City Clerk President of Common Council Approved and signed by me July 11 20 02 City Clerk 0 RESOLUTION NO. 3 k o� - 0-)-, A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT AN APPLICATION TO THE INDIANA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT FOR A LOAN FROM THE BROWNFIELDS CLEANUP REVOLVING LOAN FUND WHEREAS, the Mayor of the City of South Bend, Indiana, is the Chief Executive Officer of the City and is the appropriate applicant for a loan from the Indiana Department of Environmental Management (IDEM) Brownfields Cleanup Revolving Loan Fund; and WHEREAS, the purpose of the Brownfields Cleanup Revolving Loan Fund is to clean up brownfields to facilitate their sustainable reuse; and WHEREAS, the City of South Bend is interested in remediating environmental conditions at a publicly owned piece ofproperty known as Fredrickson Park in order that new development may occur on the site; and WHEREAS, the proposed remediation at Fredrickson Park meets the guidelines of the Brownfields Cleanup Revolving Loan Fund. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Mayor of the City of South Bend, Indiana, is hereby authorized to submit an application to the Indiana Department of Environmental Management for a loan from the Brownfields Cleanup Revolving Loan Fund in the amount of $1,000,000. SECTION II. That the Mayor of the City of South Bend, Indiana, shall file with the Common Council a complete copy of the Loan Application to be submitted by the Mayor to the Indiana Department of Environmental Management. SECTION III. That for every activity, project, or program to be funded under this resolution, the Mayor shall submit to the Common Council an appropriation ordinance prior to expenditure of any funds received from the Indiana Department of Environmental Management upon approval of this application. SECTION IV. That the Mayor shall be authorized to accept and affirm the loan should one be awarded. SECTION V. That the City of South Bend, Department of Community and Economic Development be designated as the agency and office administering on behalf of the City of South Bend any loan awarded under this application. SECTION VI. That this resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. HUNT EXECUTIVE DIRECTOR June 19, 2002 South Bend Common Council 4" Floor, County City Building 227 West Jefferson South Bend, IN 46601 Dear Council Members: Enclosed is a resolution authorizing the Mayor to submit an application to the Indiana Department of Environmental Management for a Brownfields Cleanup Revolving Loan in the amount of $1,000,000. If the loan is approved by IDEM, the proceeds will be used to remediate environmental concerns at Fredrickson Park so that the park can be prepared for new development. If the loan is approved, the exact terms of the loan will be negotiated with IDEM and the Indiana Development Finance Authority. The general terms of the loan program are that loans of 1 -9 years have an interest rate of 2.5% while loans of 10 -20 years have an interest rate of 3 %.
