AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING ARTICLE 10, SIGN REGULATIONS, OF CHAPTER 21,
ZONING, OF THE SOUTH BEND MUNICIPAL CODE BY REVISING AND ADDING
TO THE LOCATION REQUIREMENTS OF OUTDOOR ADVERTISING SIGNS AND
REVISING THE TIME FRAME FOR ISSUING SIGN PERMITS
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Chapter 21 of the
Municipal Code to modify the distance regulations regarding
outdoor advertising signs.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section 1. Section 21.170.(6)(d)(5)of Article 10 Chapter
21 of the South Bend Municipal Code is amended to read as
follows:
Sec. 21.170.(6) "C" Commercial, "D" Light Industrial,
and "E" Heavy Industrial Districts:
(d)(5) The minimum distance between a new outdoor
advertising sign and an existing outdoor advertising
sign located on the same side of the street shall be
. seven hundred
fifty feet (750') .
(d)(6) The minimum distance between a new outdoor
advertising sign and an existing outdoor advertising
sign located on the same side of a limited-access
highway shall be one thousand feet (1000'), nor shall
it be placed within five hundred feet (500') of an
interchange, intersection at-grade, or rest area.

the nearest boundary of a residential district,
historic preservation district, public Park,
residential use, church, school, designated historic
landmark or river shall be one-hundred (100) feet as
measured from the extremity of the sign face.
(elf--(-7~(d) (8)The total number of outdoor
advertising signs within the associated sphere of
influence shall at no time exceed the total number of
outdoor advertising signs legally in existence in said
area on the effective date of Ordinance No. 5647-74.
Section 2. Section 21-173 (3)(b)of Article 10, Chapter 21
of the South Bend Municipal Code is amended to read as follows:
Section 21-173 (3) Procedure:
(3)(b)Except as otherwise provided, the Building
Commissioner shall review an application for a sign
permit and issue such permit in accordance with the
provisions of this article or deny the application
within ~}- fifteen (15) working days of its
receipt. Failure of the Building Commissioner to take
such action shall constitute approval of the sign
permit.
Section 3. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approved
by the Mayor, and legal publication.
