NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section 1. Section 21.170.(6)(d)(5)of Article 10 Chapter 21 of the South Bend Municipal Code is amended to read as follows: Sec. 21.170.(6) "C" Commercial, "D" Light Industrial, and "E" Heavy Industrial Districts: (d)(5) The minimum distance between a new outdoor advertising sign and an existing outdoor advertising sign located on the same side of the street shall be . seven hundred fifty feet (750') . (d)(6) The minimum distance between a new outdoor advertising sign and an existing outdoor advertising sign located on the same side of a limited-access highway shall be one thousand feet (1000'), nor shall it be placed within five hundred feet (500') of an interchange, intersection at-grade, or rest area. (elf--(-7~(d) (8)The total number of outdoor advertising signs within the associated sphere of influence shall at no time exceed the total number of outdoor advertising signs legally in existence in said area on the effective date of Ordinance No. 5647-74. Section 2. Section 21-173 (3)(b)of Article 10, Chapter 21 of the South Bend Municipal Code is amended to read as follows: Section 21-173 (3) Procedure: (3)(b)Except as otherwise provided, the Building Commissioner shall review an application for a sign permit and issue such permit in accordance with the provisions of this article or deny the application within ~}- fifteen (15) working days of its receipt. Failure of the Building Commissioner to take such action shall constitute approval of the sign permit. Section 3. This ordinance shall be in full force and effect from and after its passage by the Common Council, approved by the Mayor, and legal publication.
