Area Plan Commission of St. Joseph County as the document which was approved
by the Commission at its public meeting held on January 29, 2002, by the adoption of Resolution
No. 140-02 and which was subsequently amended by the Commission at its public meeting held
on April 16, 2002, by the adoption of Resolution No. 141 -02; and
'Ililbt"00, the Common Council of the City of South Bend, Indiana, acknowledges that
the Comprehensive Plan would serve as a non - binding planning document to guide the entities
under the jurisdiction of the Area Plan Commission of St. Joseph County into the future, with the
City of South Bend desiring to have the plan updated and amended when necessary;
Wbitre40, by the adoption of the Comprehensive Plan, the City of South Bend envisions
such action as providing the necessary enabling legislation to establish a framework for South
Bend to move forward on its own, more specific legislation, which may include but not be limited
to the development of a City Plan, Neighborhood Plans, Zoning and Subdivision ordinances and
other rules and regulations which would address the specific planning needs for the enhancement
and betterment of residential neighborhoods and the overall economic viability of the city.

Section I. The certified Comprehensive Plan, which is marked "Exhibit A" and attached
hereto and included herein by reference, which was formally adopted by the Area Plan
Commission of St. Joseph County as the document approved by the Commission on January 29,
2002, by the adoption of Resolution No. 140 -02 and subsequently amended by the Commission
on April 16, 2002, by the adoption of Resolution No. 141 -02, is hereby adopted as a planning tool
and guide to enable the City of South Bend to move forward on more specific and detailed
legislation which would promote and enhance the overall viability and vitality of the city.
Section II. This Resolution shall be in full force and effect from and after its adoption by
the Common Council.
