A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY
FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN
PORTAGE TOWNSHIP
(ARBORS AT BELLEVILLE ANNEXATION AREA)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the
annexation of real estate located in Portage Township, St. Joseph County, Indiana, which is
described more particularly in Section I of this Resolution, and;
WHEREAS, the territory proposed to be annexed encompasses approximately 21.21 acres
of land on which is situated an apartment complex consisting of thirteen (13) three story buildings
and a clubhouse, with proposed construction of thirteen (13) additional three story buildings for a
total of 232 units, which project is proposed to be re -zoned MF 2 upon annexation to the City of
South Bend. This property is at least 12.5% contiguous to the current City limits, i.e., approximately
50% contiguous, and is generally located on the east side of Mayflower Road, approximately 2,200
feet south of Sample Street, Portage Township, Indiana. This annexation area and its multi family
rental use will require a basic level of municipal public services of a non - capital improvement
nature, including police and fire protection, street and road maintenance, street sweeping, flushing,
snow removal, and sewage collection, as well as services of capital improvement nature, including
street and road construction, street lighting, a sanitary sewer system, a water distribution system and
a storm water system; and
WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to
establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of
services of a non - capital nature, including street and road maintenance, sewage collection, street
sweeping, flushing, and snow removal, police and fire protection, and other non - capital services
normally provided within the corporate boundaries, and services of a capital improvement nature,
including street and road construction, street lighting, a sanitary sewer extension, a water
distribution system, and a storm water system to be fiunished to the territory to be annexed; (2) the
method(s) of financing those services; (3) the plan for the organization and extension of those
services; (4) that services of a non - capital nature will be provided to the annexed area within one (1)
year after the effective date of the annexation, and that they will be provided in a manner in standard
and scope to similar non - capital services provided to areas within the corporate boundaries of the
City of South Bend, regardless of similar topography, patterns of land use, or population density; (5)
that the services of a capital improvement nature will be provided to the annexed area within three
(3) years after the effective date of the annexation in the same manner as the services are provided
to areas within the corporate boundaries of the City of South Bend, regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be
eliminated by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public
Safety of the City of South Bend, have each approved a written fiscal plan and established a policy
for the provision of services to the territory proposed to be annexed, which plan and policy the
Common Council finds to be appropriate and in the best interest of the City, and, which it desires
to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the real property located in Portage Township, St. Joseph County, Indiana, described
more particularly as follows, be annexed to the City of South Bend:
THAT PART OF THE NORTHWEST, NORTHEAST AND SOUTHEAST
QUARTERS OF SECTION 17, TOWNSHIP 37 NORTH, RANGE 2 EAST,
PORTAGE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA WHICH IS
DESCRIBED AS: BEING LOT # 1 OF THE PLAT OF "MATTHYS
MAYFLOWER ROAD SECOND MINOR SUBDIVISION" RECORDED AS
DOCUMENT NO. 0262648 IN THE RECORDS OF THE ST. JOSEPH COUNTY,

Section H. It shall be and hereby is now declared and established that it is the policy of the
City of South Bend, to furnish services to said territory of a non - capital nature, such as police and
fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow
removal, within one (1) year of the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other areas of the City regardless of
similar topography, patterns of land use, or population density; and to furnish to said territory
services of a capital improvement nature, such as street and road construction, street lighting, a
sanitary sewer extension, a water distribution system, and a storm water system, within three (3)
years of the effective date of the annexation in the same manner as those services are provided to
areas within the corporate boundaries of the City of South Bend regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws, procedures, and planning criteria.
Section III. The Common Council for the City of South Bend shall and does hereby now
establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part
hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides
among other things, that except for the extension of Lombardy Drive, virtually all capital
improvements required to service the annexation area will be planned, provided, and paid for by the
developer subject to compliance with state and local law.
Section W. This Resolution shall be in full force and effect from and of its date of adoption
by the Common Council and approval by the Mayor. 'X,

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation
of property in Portage Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "), and
was developed through the cooperative efforts of the Area Plan Commission and the following
City Departments:

Department of Code Enforcement
Department of Community and Economic Development
Department of Administration and Finance
SECTION II. GENERAL DATA
A. Location
The Annexation Area is generally located on the east side of Mayflower Road, approximately
2,200 south of Sample Street. See Map 1.
B. Legal Description
The Annexation Area is part of the Northwest, Northeast and Southeast Quarters of Section 17,
Township 37 North, Range 2 East, Portage Township, St. Joseph County, Indiana. For a complete
legal description see Table 2.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits:

D. Size of Annexation Area
The Annexation Area is approximately 26.17 acres in area.

E. Buildings and Land Use
The Arbors at Belleville Park is an apartment complex consisting of a series of 13 three -story
buildings with a club house. An additional 13 three -story buildings will be constructed to the east
of the existing buildings. A total of 208 units will be located within the Annexation Area.
F. Zoning & Subdivisions
The site is zoned "R -2" Multi- family in unincorporated St. Joseph County. It is proposed to be
zoned "MF2" upon approval of the City Council and incorporation into the City of South Bend.
G. Population
The 2000 Census indicates that the average household size per renter - occupied units in South Bend
is 2.35. 208 units would generate a population size approximately 489 (208 * 2.35 rounded).
H. Tax Rate
The tax rates used are those of 2002 payable in 2003.
The Township Rate will decrease by $.2187 per $100.00 of assessed valuation with the deletion of
the Fire Fighting Fund, Fire Equipment Debt and the Cumulative Fire assessments.
The tax rate for the Annexation Area will increase by $2.1341 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be $1.9154 per $100.00 of assessed valuation. Table 1
shows representative tax rate information as published by the St. Joseph County Auditor.

This property has no assessed value assigned to it as of the date of this fiscal plan. The Hurwich
Farms apartment complex is being used as the closest available comparison. Net Assessment of
Hurwich Farms is $17,208,800 (2002/2003).

J. Municipal Legislative District
The Annexation Area will be in the 6th District.
K. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities. The Portage Township Trustee has been notified of this Annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer The public sanitary sewer network has been extended to the property by the developer
along an easement obtained from the Department of Parks and Recreation. The developer will be
required to extend the necessary sewer lines to and through the proposed development. The
wastewater treatment plant and the downstream collection facilities are adequately sized to handle
the additional flow
No additional public expenditures will be needed to extend existing sewer main facilities.
Water - The public water network has been extended to the property by the developer. The
apartment complex is looped with an 8" water main from Mayflower and a 6" water main from
Evergreen that goes south through Belleville Park. There is sufficient capacity for the Annexation
Area.
No additional public expenditures will be needed to extend existing water main facilities.
Street Lighting - Street lighting will be required to be installed by the developer on those rights -of-
way within the subdivision. Additional revenue to the General Fund from this Annexation Area
will be more than sufficient to pay for the street light operations.
Waivers of Annexation - Waivers of annexation is already in place for the Annexation Area.
Streets — Lombardy Drive will be extended by 1,412' to the south end of the development. The
City has agreed to partner with the developer (The Sterling Group) to extend Lombardy Drive.
The new street will add mileage to the roadway inventory, and this new mileage will add to the
state's payments to the Motor Vehicle Highway Fund, and the Local Road and Street Fund which
will be sufficient for street maintenance, sweeping and snow removal.
Note: It is anticipated that only sweeping and snow plowing will be required over the initial five -
year period, and that repair and replacement costs will not be needed to the fullest extent. As a
result, the cost to maintain this roadway reflects a reduced cost of one - third.
Drainage Plan — An approved drainage plan is in place, approved through the subdivision process.

When fully developed, this annexation area is not expected to require major capital outlays for
public works vehicles or equipment.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2,
I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer
Utility.
B. Police Department
The noted area would be expected to be added to the already existing BEAT 28. Police patrols,
traffic enforcement, and emergency responses will be part of the services the City will offer to this
area. This proposed annexation would require officers to cover a relatively small additional area to
this beat. It is located in an area of the city that was recently annexed into the City and is expected
to continue to grow, both in commercial development as well as residential.
At this time it is not expected that this annexation would cause calls for service to increase
significantly and it is not anticipated that it will be necessary to increase police patrols beyond the
already existing beat patrol at this time. The area under consideration is not expected to cause any
unusual problems. Cost for servicing this area would be expected to be absorbed by the existing
budget of the Police Department, as the addition of this area would not be significant to the point
of having to increase any budgetary items. Police services and response time in this area can be
expected to be comparable and consistent with that as in all other areas of the City. Police
coverage to this area could begin immediately upon annexation and coordination of the conversion
of the 911 emergency phone system for that area.
Note: The cost of service for this Annexation Area is based on the number of households.
Because of the high density of this single parcel, this is deemed a more appropriate way to
determine cost of servicing.

C. Fire Department
The Annexation Area will be serviced primarily by Station #6, located at 4302 Western Avenue
approximately one point nine (1.9) miles away. Additional Fire Department units would respond
from Fire Station #5 located at 2221 Prairie Avenue which is approximately three point seven (3.7)
miles away.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional
equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate
water supply will be necessary as development takes place.
Note: Due to the multi - family nature of the Annexation Area, the cost of service is based on one
building equaling one parcel. Large apartment complexes are generally well- managed and
constructed, with built -in fire safety systems. A one -third cost of service credit is being applied in
recognition of this.

The Annexation Area will be added to Area 7.
The Department of Code Enforcement will be able to provide services to the Annexation Area with
comparable response times. The Department will respond to calls for service upon the effective
date of the Annexation. Full and dedicated response will be in place within one year of the
effective date of the Annexation.
It is anticipated that the services of this Department will be minimally required to service the
Annexation Area in the first five years. Large apartment complexes are generally well- managed
and self policing, requiring less attention from Code Enforcement. Therefore, the service cost of
the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the
Annexation Area in the first five years.

E. Environmental Services
Environmental Services provides wastewater treatment and administers the City's Solid Waste
service. These services are supported by user fees, and are paid through the Water Works billing
system. Industrial and apartment customers are not served:

F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as
the Mayor's office, the Legal Department, and the Parks & Recreation.
These services are available upon the effective date of the Annexation. Full and dedicated
response for non - capital services will be in place within one year of the effective date of the
Annexation. Costs for these services have not been calculated.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on a county -wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South
Bend Building Department are some of the county -wide agencies and their services that will
continue to provide the same type and level of services to the Annexation Area.
County -wide services will continue to be supported by the County and Township tax rates that will
remain in effect.

SECTION IV. FISCAL IMPACT
1) Essential city services can be made available to the residents (and territory) of the Annexation
Area in a timely and comparable fashion per the requirements of State law and this fiscal plan.
2) The City is financially able to support city services to the territory sought to be annexed.
3) Required improvements made by the petitioner and/or owner of the parcels must be made in
accordance with the standards of the City of South Bend.
4) Required improvements made by the City will be completed within the time frames provide by
State law and this fiscal plan.
5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out.
6) Property tax revenue and land assessment estimates are based on a combination of. 2002
payable 2003 tax rates, taxes paid in previous years by a comparable development, estimates of
units built, estimates of unit values and land assessments, and tax abatements or adjustments, if
any. Tax rates are subject to change every year.
7) Department expenditures and revenues are derived from the City of South Bend Budget.
8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide
average based on a particular budget year. In the case of the proposed development in the
Annexation Area, some of these services will not be required or possibly requested for many years.
Hence, the cost of providing services over the first five years is adjusted, and the costs reflected in
this fiscal impact should be evaluated with this in mind.

ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION
OF SERVICES TO AN ANNEXED AREA IN PORTAGE TOWNSHIP - Arbors at Belleville Park
ANNEXATION.
Dear Ms. White:
I am attaching for filling, the above- referenced resolution, which is a companion to Bill No. 11 -04. This
Bill proposes to annex contiguous territory in Portage Township to the City of South Bend. The resolution indicates
the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the
provision of services, both capital and non - capital in nature, to the territory to be annexed.
The Arbors at Belleville Park is a voluntary petition. It is a 26.17 acre parcel on the east side of Mayflower
Road, north of the St. Joseph Valley Parkway. All public improvements will be required to be done at the expense
of the developer with the exception of the extension of Lombardy Drive which wilt be the responsibility of the City.
I am requesting that the attached resolution be placed on the May 24, 2004 agenda of the Common Council
meeting at which the companion Bill is given Second Reading. I will be attending the meeting as the presenter.
