INDIANA, AMENDING SECTION 9 -17 OF THE SOUTHBEND MUNICIPAL CODE
ADDRESSING EMS OPERATING ENTERPRISE FUND # 288; CREATING NEW SECTION
9 -17.1 EMS CAPITAL ENTERPRISE FUND # 287 AND CREATING
NEW SECTION 2- 170.15 CENTRAL SERVICES CAPITAL FUND # 224
STATEMENT OF PURPOSE AND INTENT
In the interest of promoting greater accountability and transparency, this ordinance would
specifically address three (3) funds. It would amend the current provisions set forth in Section 9-
17 of the South Bend Municipal Code by changing Fund # 288 to an enterprise fund structure for
the South Bend Fire Department. New Section 9 -17.1 would be a companion fund to Fund # 288
which would be created to track capital expenditures in the Fire Department. New Section 2-
170.15 is proposed to be a companion Fund to Fund # 222 which would enable tracking of capital
expenditures in Central Services of the Department of Public Works.
This ordinance is believed to be in the best interests of the City of South Bend, Indiana.

Section I. Section 9 -17 of Article 3 Chapter 9 of the South Bend Municipal Code is hereby
amended to read in its entirety as follows:
See. 9 -17 EMS Operating Enterprise Fund # 288.
(a) The revenues generated by the ambulance /medical user fees set forth in Section 9-
16 shall be deposited into EMS Operating Enterprise Fund # 288.
(b) EMS Operating Enterprise Fund # 288 shall operate as an enterprise fund for the benefit
of the South Bend Fire Department.
Section II. Chapter 9, Article 3 of the South Bend Municipal Code is hereby amended by
the inclusion of new Section 9 -17.1 which shall read in its entirety as follows:
See. 9 -17.1 EMS Capital Enterprise Fund # 287.
(a) The EMS Capital Enterprise Fund # 287 is created to be a companion fund to Fund #
288 for the benefit of the South Bend Fire Department.
(b) The EMS Capital Enterprise Fund # 287 shall track capital expenditures of the South
Bend Fire Department.

Section III. Chapter 2, Article 14 of the South Bend Municipal Code is hereby amended by
the inclusion of new Section 2- 170.15 which shall read in its entirety as follows:
Sec. 2- 170.15 Central Services Capital Fund # 224.
(a) The Central Services Capital Fund # 224 is created to be a companion fund to Fund #
222 for the benefit of the Central Services Division.
(b) The Central Services Capital Fund # 224 shall track capital expenditures of the Central
Services Division of the Department of Public Works.
Section IV. If any part, subsection, section, paragraph, sub - paragraph, sentence, clause,
phrase or word of this ordinance is for any reason declared to be unconstitutional or otherwise
invalid by a Court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this ordinance.
Section V. This ordinance shall be in full force and effect from and after its passage by the
Common Council, approval by the Mayor, and legal publication.

Re: Ordinance Amending or Adding Three Funds in the South Bend Municipal Code
Dear Council President Davis:
During the 2015 budget process, the City Administration discussed amending/adding three funds
in the interest of promoting greater accountability and transparency. The purpose of this bill is to
amend the South Bend Municipal Code for these funds in order to implement the 2015 budget that
was passed by the Common Council during October, 2014:
• Fund 288 — EMS Operating Enterprise
• Fund 287 — EMS Capital Enterprise
• Fund 224 — Central Services Capital
This bill is respectively submitted for 151 reading at the council meeting on November 10, 2014
and 2 d reading, public hearing, and 3rd reading at the council meeting on November 24, 2014. I
will present this bill at the appropriate committee and council meetings.

(5) FIVE -YEAR RESIDENTIAL REAL PROPERTY
TAX ABATEMENT FOR

WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Residentially Distressed
Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as 802
Napoleon, Indiana, and which is more particularly described as follows:
LOT 53 EXCEPT EAST 140 FEET, SORIN'S 211D ADDITION, SECTION 1, TOWNSHIP 37
NORTH, RANGE 2 EAST, PORTAGE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA
and this property has Tax Key Number 018 -5104 -3634 be designated as a Residentially
Distressed Area under the provisions of Indiana Code 6 -1.1 -12.1 gt sea., and South Bend
Municipal Code Sections 2 -76 et sea., and;
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for a residentially
distressed area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that the petition for real
property tax abatement and the Statement of Benefits form meet the requirements of Indiana
Code 6 -1.1 -12.1 et sea., for tax abatement.
SECTION II. The Common Council hereby determines and finds that the area meets one of the
following conditions as formally established in Ordinance No. 9394 -03, which was passed on
February 10, 2003:
A. The area is comprised of parcels that are either unimproved or contain only one (1)
or two (2) family dwellings designed for up to four (4) families, including accessory
buildings for those dwellings; or
B. Any dwellings in the area are not permanently occupied and are:
i. the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies; or
C. Parcels of property in the area:
i. have been sold and not redeemed under IC 6- 1.1 -24 and IC 6- 1.1 -25; or
ii. are owned by a unit of local government; or
D. A significant number of dwelling units within the area are not permanently
occupied or a significant number of parcels in the area are vacant land; or
E. A significant number of dwelling units within the area are:
i. the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies; or
F. The area has experienced a net loss in the number of dwelling units, as documented
by census information, local building and demolition permits, or certificates of
occupancy, or the areas are owned by Indiana or the United States; or
G. The area (plus any areas previously designated under this subsection) will not
exceed ten percent (10 %) of the total area within the Council's jurisdiction.
SECTION III. The Common Council also hereby determines and finds the following:
A. That the description of the proposed redevelopment meets the applicable standards
for such development.
B. That the estimate of the value of the redevelopment is reasonable for projects of this
nature;
C. That the other benefits about which information was requested are benefits that can
be reasonably expected to result from the proposed described redevelopment; and
D. That the totality of benefits is sufficient to justify the requested deduction, all of
which satisfy the requirements of Indiana Code 6 -1.1= 12.1 -3.
E. The deduction will not be allowed unless the dwelling is rehabilitated to meet local
code standards for habitability.
F. The deduction will not be allowed unless the dwelling rehabilitation is completed
within five (5) calendar years from the date of the adoption of this Resolution by the
Common Council.
SECTION IV. The Common Council hereby confirms its Declaratory Resolution designating
the area described herein as a Residentially Distressed Area for the purposes of tax abatement.
Such designation is for Real property tax abatement only and is limited to five (5) calendar years
from the date of adoption of the Declaratory Resolution by the Common Council as shown by
the attachment pursuant to Indiana Code 6 -1.1- 12.1 -17.
SECTION V. The Common Council hereby determines that the property owner is qualified for
and is granted Real property tax deduction for a period of five (5) years, and further determines
that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South
Bend and Indiana Code 6 -1.1 -12.1 et sea.
SECTION VI. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

WHEREAS, the Department of Community Investment has concluded an investigation
and prepared a report with information sufficient for the Common Council to determine that the
area qualifies as a Residentially Distressed Area under Indiana Code 6 -1.1 -12.1, et sue., and South
Bend Municipal Code Sections 2 -76, et se ., and has further prepared maps and plats showing the
boundaries and such other information regarding the area in question as required by law; and
WHEREAS, the Community Investment Committee of the Common Council has reviewed
said report and recommended to the Common Council that the area qualifies as a Residentially
Distressed Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I . The Common Council hereby determines and finds that the petition for real property
tax abatement and the Statement of Benefits form meet the requirements of Indiana Code 6 -1.1-
12.1 et seq., for tax abatement.
SECTION II. The Common Council hereby determines and finds that the area meets one of the
following conditions as formally established in Ordinance No. 9394 -03, which was passed on
February 10, 2003:
A. The area is comprised of parcels that are either unimproved or contain only one (1)
or two (2) family dwellings designed for up to four (4) families, including accessory
buildings for those dwellings; or
B. Any dwellings in the area are not permanently occupied and are:
i. the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies; or
C. Parcels of property in the area:
i. have been sold and not redeemed under IC 6- 1.1 -24 and IC 6- 1.1 -25; or
ii. are owned by a unit of local government; or
D. A significant number of dwelling units within the area are not permanently
occupied or a significant number of parcels in the area are vacant land; or
E. A significant number of dwelling units within the area are:
i. the subject of an order issued under IC 36 -7 -9; or
ii, evidencing significant building deficiencies; or
F. The area has experienced a net loss in the number of dwelling units, as documented
by census information, local building and demolition permits, or certificates of
occupancy, or the areas are owned by Indiana or the United States; or,
G. The area (plus any areas previously designated under this subsection) will not
exceed ten percent (10 %) of the total area within the Council's jurisdiction.
SECTION III. The Common Council also hereby determines and finds the following:
A. That the description of the proposed redevelopment meets the applicable standards
for such development.
B. That the estimate of the value of the redevelopment is reasonable for projects of
this nature;
C. That the other benefits about which information was requested are benefits that can
be reasonably expected to result from the proposed described redevelopment; and
D. That the totality of benefits is sufficient to justify the requested deduction, all of
which satisfy the requirements of Indiana Code 6- 1.1- 12.1 -3.
E. The deduction will not be allowed unless the dwelling is rehabilitated to meet local
code standards for habitability.
F. The deduction will not be allowed unless the dwelling rehabilitation is completed
within five (5) calendar years from the date of the adoption of this Resolution by
the Common Council.
SECTION IV. The Common Council hereby determines and finds that the proposed described
redevelopment can be reasonably expected to yield benefits identified in the Statement of Benefits
and the petition for real property tax abatement consideration and that the Statement of Benefits
form prescribed by the State Board of Accounts are sufficient to justify the deduction granted
under Indiana Code 6 -1.1- 12.1 -3. This resolution is passed as an exception to the current City
Code regarding the applicable building permit provision (Section 2- 84.7(c)13. Previously,
Council approved Resolution 4298 -13 lots 47, 73, 78, 88 as special exceptions for the Villa at Lake
Blackthorn because of conflict of the City Code and building permits being pulled. The council
considers this abatement because the City specifically provided water and sewer services to spur
additional development.
SECTION V. The Common Council hereby accepts the report and recommendation of the
Community Investment Committee that the area herein described be designated as a Residentially
Distressed Area and hereby adopts a Resolution designating this area as a Residentially Distressed
Area for purposes of real property tax abatement.
SECTION VI. The designation as a Residentially Distressed Area shall be limited to five (5)
calendar years from the date of the adoption of this Resolution by the Common Council as shown
by the attachment pursuant to Indiana Code 6- 1.1- 12.1 -17.
SECTION VII. The Common Council hereby determines that the property owner is qualified for
and is granted property tax deduction for a period of five (5) years. This resolution is adopted as
an exception to the current City Code regarding the applicable building permit provision (Section
2- 84.7(c)13.
SECTION VIII. The Common Council directs the City Clerk to cause notice of the adoption of
this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana
Code 5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing notice of the public
hearing before the Common Council on the proposed confirming of said declaration.
SECTION IX. Pursuant to Indiana Code 6 -1.1- 12.1 -2, the rehabilitation must meet all local code
standards for habitability as a specific condition of having such property designated as a
residentially distressed area.
SECTION X. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

On October 22, 2014, a petition for residential tax abatement consideration for real property
located at The Villas at Lake Blackthorn street address of 4946 Stem Line Court, 5004 Stern
Line Court and 4949 Bow Line Court. Pursuant to Chapter 2, Article 6, Section 2 -77.1 of
the Municipal Code of the City of South Bend, this petition was referred to the Department
of Community Investment for purposes of investigation and preparation of a report
determining whether the area qualifies as a Residentially Distressed Area pursuant to
I.C.6 -1.1 -12.1 and whether all zoning requirements have been met.
The Department of Community Investment has reviewed the petition (a copy of which is
attached), investigated the area, and makes the following report.
PROJECT DESCRIPTION
The petitioners intend to construct three 1,800 square foot single family homes on three lots
in The Villas at Lake Blackthorn in Sections I and II at a cost of $250,000 for each home. .
The homes will have three bedrooms, 2 baths along with a 2 car garage. These three
properties were left of an existing abatement which expires on 11/12/2018. They had
personnel changes within the company around the time of filing the existing abatement and
a careful audit of the lots to be included was not conducted resulting in the three lots being
left of in error. By filing for a new abatement they will have two years to develop and sell
the lots. As an alternative to filing an abatement extension to an existing abatement would

have given them only one year to develop and sell the lots.
The Villas at Blackthorn is a single family home subdivision with 114 home sites, located on
56 +- acres, with a large lake, a gazebo park, and a year round pond.
Total taxes to be abated during the (5) five -year abatement period are estimated to be $5,679.
Total taxes to be aid during the (5) five -year abatement period are estimated to be $45,686.
ABATEMENT QUALIFICATION
A review of the tax abatements previously granted finds that the petitioner has been
associated with or been granted these previous tax abatements: 3868 -08, 3869 -08, and
3806 -07.
2. The Building Commissioner has reviewed this petition and finds the property to be
properly zoned for the proposed project. The Building Commissioner has noted that
the properties requesting abatement have had building permits pulled.
3. A review of the Tax Abatement Ordinance No. 9394 -03 finds that the petitioner meets
the qualifications for a (5) five -year residential tax abatement under Section 2 -77.1,
Single Family Residential Construction, if the Council determines a special exception
is granted.

WHEREAS, the Department of Community Investment has concluded an investigation
and prepared a report with information sufficient for the Common Council to determine that the
area qualifies as a Residentially Distressed Area under Indiana Code 6 -1.1 -12.1, et M., and
South Bend Municipal Code Sections 2 -76, et sea., and has further prepared maps and plats
showing the boundaries and such other information regarding the area in question as required by
law; and
WHEREAS, the Community Investment Committee of the Common Council has
reviewed said report and recommended to the Common Council that the area qualifies as a
Residentially Distressed Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I . The Common Council hereby determines and finds that the petition for real
property tax abatement and the Statement of Benefits form meet the requirements of Indiana
Code 6 -1.1 -12.1 et sea., for tax abatement.
SECTION II. The Common Council hereby determines and finds that the area meets one of the
following conditions as formally established in Ordinance No. 9394 -03, which was passed on
February 10, 2003:
A. The area is comprised of parcels that are either unimproved or contain only one
(1) or two (2) family dwellings designed for up to four (4) families, including
accessory buildings for those dwellings; or
B. Any dwellings in the area are not permanently occupied and are:
i, the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies; or
C. Parcels of property in the area:
i. have been sold and not redeemed under IC 6- 1.1 -24 and IC 6- 1.1 -25; or
ii. are owned by a unit of local government; or
D. A significant number of dwelling units within the area are not permanently
occupied or a significant number of parcels in the area are vacant land; or
E. A significant number of dwelling units within the area are:
i. the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies; or
F. The area has experienced a net loss. in the number of dwelling units, as

documented by census information, local building and demolition permits, or
certificates of occupancy, or the areas are owned by Indiana or the United States;
or,
G. The area (plus any areas previously designated under this subsection) will not
exceed ten percent (10 %) of the total area within the Council's jurisdiction.
SECTION III. The Common Council also hereby determines and finds the following:
A. That the description of the proposed redevelopment meets the applicable
standards for such development.
B. That the estimate of the value of the redevelopment is reasonable for projects of
this nature;
C. That the other benefits about which information was requested are benefits that
can be reasonably expected to result from the proposed described redevelopment;
and
D. That the totality of benefits is sufficient to justify the requested deduction, all of
which satisfy the requirements of Indiana Code 6 -1.1- 12.1 -3.
E. The deduction will not be allowed unless the dwelling is rehabilitated to meet
local code standards for habitability.
F. The deduction will not be allowed unless the dwelling rehabilitation is completed
within five (5) calendar years from the date of the adoption of this Resolution by
the Common Council.
SECTION IV. The Common Council hereby determines and finds that the proposed described
redevelopment can be reasonably expected to yield benefits identified in the Statement of
Benefits and the petition for real property tax abatement consideration and that the Statement of
Benefits form prescribed by the State Board of Accounts are sufficient to justify the deduction
granted under Indiana Code 6 -1.1- 12.1 -3.
SECTION V. The Common Council hereby accepts the report and recommendation of the
Community Investment Committee that the area herein described be designated as a
Residentially Distressed Area and hereby adopts a Resolution designating this area as a
Residentially Distressed Area for purposes of real property tax abatement.
SECTION VI. The designation as a Residentially Distressed Area shall be limited to five (5)
calendar years from the date of the adoption of this Resolution by the Common Council as
shown by the attachment pursuant to Indiana Code 6 -1.1- 12.1 -17.
SECTION VII. The Common Council hereby determines that the property owner is qualified for
and is granted property tax deduction for a period of five (5) years.
SECTION VIII. The Common Council directs the City Clerk to cause notice of the adoption of
this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana
Code 5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing notice of the public
hearing before the Common Council on the proposed confirming of said declaration.
SECTION IX. Pursuant to Indiana Code 6 -1.1- 12.1 -2, the rehabilitation must meet all local code
standards for habitability as a specific condition of having such property designated as a
residentially distressed area.
SECTION X. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

On October 22, 2014, a petition for residential tax abatement consideration for real property
located at The Villas at Lake Blackthom street address of 4946 Stern Line Court, 5004 Stern
Line Court and 4949 Bow Line Court. Pursuant to Chapter 2, Article 6, Section 2 -77.1 of
the Municipal Code of the City of South Bend, this petition was referred to the Department
of Community Investment for purposes of investigation and preparation of a report
determining whether the area qualifies as a Residentially Distressed Area pursuant to
I.C.6 -1.1 -12.1 and whether all zoning requirements have been met.
The Department of Community Investment has reviewed the petition (a copy of which is
attached), investigated the area, and makes the following report.
The petitioners intend to construct three 1,800 square foot single family homes on three lots
in The Villas at Lake Blackthorn in Sections I and II at a cost of $250,000 for each home. .
The homes will have three bedrooms, 2 baths along with a 2 car garage. These three
properties were left of an existing abatement which expires on 11/12/2018. They had
personnel changes within the company around the time of filing the existing abatement and
a careful audit of the lots to be included was not conducted resulting in the three lots being
left of in error. By filing for a new abatement they will have two years to develop and sell
the lots. As an alternative to filing an abatement extension to an existing abatement would

have given them only one year to develop and sell the lots.
The Villas at Blackthorn is a single family home subdivision with 114 home sites, located on
56 +- acres, with a large lake, a gazebo park, and a year round pond.
Total taxes to be abated during the (5) five -year abatement period are estimated to be $5,679.
Total taxes to be paid during the (5) five -year abatement period are estimated to be $45,686.
ABATEMENT QUALIFICATION
A review of the tax abatements previously granted finds that the petitioner has been
associated with or been granted these previous tax abatements: 3868 -08, 3869 -08, and
3806 -07.
2. The Building Commissioner has reviewed this petition and finds the property to be
properly zoned for the proposed project.
3. A review of the Tax Abatement Ordinance No. 9394 -03 finds that the petitioner meets
the qualifications for a (5) five -year residential tax abatement under Section 2 -77.1,

because of a lack of development, cessation of growth, deterioration of improvements or
other factors which have impaired values and prevent a normal development of the property:
Economic market factors, including the tightening of the credit market, and the decline
of real estate property values, have compounded the impact of the higher than
comparable city taxes in this subdivision. Additionally, the majority of the unsold
property in this neighborhood is located adjacent to the US 31 Bypass — a negative that
has proven to be an immitigable factor in the slow growth of sales. Additionally, the
new construction market has plummeted from 800+ new homes annually, to about 100
new homes. The tax abatement provides an incentive for citizens to invest in new
construction within the city limits of South Bend.

STATEMENT OF PURPOSE AND INTENT
On January 16, 2013, Policy # 01 -2013 governing members of the South Bend Common Council
took effect which created Interim Policies and Procedures addressing City -Owned Technologies which
are currently in effect.
On February 1, 2013, Policy # 02 -2013 governing members of the South Bend Common Council
took effect which created Interim Policies and Procedures addressing Facebook Standards. These policies
were deemed necessary in light of the Common Council beginning to transition from a paper -driven
legislative body to using advanced technologies including but not limited to city -owned computers and
city -owned Ipads. Both of these referenced Interim Policies and Procedures have been updated and are
included in the proposed ordinance.
On June 24, 2014, proposed "Supplemental Social Media Practices and Guidelines" was shared
with the Common Council. That draft recommended twenty -five (25) supplemental guidelines and
incorporated many policies which are used by other communities and many Fortune 500 companies.
Additionally, all three (3) areas summarized above have had input from the City of South Bend's
Human Resources Director and the City's Information Technologies staff of the Department of
Administration and Finance. These policies and procedures would formally govern members of the South
Bend Common Council setting forth best practices to help keep pace with the ever - changing technologies.
They would be codified into Chapter 2 of the South Bend Municipal Code along with other Common
Council regulations. Best practices governing many federal departments have also been studied and
reviewed.
Today Council Members communicate, collaborate and exchange information using a variety of
the latest technologies. It is acknowledged that opportunities to engage the public are often not without
risk. This ordinance is intended to address responsible and appropriate use of these new technological
resources, and also strives to maintain compliance with the State of Indiana's Open Meeting and Public
Records laws. This ordinance is believed to be in the best interests of the City of South Bend, Indiana, in
seeking and maintaining the highest standards of respect, integrity, and professionalism of all the
individuals elected to serve in legislative branch of city government.

Section I. Chapter 2, Article 1 of the South Bend Municipal Code is hereby amended by the
inclusion of new Section 2 -9.1 which shall read in its entirety as follows:
Sec. 2-9.1 Policies and Procedures Governing City -Owned Technologies, Facebook Standards,
Social Media and Social Networking.
(a) Pumose and Intent. The following policies and procedures shall govern the official
and the non - official personal use of any and all city -owned technologies and privately -owned
technologies, usage of Facebook, social media and social networking services and tools by any person
elected to serve as a member of the South Bend Common Council.
These policies and procedures shall govern various types of communication and public engagement
including but not limited to:
1 Email and text messaging'
2. Media Sharing — Examples: You Tube, iTunes
3. Blogging /Microblogging — Examples: WordPress, Blogger, Twitter
4. Social Networking — Examples: Facebook, MySpace, LinkedIn, Ning
5. Document and Data Sharing Repositories: Examples: Scribd, S1ideShare, Socrata
6. Social Bookmarking — Examples: Delicious, Digg, Reddit
7. Widgets — Examples: Google Maps, AddThis, Facebook "Like"
(b) City -Owned Technologies. All technology resources owned by the City of South
Bend, Indiana, which are permitted to be used by a member of the South Bend Common Council shall be
used in compliance with the following regulations:
1. Technology resources are to be used primarily to serve the governmental need of the City of
South Bend.
2. Technology resources may be used for personal purposes on a limited basis, provided there is:
i. No marginal cost to the City of South Bend
ii. No interference with government responsibilities
iii. No political activities
iv. No accessing of sites which promote laws which are contrary to the city, state or federal
governments
' Indiana's Public Access Counselor Luke H. Britt ruled that private email accounts are public record if they involve official
business under Indiana's Access to Public Records Act. In the Advisory Opinion in Formal Complaint 14 -FC -199 issued on
October 8, 2014, he noted that "when a public official avails himself to any communication medium, whether it is phone, email
or text message, he is availing himself of the Indiana access laws when communicating in his official capacity... the public
official is basically on the honor system to either produce the requested emails or identify an APRA exception to
disclosure... the best transparent practice would be to implement a policy where email communication on private accounts
dealing with public business is considered potentially disclosable public record.

V. No accessing of inappropriate sites including but not limited to adult content, online
gambling, daring services and online shopping
vi. No accessing sites which promote illegal activities, trademark and copyright violations
vii. No accessing sites that distribute computer security exploits (hacking sites)
3. If any of the above - listed prohibited uses are required for a legitimate government reason, an
exception process must be followed.
4. No Expectation of Privacy: Nothing in this sub - section confers an individual right or should
be construed to provide an expectation of privacy. The provisions of the Indiana Open Door
Law codified at Indiana Code § 5- 14 -1.5 and the Indiana's Access to Public Records Law
codified at Indiana Code § 5 -14 -3 govern.
5. Further Responsibilities: Each Council Member is expected to:
i. Monitor personal use of the internet, messaging and other applications to ensure that
the City of South Bend is being appropriately served
ii. Adhere to the policies and procedures addressed herein
iii. Read and adhere to any additional policies and procedures developed by the Council's
Information and Technology Committee
6. Exception Process: Exceptions to these policies and procedures must be requested in writing
to the Chairperson of the Common Council's Information and Technology Committee. All
exceptions must be documented in writing and retained according to existing schedules.
Exceptions may be granted on a limited -rime basis only.
7. South Bend Municipal Code: All governing policies codified in Chapter 2 of the South Bend
Municipal Code addressing the Common Council shall be adhered to when using such
technology resources.
(c) Facebook Standards. Facebook is a social networking site which is operated worldwide by
Facebook, Inc. The company builds tools which are designed to enable its users to connect, share and
communicate with others. Facebook is being used by businesses and governmental entities to help
promote communication on various activities, events, projects and programs. The Council's Facebook
page is designed to drive traffic to the City's website and to inform more people about the City Council.
The following policies and procedures are to be used in conjunction with all other policies and procedures
addressed in this Section.
1. Initial Requirements: When a Council Member determines that he or she has a government
need for a Facebook account, the Council Member shall be required to submit a request to the

Council's Information and Technology Chairperson. Once approved, the Council's
Information and Technology Committee (ITC) Chairperson, will create the boilerplate
business page for the requesting Council Member, with the City's IT Division being available
for back -up assistance. The primary contact person shall be the Council's ITC Chairperson,
with the City's IT Division being the primary back -up for assistance. Applications shall not
be added to a City Facebook site, without prior approval by the IT members designated herein.
All City providing branding images must meet the City of South Bend, Indiana branding
standards.
2. Content:
Type of "Pages"
i. The Council's ITC Chairperson, with the City's IT Division being the primary
backup, may create "Pages" in Facebook, not "Groups ". Facebook "Pages" offer
distinct advantages including greater visibility, measurability and customization.
Community pages maybe accepted as is unless there is a copyright/trademark issue
or concern.
ii. For "type" description, choose "government ".
Boilerplate Requirements:
i. The IT members designated in these policies and procedures will standardize and
provide the Facebook page's image, consisting of a picture and the City's official
logo or seal.
ii. Each Council Member may include a brief welcome and biography of
himself/herself as it relates to publicly serving on the Common Council on the Wall
Page and send users first to the Wall to connect to the freshest content. Boilerplate
policy text regarding public disclosure and comments must be created using the
FBML static page application. A City boilerplate disclaimer statement must follow
the introductory statement which shall read as follows:
"(Name of Council Member) is a member of the South Bend
Common Council. This site is intended to serve as a mechanism for
communication between the public and the Council Member on listed
topics. Any comments submitted to this page and its list of fans are public
records subject to disclosure under the State of Indiana's Access to Public
Records law codified at Indiana Code § 5 -14 -3. All public disclosure
request must be directed to the of South Bend's Department of Law"

iii. If comments are turned on in very limited situations, the Wall page must include a
link to a Comment Policy tab with the following disclaimer:
"Comments posted to this page will be monitored. Under the City's
blogging policy, the City of South Bend reserves the right to remove
inappropriate comments including but not limited to those which have
obscene language or sexual content, threaten or defame any person or
organization, are of a political nature, promote illegal activity or violate any
local, state or federal laws ".
Users will be encouraged to contact a Council Member directly rather than having
"give and take" comments; and shall be directed to www.southbendin. gov for more
information.
Link to the City of South Bend:
A link to the City's website located at www.southbendin.gov must be included on
the Info page.
ii. Common Council Member pages should be page favorites of other City Facebook
pages.
Page Naming:
Page name must be descriptive of the Council Member
ii. Each participating Council Member shall choose carefully with consideration for
abbreviations, slang iterations, etc.
iii. The IT members designated in these policies and procedures shall review and
approve qualifying proposed names which meet the City's policies and procedures.
Page Administrators:
i. A successful Page requires "babysitting ". The Common Council President shall
be the Public Information Officer (PIO) with the Information and Technology
Committee Chairperson and the City's IT Division being the immediate back -ups.
The PIO shall be responsible for monitoring the Facebook page(s). Posts should
be approved by the PIO or a designated back -up. The PIO is responsible for making
sure that content is not stale and taking appropriate action thereafter.

ii. Each participating Council Member shall be an Administrator of their Facebook
page. All postings must include a by -line of the Council Member posting. The PIO
has the right to remove any inappropriate postings.
iii. The City of South Bend reserves the right to have additional Administrators to

Comments and Discussion Boards:
Style:
i. Comments to the Wall generally will be turned off, but may be allowed only on a
case -by -case basis upon the request of a Council Member and approved by the IT
members designated in these policies and procedures. Discussion Boards shall be
turned off.
i. City of South Bend Facebook pages will be based on a template that includes
consistent City branding. Only the IT members designated in these policies and
procedures will be able to provide requesting Council Members with the template.
ii. Council Members may be required to attend a training session prior to any
Facebook page being developed, and additional training sessions as changes to this
technology evolve.
iii. Council Members are required to use proper grammar and standard AP style,
avoiding jargon and abbreviations. Facebook is more casual than other
communication tools however, Council Members still represent the City of South
Bend at all times, and the highest standards of professionalism and decorum are
expected and required.
Applications:
i. There are literally thousands of Facebook applications. Common applications can
allow users to stream video and music, post photos, and view and subscribe to RSS
feeds; and while many may be useful to the Page's mission, many can cause clutter
and security risks.

ii. An application shall not be used unless it serves a governmental purpose, adds to
the user experience, comes from a trusted source and is approved by the IT
members designated in these policies and procedures.
iii. An application may be removed at any time by the City if there is significant reason
to believe that it is causing a security breach or is spreading viruses.
Archive:
Any additional protocols developed by the City of South Bend must be complied
with in conjunction with a City -wide designated City e -mail account designated for
each Council Member.
ii. Content which cannot be retrieved from Facebook via the API and is required to be
retained as a record will be required to be printed and maintained in accordance
with the City of South Bend's records retention policies.
(d) Social Media and Social Networking Policies and Procedures. The many forms of social media
are ever - changing. The following policies and procedures shall govern all Common Council Members
when using social media and social networking sites, regardless of whether such usage is in an official
capacity as an elected official or privately in a non - official personal use. These policies and procedures
shall govern when such usage is on any and all city -owned technologies and any and all privately -owned
technologies. The following policies and procedures are to be used in conjunction with all other policies
and procedures addressed in this Section.
Responsibility and Consequences: If a Council Member has a question with regard to
the usage of social media and /or social networking, he /she shall contact the Public
Information Officer (PIO) for the Council. Each participating Council Member takes
responsibility for conversation(s) he or she starts, with the Council Member being ever
mindful of the fact that his or her actions online reflect on his or her integrity as a
Council Member, the entire Common Council, and the City of South Bend, Indiana.
2. Identity, Signature and Timestamp: All participating Council Members must identify
one's self and sign his or her post or at a minimum leave one's initials to the Common
Council Facebook page or any other authorized social media formally established by
the Council. Council Members must identify himself or herself and make clear from
whom any social media statement is originating. Council posts must clearly show when
the information was published; and if the form of social media does not automatically
include a time stamp, he or she must then use a template indicating the date and time.

3. Photo /Video Release Form and Use ofimages: If a Council Member decides to post
an image(s) to social media, he or she must not violate any copyright, trademark, logo
or governing City of South Bend branding policies. Any photo /video /image considered
to be obscene or offensive is prohibited to be posted.
4. Disclaimer: If a Council Member's public content online is relevant to the City of
South Bend, he or she must clearly communicate that he or she is communicating on
behalf of himself or herself and not the City of South Bend. Participating Council
Members shall include the following statement "The views expressed on this site (or in
this post) are one's own and do not necessarily represent the positions of the city, its
officers or officials, strategies or opinions ".
5. Compliance with Applicable Laws and Policies /Procedures: Each Council Member
who decides to use social media is responsible for complying with all applicable
federal, state, county and city laws, policies and procedures.
6. Emergencies and Official City Business: For official statements published by the City
of South Bend and during all emergencies, all social media contact and postings must
be coordinated with the City of South Bend Director of Communications, as part of its
Emergency Support Function. Depending on the type of incident /declared emergency,
publishers may be directed to point to special social media sites that will serve as the
main source(s) of information, which in such circumstances may be directed by the
Emergency Management Agency. In such instances, Facebook Share or retweet
Council or City information to fans /followers maybe done as needed in order to ensure
message accuracy and consistency.
7. Assume that Everything One Writes On Line Will Become Public: Each Council
Member should always operate on the assumption that everything is visible to
everyone. Participating Council Members shall log out of Facebook when shutting
down a computer to minimize hacking in your name. Council Members are required
to monitor what other people post to their page and monitor what photos people tag
where a Council Member appears in a photo. Council Members are required to protect
confidential information.
8. Post Only Legally Accurate Information: Participating Council Members must comply
with the State of Indiana's Open Meeting law and Public Records law. Therefore posts
regarding official City of South Bend business shall always be in compliance with such
laws protecting confidential material and be in compliance with copyright, trademark,
logo and branding laws, policies and procedures. Links may be made to sources or
statements as references to ensure accuracy. Posts should be informative and based on
sustainable facts which can be verified. Consider and verify all sources BEFORE

posting. Content gathered online is subject to the same attribution rules as other content.
Council Members shall proofread all posts for grammatical and spelling errors in addition
to verification of the accuracy of the information to be posted.
9. Attribution: In the event that a Council Member decides to publish an email or other
message he or she has received from a reader, the Council Member must be clear in his
or her post that the email or message is from another person and that the words are not
the words of the Council Members. BEFORE such a post is made, the Council Member
must check the accuracy of the comment before republishing.
10. Honesty and Being Straightforward: All posts must be accurate and must avoid being
misleading in any way. Posts should be presented as being brief, accurate and to the
point. If a Council Member is alerted or discovers that a post which he or she made
may be misleading, that Council Member must correct the post as soon as possible.
11. Encourage Readers to Contribute: Council Members may encourage multiple
perspectives, additional knowledge and expertise which should be properly and
respectfully acknowledged.
12. Always Be Respectful: Posts may encourage comments of opposing ideas. Responses
shall be carefully considered in light of how such responses reflect upon the individual
Council Members, the Common Council and the City of South Bend, Indiana.
Disruptive behavior shall never be rewarded by a participating Council Member.
Council Members have the duty and responsibility to report any such instances as
consistent with these policies and procedures in a respectful manner.
13. Embracing Social Media is a Risk -Based Decision. Each Council Member who
individually decides to participate in using social media acknowledges the principle
that this is a "risk -based decision "?
14. Defamatory Personal Attacks Prohibited: Postings shall never include profane or
defamatory personal attacks of any type. No Council Member shall post in a
defamatory or unprofessional manner especially when a person's post is critical to a
Council Member.

15. Participation and Endorsements: A Council Member who participates in an online
group should be aware that such participation may be seen as endorsing such views.
Council Members shall be aware decide to observe in a group's activities or become a
member thereby being governed by all rules of professional conduct.
16. Transparency and Requirement to Correct Mistakes: Council Members are responsible
for being transparent. If a Council Member has a personal interest it must be declared.
Transparency includes declarations of affiliations, perspectives or previous coverage
of a particular topic or individual. All conflicts of interests are specifically governed
by the Council's regulations addressed in the South Bend Municipal Code and Indiana
Code § 35- 44.1 -1 -4 addressing conflicts of interest. Council Members shall be open
about their mistakes. Council Members have a duty to issue a correction in a timely
manner to any post which was posted incorrectly or contained mistakes regardless of
what means of communication was used.
17. Integrity is a Core Value: Ethical principles do not change in differing media. The
standards which govern behavior and activities as Council Members addressed in
Chapter 2 of the South Bend Municipal Code apply online and offline.3
18. Compliance With All Governing Laws, Policies and Procedures. Any Council Member
who decides to use social media or any form of social networking is responsible for
complying with all of the governing regulations set forth in this Section of the South
Bend Municipal Code, and all other City policies and procedures, and applicable state
and federal laws.
(e) Violations. The Council recognizes that public confidence in the integrity of the Common
Council and its elected Common Council Members is essential to the exercise of good government.
Therefore any Council Member allegedly violating this Section shall be timely reported to the Office of
the City Clerk on a form available from that Office. Upon receipt, the Office of the City Clerk shall send
said verified form to the Council Member alleged to have violated this section. The Office of the City
Clerk shall simultaneously send the verified form to the Information and Technology Committee and the
City's Human Resources Director for a review of whether the allegation is sustainable and send their
recommendation(s) to the Council Rules Committee. Upon receipt of said recommendation(s), the Council
Rules Committee shall have the limited authority to accept or deny said finding regarding the allegation(s).
A majority vote of the voting members of the Council Rules Committee shall be required to implement
the following disciplinary action: a moratorium of all social media ranging from a minimum of three (3)
months to a maximum of the remainder of the term of office of the Council Member. Each sustained
'Security Working Group (W20SEG) (p. 6, 2009) noted that when a person decides to embrace social media technology, risk
mitigation should include policies which "...focus on user behavior, both personal and professional ".

violation shall be subject to a public reprimand, in light of the fact that usage privileges of any city -owned
technologies or posting privileges to the Common Council Facebook page are public postings, and that
social media is public.
Section IV. If any part, subsection, section, paragraph, sub - paragraph, sentence, clause, phrase or
word of this ordinance is for any reason declared to be unconstitutional or otherwise invalid by a Court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions of this
ordinance.
Section V. This ordinance shall be in full force and effect from and after its passage by the
Common Council, approval by the Mayor, and legal publication.

Henry Davis, Jr. We are pleased to introduce the attached ordinance which would formally
Second District incorporate policies and procedures governing City -Owned Technologies,
Facebook Standards, and Social Media and Social Networking into the South Bend

Fred Ferlic The Common Council has had in effect since early 2013, two (2) interim policies
Fourth District which address city -owned technologies and Facebook Standards. Those policies
were implemented when the Ipads were rolled out for the Council. Supplemental
David Varner social media and social networking policies were shared with the Council in June
Fifth District of this year, with ongoing input and research taking place thereafter.
Oliver J. Davis Proposed new Section 2 -9.1 incorporates "best practices" in each of these areas.
Sixth District Our research reviewed many municipal policies which have been used by various
offices. We also reviewed policies used by the federal government. For example,

on the fast - changing landscape of the Internet and online communications with the
public. As technology advances, the policies and procedures will be reviewed on

an ongoing basis, so that as a broader audience is reached the professionalism
expected of the South Bend's elected legislative members will also be advanced.
The proposed ordinance also provides that all of the proposed policies and
procedures would be supplemental to the State of Indiana's laws governing Open
Meetings and Public Records. As changes are made to those state laws, updates if
necessary, would be made to our local ordinance regulations.
We have collaborated with the City of South Bend's Human Resources Director
and the Information Technology Division so that the proposed policies represent
the latest and best possible practices.
We request that this ordinance be referred to the Information and Technology
Committee and that it be set for public hearing, 2nd and 3rd readings at the Monday,
December 8, 2014 Common Council meeting.

During the past several years, it has been the practice of the City of South Bend to request
department heads, fiscal staff and city administration to conduct an extensive review of
the status of compliance with the adopted city budget and propose necessary adjustments
during the middle of the year and at year end. For 2014, we plan to propose adjustments
during three time periods— March, July and December.
Based on our budget review, we are submitting the enclosed additional appropriation
ordinance for your consideration.
I will present this bill to the Common Council at the appropriate committee and council
meetings. It is requested that this bill be filed for I" reading on November 24, 2014 with

Dear President Davis,
During the past several years, it has been the practice of the City of South Bend to request
department heads, fiscal staff and city administration to conduct an extensive review of
the status of compliance with the adopted city budget and propose necessary adjustments
during the middle of the year and at year end. For 2014, we plan to propose adjustments
during three time periods— March, July and December.
Based on our budget review, we are submitting the enclosed additional appropriation
ordinance for your consideration.
I will present this bill to the Common Council at the appropriate committee and council
meetings. It is requested that this bill be filed for 1st reading on November 24, 2014 with
2 "d reading, public hearing and 3`d reading scheduled for December 8, 2014.

AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, FOR BUDGET TRANSFERS FOR VARIOUS DEPARTMENTS WITHIN
THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 2014
STATEMENT OF PURPOSE AND INTENT
Unforeseen conditions have developed since the adoption of the existing budgets
(Ordinances #10264 -13 and #10265 -13 passed on October 30, 2013) which necessitate
the increase and reduction of appropriations within the various departments of the
General Fund and other funds of the City of South Bend during 2014.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana, as follows:
Section I. All accounts as set forth in the detailed attachment hereto which are
incorporated herein shall be adjusted by increase or reduction of appropriation in the
designated sums.
Section II. This ordinance shall be in full force and effect from and after its
passage by the Common Council and approval by the Mayor.

Dear President Davis,
During the past several years, it has been the practice of the City of South Bend to request
department heads, fiscal staff and city administration to conduct an extensive review of
the status of compliance with the adopted city budget and propose necessary adjustments
during the middle of the year and at year end. For 2014, we plan to propose adjustments
during three time periods — March, July and December.
Based on our budget review, we are submitting the enclosed ordinance for transfers
between various departments and cost categories within the same funds for your
consideration. No additional appropriation is requested in this ordinance.
I will present this bill to the Common Council at the appropriate committee and council
meetings. It is requested that this bill be filed for 151 reading on November 24, 2014 with
2"' reading, public hearing and 3`d reading scheduled for December 8, 2014.

I hereby Certify that the above referenced ordinance of G Family Properties was legally advertised on Thursday,
November 06, 2014 and that the Area Plan Commission at its public hearing on Tuesday, November 18, 2014 took
the following action:
Upon a motion by John McNamara, being seconded by Robert Hawley and unanimously carried, the
proposed ordinance of G Family Properties to zone from LB Local Business District to CB Community
Business District, property located at 1430 Mishawaka Avenue, City of South Bend, is sent to the
Common Council with a FAVORABLE recommendation. The site has been commercial for many years
and is part of the larger Mishawaka Avenue commercial strip. The rezoning will allow an adaptive reuse of
the site consistent with the other commercial uses in the area.
The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in
the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report.

Requested Action:
The petitioner is requesting a zone change from LB Local Business District to CB
Community Business District and three variances.
Land Uses and Zoning:
On site: On site is an existing commercial structure.
North: To the north across Mishawaka Avenue are single family homes zoned SF2
Single Family & Two Family District and a gas station zoned CB
Community Business.
East: To the east is a commercial building zoned MU Mixed Use District.
South: To the south is a single family home zoned SF2 Single Family & Two
Family District.
West: To the west across Clover Street is a commercial building zoned LB Local
Business District.
District Uses and Development Standards:
The CB - Community Business District is established to provide a location for high
volume and high intensity commercial uses. Activities in this district are often large space
users which may include limited amounts of outdoor sales or outdoor operations.
Developments within the CB District shall be coordinated to facilitate vehicular and
pedestrian access from nearby residential districts.
Site Plan Description:
The site is approximately a 4,000 square foot lot with an existing 1,300 square foot
building. The existing building has 2 service bays that front Mishawaka Avenue. The
remainder of the lot is paved. Due to the size of the lot and room for drive aisles, the
petitioner is seeking a variance from the required 7 parking spaces to 2 spaces. The
parking shown on the aerial photograph that extends in to the public right -of -way is not
permitted without special approval by the Board of Public Works. There is an existing 6'
privacy fence separating this property from the single family home to the south. The
petitioner would like to maintain this fence in place of the required Type B: Partial
Screening required.
Zoning and Land Use History And Trends:
Mishawaka Avenue has historically been a mix of commercial and residential uses. The
site was previously a gas station and has operated with auto oriented uses even after the
removal of the gas pumps.

State statutes and the South Bend Zoning Ordinance require that certain standards must be
met before a variance or Special Exception Use can be approved. These standards are
attached and made part of the staff report.
Recommendation:
Based on information available prior to the public hearing, the staff recommends that the
rezoning petition be sent to the Common Council with a favorable recommendation. The
staff recommends approval of the variances.
Analysis:
The site has been commercial for many years and is part of the larger Mishawaka Avenue
commercial strip. The rezoning will allow an adaptive reuse of the site consistent with the
other commercial uses in the area.
