City Clerk RESOLUTION NO. 3I 53 - 03 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN GERMAN TOWNSHIP (CLELAND HOMES INC. ANNEXATION AREA) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the annexation of real estate located in German Township, St. Joseph County, Indiana, which is described more particularly in Section I of this Resolution, and; WHEREAS, the territory proposed to be annexed encompasses approximately 28.15 acres of land containing one house and some older dilapidated farm buildings the remainder of which is vacant, unimproved land, which property is at least 12.5% contiguous to the current City limits, i.e., approximately 69% contiguous, generally located on the south side of Brick Road east of and adjacent to the Hartman & DeMaeght Subdivision in German Township, Indiana. This annexation territory is intended to be developed as a single family residential subdivision. Accordingly, the annexation territory will require a basic level of municipal public services, of a non - capital improvement nature, including police and fire protection, street and road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services of a capital improvement nature, including street and road construction, street lighting, a sanitary sewer system, a water distribution system and a storm water system; and WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, police and fire protection, and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street and road construction, street lighting, a sanitary sewer extension, a water distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density; (5) that the services of a capital improvement nature will be provided to the annexed area within four (4) years after the effective date of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public Safety of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the real property located in German Township, St. Joseph County, Indiana, described more particularly as follows, be annexed to the City of South Bend: A parcel of land being a part of the Northwest Quarter of Section 21, Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at a point on the North line of said Section 21, a distance of 80.5 feet South 89 °27'36" East of the Northwest corner of said Northwest Quarter, said beginning point being the Northeast corner of the plat of Hartman and De Maegt Subdivision as the same is recorded in the office of the Recorder of St. Joseph County, Indiana in Plat Book 27 Page `H'; thence Northerly, parallel with the West line of the Southwest Quarter of the Southwest Quarter of Section 16, Township 38 North, Range 2 East, a distance of 20 feet to the Northerly right -of -way line of Brick Road; thence South 89 °27'36" East, parallel with said North line of Section 21, a distance of 189.5 feet to the West line of the plat of Reiner's Brick Road Subdivision Minor Plat as the same is recorded in the said office of the Recorder of St. Joseph County, Indiana; thence Northerly, parallel with the West line of the Southwest Quarter of the Southwest Quarter of Section 16, a distance of 30 feet to the Southwest corner of Lot 1 in said Reiner's Subdivision; thence South 89 °27'36" East, parallel with said North line of Section 21, a distance of 100 feet to the Southeast corner of Lot 1 in said Reiner's Subdivision; thence Southerly, parallel with the West line of the Southwest Quarter of the Southwest Quarter of Section 16, Township 38 North, Range 2 East, a distance of 30 feet to the Northerly right -of -way line of Brick Road; thence South 89 °27'36" East, along said Northerly right -of -way line and parallel with said North line of said Section 21 to said right -of -way line's intersection with the Northerly projection of the West line of the plat of Harvest Pointe Subdivision, Section One, said plat recorded as instrument number 9907812 in said Recorder's office; thence South 00 °38'27" West, along said Northerly projection, a distance of20.00 feet to said North line of Section 21 and the Northwest comer of said plat of Harvest Pointe Subdivision, Section One; thence South 00 °38'27" West, along a West line of said Harvest Pointe Subdivision, a distance of 529.38 feet to a comer of Lot 19 in said subdivision; thence North 89 °29'09" West, along a North line of said Lot 19, a distance of 138.47 feet to a West line of said Harvest Pointe Subdivision, Section One; thence South 00 °36'54" West, along said West line and its Southerly projection, a distance of 490.21 feet to its intersection with a Northerly line of the South Bend City limits; thence North 89 °27'36" West, along said Northerly line of the South Bend City limits, a distance of 1102.23 feet to the Southeast corner of said plat of Hartman and De Maegt Subdivision; thence North 00 °40'41" East, along the East line of said Subdivision, a distance of 1019.85 feet to the place of beginning. Section II. It shall be and hereby is now declared and established that it is the policy of the City of South Bend, to furnish services to said territory of a non - capital nature, such as police and fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City regardless of similar topography, patterns of land use, or population density; and to furnish to said territory services of a capital improvement nature, such as street and road construction, street lighting, a sanitary sewer extension, a water distribution system, and a storm water system, within four (4) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. The Common Council for the City of South Bend shall and does hereby now establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides among other things, that virtually all capital improvements required to service the annexation area with the exception of looping the existing water main lines, will be planned, provided, and paid for by the developer subject to compliance with state and local law. Section IV. This Resolution shall be in full force and effect from and of its date of adoption by the Common Council and approval by the Mayor. Annexation Area 3 SECTION I. INTRODUCTION A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation of property in German Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance NOTE: The extant of ownership for the annexation parcel extends into the current City limits. Only that portion not within the City limits is being incorporated. A separate petition to rezone the portion within the City limits from industrial to residential will be filed and follow the established administrative procedure. SECTION II. GENERAL DATA A. Location The Annexation Area is located on the south side of Brick Road, east of and adjacent to the Hartman & DeMaegt Subdivision. See Map 1. B. Legal Description The Annexation Area is part of the Northwest Quarter of Section 21, Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana. For a complete legal description see Table 2. C. Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous Non - Contiguous Total (approx.) 2,281.51 feet 1,040.00 feet 3,321.51 feet 69% 31% 100.00% D. Size of Annexation Area The Annexation Area is 28.15 acres in area. Cleland Homes, Inc. Annexation Area 4 E. Buildings and Land Use There is one house and some older, dilapidated farm buildings in the Annexation Area. The Area is proposed to be developed into single family homes, accessed by dedicated public streets, and serviced by public sewer and water utilities in addition to City fire and police services. F. Zoning & Subdivisions The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned "A" Single Family upon incorporation. G. Population There is no population in the Annexation Area. 140 lots are proposed, resulting in an estimated population of 350 (140 x density of 2.5). H. Tax Rate The tax rates used are those of 2001 payable in 2002. The Township Rate will decrease by $.1908 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund, the Fire debt Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $2.8726 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $2.6818 per $100.00 of assessed valuation. Table 1 shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments 2001 payable 2002, St. Joseph County Auditor property tax records: Land: $3,070.00 Improvements: $7,830.00 Net: $8,900.00 Estimated net assessment at build out for the proposed development: $9,240,000 I Municipal Legislative District The Annexation Area will be in the 1st District. Cleland Homes, Inc. Annexation Area 5 K Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The German Township Trustee has been notified of this annexation. SECTION M. MUNICIPAL SERVICES A. Public Works Sewer - The public sanitary sewer network will be available. The developer of the subdivision proposed for this will be required to extend sewer service to and within the subdivision at his own expense. Revenue to Environmental Services for wastewater collection and treatment will be sufficient to cover the additional cost of sewer and plant operations. No additional expenditures will be needed to extend existing sewer main facilities. Water - There is currently a 12" water main on Brick Road that terminates west of Laurel Creek Drive (Field Point entrance). There is also an 8" main in Harvest Pointe. The two mains should be looped along Brick Road to provide service to the annexed area. The capacity will be more than adequate. No additional expenditures will be needed to extend existing water main facilities. Street Lighting - The developer will be required to provide street lighting within the subdivision. Additional revenue to the General Fund from this annexation area will be more than sufficient to pay for the street light maintenance and operations. Once installed, the maintenance and utility bill are paid by the City at a cost of $13 per light per month. Approximately 8 lights will be required, but final count is to be determined at time of Public works approval. 8 x 13 = $104.00 per month x 12 = $1,248.00 per year x 5 years = $6,240.00 Waivers of Annexation - No waivers of annexation are in effect for the Annexation Area. Streets - The developer will be required to construct a new public street to access lots proposed for development. The new streets and a portion of Brick Road along the frontage will add mileage to the roadway inventory. The new mileage will increase distributions to the City's Motor Vehicle Highway Fund and Local Road and Street Account sufficient for street maintenance, sweeping, and snow removal. Drainage Plan - The developer will also be required to plan for storm water control and to install a proper system. The Sewer Maintenance Bureau will maintain the storm water system with revenues from wastewater collection and treatment. Cleland Homes, Inc. Annexation Area 6 2000 Operating Budget for the Department $2,550,312 Reconstruction/Maintenance of Roads snow removal and leaf- pick -up: $993,058 Total $3,543,370 Miles of Roadway: @472 Cost per Mile: @$7,507 New Mileage (est.) 1.05 miles (5,570') Cost for Annexation Area per year: $7,882 When fully developed, this annexation area is not expected to require major capital outlays for public works vehicles or equipment. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, . I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. B. Police Department The noted area would be expected to be added to the already existing BEAT 22. Police patrols, traffic enforcement, and emergency responses will be part of the services the City will offer to this area. At this time it is not expected that this annexation would cause calls for service to increase significantly and it is not anticipated that it will be necessary to increase police patrols beyond the already existing beat patrol at this time. The area under consideration is not expected to cause any unusual problems. Cost for servicing this area would be expected to be absorbed by the existing budget of the Police Department, as the addition of this area would not be significant to the point of having to increase any budgetary items. Police services and response time in this area can be expected to be comparable and consistent with that as in all other areas of the City. Police coverage to this area could begin immediately upon annexation and coordination of the conversion of the 911 emergency phone system for that area. It is not anticipated that the services of this Department will be required to a great extent in the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area. 2000 Operating Budget for the Department: $19,596,124 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$414 Proposed Number of Parcels in Area: 140 Cost for Annexation Area per year: $57,960 / 3 = $19,320 C. Fire Department The Annexation Area will be serviced primarily by Station #11, located at 3505 North Bendix Drive approximately one point nine (1.9) miles away. Additional Fire Department units would respond from Fire Station #7 located at 1616 Portage Avenue which is approximately four (4) miles away. Cleland Homes, Inc. Annexation Area _ 7 The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate water supply will be necessary as development takes place. It is not anticipated that the services of this Department will be required to a great extent in the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area. 2000 Operating Budget for the Department: $14,033,553 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$296 Proposed Number of Parcels in Area: 140 Cost for Annexation Area per year: $41,440 / 3 = $13,813 D. Code Enforcement The Annexation Area will be added to Territory 8. The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Full and dedicated response will be in place within one year of the effective date of the Annexation. It is not anticipated that the services of this Department will be required to a great extent within the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area. 2000 Operating Budget for the Department: $1,151,497 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$24 Proposed Number of Parcels in Area: 140 Cost for Annexation Area per year: $3,360 / 3. _ $1,120 E. Environmental Services Environmental Services provides wastewater treatment and administers the City's sanitation service (trash pickup). These services are supported by user fees, and are paid through the Water Works billing system: Single family rate: $8.00 per month. Senior rate: $5.50 per month. Duplex rate: $10.50 per month Tri-plex: $13.00 per month Quad: $15.00 per month Recycling fee: $1.97 per month Cleland Homes, Inc. Annexation Area 8 F. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as the Mayor's office, the Legal Department, and the Parks & Recreation. These services are available upon the effective date of the Annexation. Full and dedicated response for non - capital services will be in place within one year of the effective date of the Annexation. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county -wide agencies and their services that will continue to provide the same type and level of services to the Annexation Area. FISCAL IMPACT 1) Essential city services can be made available to the residents (and territory) of the Annexation Area in a timely and comparable fashion per the requirements of State law and this fiscal plan. 2) The City is financially able to support city services to the territory sought to be annexed. 3) Required improvements made by the petitioner and/or owner of the parcels must be made in accordance with the standards of the City of South Bend. 4) Required improvements made by the City will be completed within the time frames provide by State law and this fiscal plan. 5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. 6) Property tax revenue estimates are based on 2001 payable 2002 tax rates, taxes paid in previous years by a comparable development, estimates of units built, and no tax abatements or adjustments. Tax rates are subject to change every year. 7) Department expenditures and revenues are derived from the City of South Bend Budget. 8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide average based on a particular budget year. In the case of the proposed development in the Annexation Area, some of these services will not be required or possibly requested for many years. Hence, the cost of providing services is largely reduced, and the costs reflected in this fiscal impact should be evaluated with this in mind. Cleland Homes, Inc. ANNEXATION Dear Ms. White: I am attaching for filling, the above- referenced resolution, which is a companion to Bill No. 102 -02. This Bill proposes to annex contiguous territory in German Township to the City of South Bend. The resolution indicates the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the provision of services, both capital and non - capital in nature, to the territory to be annexed. Cleland Homes, Inc. is a voluntary petition. It is a 28.15 acre parcel on the south side of Brick Road, west of Portage Road. All public improvements will be required to be done at the expense of the developer. I am requesting that the attached resolution be placed on the January 27, 2003 agenda of the Common Council meeting at which the companion Bill is given Second Reading.
