NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section 1. Section 6-4 (b)(1), (b)(2), (b)(7), (b)(8), (b)(11) be amended as follows: (b) Unless otherwise provided in the building code, the fees to be charged for the issuance of permits by the Department shall be paid at the time the permit is issued. (1) The fee for permits issued for new construction and building additions shall be based upon the square footage of such new construction or addition at the rate of six cents ($0.06 per square foot for the first one hundred thousand (100,000) square feet and tltrc four cents ($0.04 per square foot for each additional square foot, with a minimum permit fee of $20.00. Fees shall be charged for the issuance of permits for the installation or erection of freestanding signs; billboards, including outdoor and off-premises signs; facia signs; marquee or canopy signs and for lettering on buildings as follows: a. One (1) square foot or less of display area and embellishments: No fee b. One (1) square foot to twenty-five (25) square feet of display area and embellishments: Twenty dollars (,$20.00); c. Twenty-five (25) square feet to fifty (50) square feet of display area and embellishments: Thirty dollars ($30.002 d. Fifty (50) square feet to one hundred (100) square feet of display area and embellishments: - Forty dollars ($40.001; e. In excess of one hundred (100) square feet of display area and embellishments: ~irirtq-dollars ($S3$:@83 Fifty dollars ($50.00; f. Temporary signs: First thirty (30) days' permit, 63 twenty dollars (,$20.002 each thirty (30) days of extension of temporary permit, 6~twenty dollars ($20.00). (8) Wrecking and demolition permit fees shall be as follows: a. Residential: 1. Twenty dollars ($20.00 per one-and two-story house including accessory. house. 2. Twenty-five dollars (~25.00~ for more than atwo-story b. Commercial: 1. Twenty-five dollars (,$25.001 per rn7e=store story on buildings which has up to four thousand (4,000) square feet ere storX. 2. Forty dollars ($40.00) per one=store story on buildings which has four thousand one (4,001) to ten thousand (10,000) square feet per storX. 3. - Fifty dollars $50.00) per one=store story on buildings which has ten thousand one (10,001) to twenty-five thousand (25,000) square feet per story. -c , 4. Seventy-five dollars ($75.002per story on buildings which has over twenty-five thousand (25,000) square feet per storX. (11) The fee for installation of a wood burning stove shall be fifteen dollars 15.00 per flue (including chimney and chimney connector). Section 2. Article 2 Building Rules and Procedures be amended by adding thereto: Sect. 6-6.5. Sign Permits: ~l No~erson firm or corporation shall erect or cause to be erected a sign in the City without obtaining, in advance, a sign permit from the Department. (b) The applicant shall file with the Department a completed application on the form provided, with all information indicated on the application submitted in full and with all other required information. ~.) All persons, firm, or corporation erecting signs in the City for renumeration shall be registered with the Department. Registration shall be on forms provided by the Department and be accompanied by a Five thousand dollars ($5,000.00) bond made payable to the City of South Bend indemnifying the City against all loss or damage to public wadpublic places, and other public property during the course of the work under the sign permit and further conditioning that the applicant will indemnify the City and pay any and all personal and property damages caused by any negligent act or omission in the erection of such sign, insurance certificate as required by Chapter 21 of the South Bend Municipal Code, and payment of a registration fee of Seventy-five dollars ($75.00). Said registration shall be for a term of one year from the date of issuance. Section 3. Section 6-19 be amended by adding thereto: (cl Service change or upgrade shall require the structure to be brought into compliance with the electrical code in effect at the time of the service change or up remade. Section 4. Section 6-22(c) be amended as follows: (c) , (c) The Board or its designee shall examine applicants for licenses a minimum of twice a}ear, provided that anv such applications are pendine. The Board may also meet at other_times at the call of the chairman of the Board. Section 5. Section 6-23 (a)(1) be amended as follows: (1) Class A electrical contractor's license. A Class A electrical contractor's lic3ense may be issued to a person who is principally engaged in the business of electrical contracting. This license entitles the holder and his/her employees to perform electrical contracting work. Section 6. Section 6-23(k)(2) be amended as follows: (2) In the event of a death of the license holder, the business firm, company, or corporation shall have six (6 months to secure another license holder. A new license shall be issued in accordance with the provisions set forth in section 6-23. Section 7. Section 6-36.1 (c) be amended as follows: (c) , (cl The Board or its designee shall examine applicants for licenses a minimum of twice a year, provided that anv such applications are pending. The Board may also meet at other times at the call of the chairman of the Board.. Section 8. Section 6-36.2 (a) (1) be amended as follows: (1) Heating, air conditioning and ventilating contractor's license. A heating, air conditioning and ventilating contractor's license maybe issued to a person who is principally engaged in the business of heating, air conditioning or ventilating contracting. This license entitles the holder and his/her employees to perform heating, air conditioning and ventilating contracting work and to sell approved heating, air conditioning and ventilating apparatus and devices. Section 9. Section 6-36.2 (k)(2) be amended as follows: (2) In the event of a death of the license holder, the business firm, company, or corporation shall have six (6 months to secure another license holder. A new license shall be issued in accordance with the provisions set forth in section 6-36.2. Section 10. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and its publication as prescribed by law.
