City Clerk RESOLUTION NO. 3 t� 2- 0 3 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 3333 WEST LATHROP DRIVE TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A FIVE (5) YEAR PERSONAL PROPERTY TAX ABATEMENT FOR TOTAL ENTERPRISES, LTD. WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 3333 West Lathrop Drive and which is more particularly described as follows: PARCEL I: A tract of land in the Southeast Quarter of Section Twenty-eight (28), Township Thirty - Eight (38) North, Range Two (2) East, German Township, St. Joseph County, Indiana. PARCEL II: A part of the Southeast Quarter of Section Twenty-eight (28), Township Thirty -eight (38) North, Range Two (2) East, German Township, St. Joseph County, Indiana. PARCEL III: A part of the Southeast Quarter of Section Twenty-eight (28), Township Thirty -eight (38) North, Range Two (2) East, St. Joseph County, Indiana. with said real estate having the following Key Number 25- 1010 -0409, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Personal property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Personal property tax deduction for a period of five (5) years, and further determines that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6- 1.1 -12 et sea. SECTION III. King, Chairperson Community & Economic Development Committee South Bend Common Council RE: Personal Property Tax Abatement Petition for: Total Enterprises, Ltd. Dear Council Member King: Please find attached the Department of Community & Economic Development's report on a personal property tax abatement petition for the above referenced petitioner. The petitioner intends to install new machinery and equipment at the company's facility at 3333 W. Lathrop Street and is seeking a five year personal property tax abatement. Also attached is a copy of the petition, Statement of Benefits form and supporting information. The report contains the Department's findings relative to the above petitions. Total Enterprises is a manufacturer of tooling for the automotive and office furniture industries. Products such as office and automotive seats, arm rests, head rests, fire walls, floor pans, and head liners are mode from tools and molds produced by Total Enterprises. The company needs to purchase new foundry, pattern shop and engineering machinery and equipment in order to produce tooling more competitively. The total cost of the new equipment is estimated at $350,000. The project is expected to create 4 new jobs within the first year. Total Enterprises meets the qualifications for a five year personal property tax abatement, and a representative of the company will be available to meet with the Committee on Monday, May 12, 2003.
