The Common Council is desirous in promoting educational opportunities throughout the City, and in so doing, is supportive of a citizen -led "Get Booked" reading program where citizens and organizations may place "Book Huts ", AKA Little Free Libraries, on both private and public property throughout the City where citizens of all ages may deposit or withdraw books at no charge. Therefore, the following change needs to be made to the Zoning Ordinance to exempt small accessory structures, as defined, from required setbacks. NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. Chapter 21, Zoning, of the South Bend Municipal Code, Article 11 Definitions, Section 21 -11.02 Definitions, is hereby amended as follows: Accessory (Structure, Building or Use): A subordinate structure, building or use, except for a structure or buildings that is less than four (4) square feet in area and six feet W) in height, that is customarily associated with, and is appropriately and clearly incidental and subordinate in use, size, bulk, area and height to the primary structure, building, or use, and is located on the same lot as the primary building, structure, or use. Section H. Third District In light of that favorable reception by the Council for this concept, and in Fred Ferlic collaboration with the Area Plan staff, I am introducing an ordinance which would Fourth District move this matter forward.
