A RESOLUTION RECONFIRMING THE ADOPTION OF A
DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND, INDIANA, TO BE AN
ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A
TEN (10) YEAR REAL PROPERTY TAX ABATEMENT FOR
JVH, INC.
DESIGNATING A NEW ADDRESS OF
3152 MARY COURT
WHEREAS, the Common Council of the City of South Bend, Indiana, adopted a
Declaratory Resolution, No. 3102 -02, designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, the Common Council of the City of South Bend, Indiana, adopted a
Confirmatory Resolution, No. 3104 -02, confirming the designation that certain areas within
the City be an Economic Revitalization Area for the purpose of tax abatement consideration;
and
WHEREAS, the petitioner has now moved the project site to 3152 Mary Court (as
opposed to the original address of 4833 Ameritech Drive); and
WHEREAS, the Common Council of the City of South Bend, Indiana, now wishes to
amend the Declaratory and Confirmatory Resolutions, Nos. 3102 -02 and 3104 -02 respectively,
striking the address of 4833 Ameritech Drive, wherever it appears, and replacing it with 3152
Mary Court, and which is more particularly described as follows:
Lot 4 Young's Commerce Park
Lot 5 Young's Commerce Park
Lot 6 Young's Commerce Park
and which has Key Numbers 18 -1013- 032507; 18- 1013- 032508; 18 -1013- 032509;
respectively, as an Economic Revitalization Area; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met in resolutions 3102 -02 and 3104 -02, and further determines
that the petitioner has met all such qualifications for the new address.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
South Bend, Indiana, as follows:
SECTION I. The Common Council hereby reconfirms and hereby ratifies its Declaratory and
Confirmatory Resolutions, as amended, designating the area described as 3152 Mary Court as
an Economic Revitalization Area for the purposes of tax abatement. Such designation is for
Real property tax abatement only and is limited to two (2) calendar years from the date of
adoption of the Declaratory Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is qualified
for and is granted Real property tax deduction for a period of ten (10) years, and further
determines that the petition substantially complies with Chapter 2, Article 6, of the Municipal
Code of the City of South Bend and Indiana Code 6- 1.1 -12 et sea.
SECTION III. The Common Council pursuant to Section 2 -84 of the South Bend Municipal
Code finds the ten (10) years is the appropriate and rational time period for this tax abatement
in light of the following:
The petitioner was asked by the City of South Bend to relocate his business to
accommodate the TJX Company's new warehouse distribution center.
The petitioner was most cooperative and fair in his dealings with all involved in
the TJX Company project.
The petitioner also facilitated the site clearing process by relocating equipment
on his property prior to the date at which his property was to be transferred.
The petitioner did all of this without knowing exactly how or where he would
continue operations.
SECTION IV. The Council further exercises its authority pursuant to Indiana Code 6-1.1 -
12.1-11.3(c) and waives certain compliance requirements with such waiver taking place after
public hearing. The Council further finds that each of the additional findings required pursuant
to Indiana Code 6 -1.1- 12.1 -4.5 have been met, and that JVH's property at 3152 Mary Court
is declared an Economic Revitalization Area.
SECTION V. This Resolution shall be in full force and effect from and after its adoption by
the Common Council and approved by the Mayor.

being recommended to the full Council with no recommendation due to there not being a
quorum in the committee meeting.

These companies are relocating at this time because � e City of
Trailer Service had the property at 1818 Sample purchased
South Bend for the TJX project at Sample and olive St. MTE Truck &
Trailer Service has operated in this area since 1984, and has many loyal
customers.
The VfTE companies expect to retain 32 employees and increase 3 to
S new employees in the nearfuture.
